' As stated in "Calle Tampico -Response to Wissman-MLJ 11-8-10.doc," attached to an e-mail dated November. 16, 2010 from Joseph Larsen of Rutan & Tucker, LLP, to Kathy Jenson and Greg Butler. Date: 11/16/10 CVWD response to inquiry from City of La Quinta re Wissman letter dated 10/2/10 The District installed an 8" water pipeline in 1993 in the public right of way of Calle Tampico in the City of La Quinta. It is located approximately 7 feet south of the centerline of that vacated street. After construction of the pipeline, on February 1, 1994, the City of La Quinta by formal resolution, vacated the right of way reserving as required by state law an easement for the District's pipeline. Dale Wissman, subsequently purchased the property at 51-030 Avenida Carranza, which includes that 30 foot portion south of the centerline of the vacated Calle Tampico. His deed specifically mentions the resolution. Mr. Wissman then installed a block wall around the perimeter of the property and has stated that the wall was required by the City of La Quinta. The 8" water pipeline is 7 feet south and parallels the block wall located along the vacated centerline of Calle Tampico on the north side of 51-030 Avenida Carranza. In addition, the block wall on the east and west property lines crosses'above the 8" water line. This creates two interference issues for the District. First, the 8" water line within 51-030 Avenida Carranza would only be accessible in the event of an emergency by removing a portion of the block wall. Second, the District typically requires a 20' easement (10 feet on each side) for a single pipeline for reasonable access and in this case the District would have difficulty making repairs because of the proximity (7 feet) of the water line to the existing block wall. Now Mr. Wissman wishes to construct a pool within the 30 foot area gained by the vacation of Calle Tampico. This would create yet a third interference as the construction of a pool in this area would further impinge on the Districts ability to access the 8" water line. This will unreasonably interfere with the District's pre-existing reasonable use of the easement. Under these circumstances, the District believes that Mr. Wissman's proposed pool project should not be approved by the City of La Quinta. Box 1504 La Quinta, CA 92247 Dear Mr. Butler, RECEIVED OCT 2 7 2010 BY:4-0� This letter is in response to your Plan Check Correction List of March 8, 2010. After many months of work, and multiple attempts to fulfill the terms of the Plan Check Correction List, I can state emphatically that it is impossible to meet the City of La Quinta's demand for corrections to my submittal of plans for a residential pool at my home (51-030 Avenida Carranza). You may recall that the Plan Check Correction List concerned one major item as follows: "1. Provide a site plan, prepared by a civil engineer or surveyor, licensed to practice in the State of California, showing the location of existing and proposed structures, property lines, and all easements for review. This will be used to verify that the pool is proposed in an allowable location." [Bold from original text]. . In speaking with two surveyors/civil engineers, there is simply no way for me, as a home owner, to garner a site plan whereby a surveyor/civil engineer would sign off on any determination of an easement ostensibly held, but not defined or enumerated in any way by the Coachella Valley Water District (CVWD). That is because, as of yet, CVWD has refused to define the easement surrounding an 8" recirculation water pipe buried approximately 6' from the north property line facing the Bear Creek Path. In addition, the City of La Quinta has never attempted to clarify with CVWD the easement held by CVWD, but which was granted due to the city's own resolution. If it had, there would be no need for a correction list demanding of a homeowner details relating to the easement. On or about May 3, 1994, the City of La Quinta passed Resolution 94-13, which apparently rescinded a previous Board resolution, in order to grant to CVWD an easement stating in relevant part as follows: "However, a reservation of an easement from the proposed vacation for any existing public utilities or public service facilities is needed in order to protect such facilities and provide for their continuing use and maintenance. " (from Part 3, page 2) Putting aside whether or not Resolution -94-13 was properly filed at the time, the city's resolution does not itself define the easement. Greg Butler October 27, 2010 Page 2 If the City's own resolution does not define the easement, and CVWD has itself refused to define the easement, then it is impossible for a surveyor/civil engineer, much less the homeowner, to determine the easement. Simply put, it is impossible to comply with the terms of your March 8, 2010 Plan Check Correction List. That is because the City of La Quinta and CVWD have, perhaps inadvertently, constructed a classic "Catch-22" that cannot be resolved by demanding that a homeowner clarify an easement filed by the City of La Quinta in 1994 and held by CVWD since. What is clear is that as a homeowner I have the right to reasonable develop on the property I own. CVWD does not own my land. It is in both the homeowners' interest and in the City of La Quinta's interest to work together and demand, at the minimum, that CVWD clarify exactly what they claim their easement is. At this time, I believe that the City of La Quinta, and the other eight homeowners/lot owners with the exact same problem, all have a vested interest in working together to consider possible solutions to the problems associated with a hidden, underground waterline running through nine backyards. Here's a few possible avenues: 1. The City of La Quinta could take the time to call CVWD and demand they provide a clear cut answer to exactly the easement they are claiming. This has not been done. 2. The City of La Quinta could ne otiate with CVWD to determine the reasonable easement for homeowners., especially in light of conflicting requirements, such as the city's municipal code. This has not been done. 3. If CVWD continues to be obstinate and ignore the problem, the City of La Quinta could We a new Board Resolution stating specifically the easement granted to CVWD, in light of CVWD's flat refusal to provide exact details as to the claimed extent of the easement. To my knowledge, this has never been considered. 4. The. City of La Quinta could begin working with CVWD and the homeowners/lot owners to move the waterline ata reasonable cost to all, so that development may continue and all future litigation over this issue ceases. This has never been seriously pursued, although most homeowners, and perhaps even a majority on the City Council, would support such a plan in my opinion, (especially if moving the water line ultimately proves cheaper than litigation over the same water line). Greg Butler October 27, 2010 Page 3 In fact, it's probably just cheaper to simply move the waterline. Certainly, the future costs of litigation to CVWD, the City of La Quinta, and the homeowners in the next 20 years, all on the exact same issue, will prove more expensive than the actual construction project.' The City of La Quinta and CVWD have already spent an enormous amount of time and money defending itself against one homeowner.in Casarez v. City of La Quinta (CVWD/Commonwealth Title). If CVWD refuses to clarify the easement, the matter would certainly end up in court in order to bring clarity to the matter, especially as it relates to CVWD's easement. I believe that the City of La Quinta's liability, if any, can be limited or eliminated simply by taking action on behalf of homeowners in the area. Please note that I am not asking for any monetary damages, and I certainly don't want to be engaged in conflict with the City of La Quinta. Instead, I am asking that the City of La Quinta take positive, aggressive action to once and for all clarify, with or without CVWD's assistance, the city's own Board Resolution granting CVWD the easement so that homeowners and future developers know what can and can't be built on the property originally vacated by the City of La Quinta in 1994. Certainly, confusion reigns among homeowners. Ms. Casarez, and myself have both been denied permits to build pools and guest houses at one point by the city. However, another homeowner in the exact same situation at 51-065 Avenida Vallejo was issued a permit by the city to construct a pool, within, the easement CVWD is claiming, and did so. This is no small matter; it has added to the confusion and anger among homeowners, myself included, concerning the above stated issues. As you no doubt are aware, the city has taken no action to clarify or otherwise demand of CVWD a definitive, reasonable easement based on the city's own Resolution 94-13. Instead, the City of La Quinta's Building Department has taken the opposite tack in demanding of me, the homeowner, a determination as to the easement held by CVWD, which was originally granted to CVWD by the city's own Resolution 94-13. This is an unreasonable request in the extreme. I understand that, as per the Plan Check Correction List of March 8, 2010, the city may deny me a permit to build a pool. If that happens, as I expect it will, please consider this I Ironically, CVWD made a field decision in 1994 not to move the waterline nto the utility area and out of the vacated area as originally planned. In fact, it was CV WD's on-site, spur-of-the-moment change that necessitated the City of La Quinta's filing of a second, amended Board Resolution 94-13 to grant an easement to CVWD after the botched construction project. The entire purpose of abandoning the original 4" recirculation line in 1994 and installing an 8" line to the north was to head off any future development problems in the vacated area (and to replace the older, smaller line at the same time). In searching the city's website, 1 find no form that may be used in order to appeal a decision of the building and safety department. According to their response, they typically require a 20 foot easement. Here, the pipeline is located approximately 7 feet from the centerline of the vacated street. That would mean that they require the northerly 17 feet of the property for purposes of maintaining their pipeline. The problem is, the northerly 17 feet required by the district would include 2 feet of Wissman's property that was not within the vacated street. Clearly, those 2 feet cannot be within the easement. As such, the most they can claim is the northerly 15 feet -- which is, I believe, the entire area obtained by the property owner upon the vacation of the street.
