"City"), will receive sealed bids at 78-495 Calle
Tampico, La Quinta, California 92253 In care of the
OffiCEl of the City Clerk, until 10:00 B.m. November
23, 01998 for the construction of certain buildrng
seWElr hook-ups within special assessment dis-
tricts, Projects 98-20.
At the time deSIgnated for receiving bids on said p
ProjElct, the bids will be publicly opened, exam-
ined, and read aloud.
All bids must be rn writing, must be sealed In an
opaque envelope, and adClressed to the CI!Y:' c/o
City Clerk, and delivered or mailed to the City at,

in celre of the Cith Clerk. The envelope shall be

"BID FOR SEWER HOOK-UP AND ABANDON
EXISTING SEWERAGE SYSTEM"
Any bid received after the hour stated above for
any reason whatsoever, will not be considered for
any purpose, but will be returned, unopened, to
the bidder.
The work shall be done under the supervIsIon of
the Department of BUlldrng and Safety and no
work or portion of the work shall be paid for until it
IS approved for payment by the Department of
Building and Safety. This, however, shall not pre-
vent approval of and payment for completed por-
tions of work as It progresses. Payment made for
_ completed portions of work shall not constitute fi-
nal acceptance of these portions or of the com-
pleted proJect.
Each bidder must submit a proposal ~o the CIty,
c/o (;>rty-Gteril:,' -on standard forms ~avallable In the
P Department of Buildrng and Safety, 78-495 Calle
Tamplco, La Qurnta, 92'253. Said proposal is to be
accompanied by a cash deposit, a certified or ca-
shIer's check, or bid bond, made payable to the
City, in an amount not less than 10 percent of the
., total bid submitted. Said cash deposit or check
shall be forfeited or said bond shall become pay-.......
able in the event the bidder depositing the same
does not within fifteen (15) calendar days after
written notice execute the Contract.
The successful bidder Will be required to furnish ......
"Vlth the Contract a Faithful Performance Bond rn
the amount of 100 percent of the contract pnce,
and el Payment Bond in the amount of 100 percent
of thEl contract price. The successful bidder will al-
so bEl required to furnish certificates of insurance
eVidencing that all Insurance coverage as reqUired
by the Specifications has been so secured.
The (:ontractor may, at contractor's sole cost and
expense, subsltute securities eqUivalent to any
moniEls Withheld by the City to insure performance
under the Contract. Such securites shall be depos-
ited with the City, or a state or federally chartered
bank as escrow agent, who shall pay such monies
to tht~ contractor upon satIsfactory completion of
the Contract. Such securities, If deposited by the
contractor, will be valued by the City, whose deCI-
sion ,::>n valuation of the securities shall be fmal.
The contractor shall be the beneficial owner of any
secUrities substituted for monies withheld and shll
receive any accrued Interest thereon. SecuritIes eli-
gible for Investment shall include those listed in
Government Code Section 16430 and Government
Code Section 4S90. No such substitution shall be
acCetJted until the escrow agreement, letter of
~t~~ t~O;~d o~US~~rtztro~~~ ~njie~~r a~~fr~~~t ~~=
ceptable by the City's attorney. The CIty reserves
the ri'9ht to waive any informalities of irregularities
or to reject and then negotiate the amount and/or
terms of any bid With any bidder, and to be the
sole iUdilh~bf the merits of the respective bids re-
ceivecj. ~f the contract, if made WIll be
on the basis of the lowest cost to the City (except
as outlined In Resolution RA 93-12 on page NIB-4),
to a responsible bidder whose proposal comphes
with all the prescribed requirements.
No bidder may withdraw his bId for a period of
thirty (30) days after the bid opening.
Contract Documents, including the SpeCifications,
may be examined at or be obtained from the office
of thEl BUilding and Safety Department, City of La
QUlnta. The Contract Documents Will be mailed up-
on request.
Pursuant to California Labor Code Section 6707,
each bId for the construction of pipeline, sewer or
storm drains or similar trenches or open excava-
tions which are five feet or deeper shall have ade-
quate sheeting, shoring, and bracing or equipment
method for the protection of life and limb, which
shall conform to applicable safety orders.
The lwccessful bidder Will be required to pay not
less than the I'revalllng wage scale determined by
the Director 0 the California Department of Indus-
trial Flelations, copies of which scale are on file in
the office of the City Clerk, and shall be made
available to any Interested party on request. Fur-
ther, the City snail cause a copy of the prevailing
wage scale to be posted at each job site during
the course of construction.
The contractor shall execute the Contract and shall
secune all Insurance and bonds required within five
(S) wClrkin~ days after the contractor has been noti-
fied in Writing of the award on the Contract. The
contractor shall not commence construction or or-
der equipment until the CIty has given the Contrac-
tor a Notice to Proceed. The conlractor shall com-
menc.e construction Within five IS) working days af-
ter the Notice to Proceed and shall complete all
the work and improvements Within five (5) working
days for each listed address awarded to him after
the Notice to Proceed. The total project shall be
completed Within nmety (90) days.
Payments Will be made In cash to the contractor In
accordance With the prOVisions of the Sp'ecifica-
tions and on itemized estimates duly certified and

The contractor shall be the beneficial owner of any
securities substituted for monies withheld and

letter of credit, form of security and any other
