SUBJBCT: City Policy Regarding Development Across Lot Lines.
Dear Mr. Dougherty:
Per your request on February 28, 1986, this letter defines the City of
La Quintals policy regarding development across lot lines.
The City does not issue building permits for structures which are located
across lot lines. Structures include walls, swumung pools, and houses.
To facilitate development, the City's Building Division will issue permits,
for projects which build across lot lines when an application for either a
parcel merger or lot line adjustment has been submitted and certified as
complete by the Planning Division. In this case, an occupancy permit and
utilities will not be released until the Riverside County Recorder's Office
has recorded the merger/lot line adjustment.
For developments in the Cove area, the La Quinta General Plan encourages the
merging of smaller residential lots. The Community Development Department .
is delighted that you have chosen to build upon two lots in the Cove area.
We also understand your problem in that the property owner, for whom you are
building, is out of the country and is therefore unable to sign the appropriate
parcel merger application. Tb accommodate your needs and facilitate development
in the City, the Community Development Director has authorized the Building
Division to issue you a swimming pool permit (across lot lines) upon your
submittal of the parcel merger application and application fee.
In addition, a letter should be included specifying that the owner's consent
has been obtained and that the application will be signed by the owner at a
later date. The letter should also indicate that it is understood that occupancy
permits and utilities for the improvements upon both subject parcels will not be
released until the parcel merger has been recorded.

Our buyer, Mr. Sarkis, is having a home constructed on,one of the lots and a swimming
pool on the other one. At such time as our escrow closes both lots will be given
the same Assessor's Parcel -number because at no time in the future would the lot
with the home on it, NOR the lot with the swimming pool be sold alone. They would
always be sold as a unit.
I sincerely hope this helps the matter of the builder being issued the proper permits
to enable construction of the swimming pool, and ultimately the closing of our escrow.

On November 1, 1985 a representative of our: firm performed density
tests on the fill placed in the building area -on the above referenced
project. Tests were performed at random locations in accordance with
ASTM. 2922-81 and ASTM 3017-78 Nuclear * Density Test Procedure.
Tests performed as per authorization of Clint Dougherty.
The estimated locations of the tests are presented on the attached plan
with their results being summarized on the attached test report sheet.
A total of two (2) density tests were performed. Test results indicate
that a minimum of ninety percent (90%) of relative compaction has
been obtained within the areas tested . The maximum density -optimum
moisture was determined in the laboratory in accordance with ASTM
1557-78, Method A, five (5) layer curve. Test results are as follows:
