SUBJECT: TEMPORARY USE PERMIT 2005-601
TEMPORARY CLUBHOUSE; ANDALUSIA
Dear Mr. Perez:
The Community Development Department has approved your request to install a temporary
tent structure from December 23, 2005 to January 16, 2005, pursuant to LQMC Section
9.100.140 (Temporary Outdoor Events). This approval authorizes you to install the tent
pursuant to the application on file as TUP 2005-601, and in compliance with all conditions of
this letter; however, please be aware that this approval only constitutes an allowance to
conduct these events. As the applicant, itis your responsibility to obtain any permits as may
be required below in order to physically set up the event. Of course, any requirements listed
herein, which you may have. already complied with to date, will be considered complied
with.
FINDINGS:
1. The public .roadways surrounding the event areas are capable of handling the
anticipated traffic volumes generated from this event: No significant effects are
anticipated which would be detrimental. to the health, safety and public welfare of
the community, with implementation of the proposed traffic. control plan and
required conditions of approval.
2. .These events are categorically exempt from environmental review under the
California Environmental Quality Act. (CEQA),. under. CEQA Guidelines, Section
15304(e)-
3. Facilities, either existing or temporary, such as parking, restrooms: security,
lighting, seating, and fire, etc., will be provided to accommodate event staff,
visitors, and employees.
4. The required conditions will ensure that tenants and residents within the
surrounding area will not be . adversely affected by this event.
CONDITIONS:
By installing this tent, the applicant agrees to indemnify, defend and hold
harmless the City of La Quinta, its agents, officers, and employees from any
claim, action, or proceeding to attack, set aside -void, or annul the approval of
this Temporary Use Permit.
The City of La Quinta shall have the right to select its defense counsel at its sole
discretion. The City of La Quinta shall promptly notify the applicant of any claim,
action, or proceeding and shall cooperate fully in the defense.
2. The applicant shall comply with all provisions of the La Quinta Municipal Code
(LQMC).
3. Permits for the tent shall be obtained prior to installation. Prior to set-up, please
contact the La Quinta. Building & Safety Department and Riverside County Fire
Safety at (760)863-8886 for any additional requirements of the Fire Marshal. Fire.
lanes shall be established and/or maintained during the event.
4. Portable generators shall be shielded to prevent accidental contact with guests.
Extension cords shall be ground -secured to prevent tripping. Any lighting shall be
directed away from surrounding residential properties. No spot or. searchlights
are permitted.
5. Obtain a building permit for temporary electric service and any other required
items (e.g. bleachers, trailers, portable generators, etc.). Contact the Building
and Safety Department at 760-777-7012 for permit requirements.
6. All temporary electrical wiring shall be secured to prevent physical hazards to the
public and participants. Wiring/cords shall not be subjected to environmental or
physical damage.
7. All temporary outdoor lighting shall comply with Section 9.100.150 of the Zoning
Ordinance. All temporary lighting shall be turned off within one hour of the
conclusion of events. The use of spotlights, searchlights, or other such aerial
illumination devices is prohibited, as per City Ordinance.
8. Roadways/traffic aisles to structures and activities in and around the tent shall be
maintained accessible to emergency vehicles at all times. If used, parking
monitors shall wear light-colored clothing and reflective vests as needed. Flash
lights shall be used after dusk.
9. The event location shall not deviate from the portion of the site identified in the
attached site plan. Adjacent fire lane access shall remain unrestricted at all
times.
10. If any ground excavations are required, please contact. Underground Service
Alert (USA) at 1-800-227-2600 or 1-800-422-4133. This service is free of charge
provided USA is given two days notice prior to commencement of work.
11. The tent shall be installed on December 23, 2005 and shall be removed on or
before January 16, 2005.
The City may elect to add Conditions to this application request to mitigate any problems
that arise not previously addressed herein.
This decision may be appealed to the Planning Commission, provided the written appeal
and filing fee of $175.00 are. submitted to this Department within 15 calendar days. Please
contact this office should you wish to file an appeal, and we will assist you in that regard.
