Dear Mr. and Mrs. Dier:
Members of the Architectural Committee have reviewed the August 23; 2004 resubmitted plans
from The .Leak Detector Company; pertain to the construction of a new. pool and spa_ related
equipment. and hardscape and landscape.
The Committee now approves the application Aird plan, subject to the following conditions:
I. The pool/spa equipment surround wail will be painted to. match the house and the access gate be
of wrought Iron with wood backing and be compatible with the entry gate.
2. All pool and spa .lights be positioned so as not to cast light directly on adjacent owners.
3. A siitnple` Isiidscape plan for the buffer area between the pool and the golf course be submitted
for revi.ew and approval by the Landscape Committee prior to installation of plantings. The plan
should show type of plants, location, provisions .for irrigation, and any proposed lighting. Owners
may contact Mr. Dale Brooks, Landscape Chair, for suggested plants. Approval of the plan and the
installation will be a requirement for "final approval" of the proposed proiect_
4, The Committee understands that the Owners would prefer not to move the pool/spa facility to
meet the requested 6' north side setback. The Committee feels that 3` is too close to the adjacent
property; but, given the narrowness of the lot. request that the Owners compromise. to a 41/2'
setback from .the wall to the edge of the spa wall.
5. The Owners are reminded to get an inspection and approval from the City of La Quinta for the
location and installation of the gas line.

6. The Committee understands that the pooVspa will be hand dug and approves this approach. But,
the Owners are reminded that they arc responsible for assuring that the street and front yard area are
cleaned daily and that any and all damage caused by the construction process is repaired, coincident
with the completion of construction, to the same quality level that now exist.
7. Please note that we are in receipt of your construction deposit of $2,500, but have not received
your application fee of $50. Please forward this amount at your earliest convenience.
Please keep this letter for your records, in the event you are ever questioned about these
modifications.
