ADJOURNMENT - - - - - - - - - - - - - - - - - - - - - - - - - - - - * * * NO STUDY SESSION ON JUNE 22, 1987 * * * MR/AGENDA.PLC DATE: PROJECT PROPOSAL: APPLICANT LOCATION: ENVIRONMENTAL CONSIDERATION: BACKGROUND STAFF REPORT PLANNING COMMISSION MEETING JUNE 23, 1987 ZONING ORDINANCE AMENDMENT NO. 87-003 NEW CITY SIGN REGULATIONS CITY OF LA QUINTA CITY WIDE An Environmental Assessment has been prepared as required by the California Environmental Quality Act (CEQA). The initial study evaluation has determined that the amendment will not present a significant adverse impact and a Negative Declaration has been prepared. Currently, the City is using the 1982 edition of the County Zoning Regulations (Ord. #348) which became effective August 29, 1982, with the adoption of City Ordinance No. 5. Advertising regulations are found in Article XIX. The existing advertising regulations have four major components: Outdoor Advertising Display; On -Site Advertising Structure and Signs; For Sale, Lease or Rent Signs; and Subdivision Signs. The existing regulations do not provide for flexibility or encouragement of good sign practices. In addition, the County Sign Regulations have undergone major modification by the County since 1982. GENERAL PLAN The recently adopted General Plan necessitates the preparation of a new Zoning Ordinance. One major component of the Zoning Ordinance is the sign regulations. The new sign regulations specifically MR/STAFFRPT.006 1 implement three (3) sign -related policies of the General Plan, which are: CULTURAL RESOURCES ELEMENT - Scenic Highways/Vistas Policy 5.2.4 Prevention of visual blight shall be enhanced by addition of a comprehensive sign ordinance. COMMUNITY DEVELOPMENT ELEMENT - Village Commercial Policy 6.3.5 The City shall prepare and adopt a Specific Plan for the Village at La Quinta area as soon as possible with specific design standards, including landscaping, signing, building architecture and streetscape criteria. COMMUNITY DEVELOPMENT ELEMENT - Urban Design Policy 6.5.6 Special themes including median landscaping, parkway landscaping, street lights, perimeter walls, signing, and related design treatments shall be developed. COMPARISON WITH OTHER CITIES Prior to the preparation of draft sign regulations, existing City ordinances, ordinances from other cities, County, industry literature and other planning -oriented professional publications were reviewed. The draft document has been made available to the general public, and to the Chamber of Commerce in particular. The sign regulations for cities within the Valley are similar in that the approach is to provide integrated project/sign development. Exhibit 1 is a comparison of typical sign regulations for various cities in the Valley. Each city regulates the amount of signage differently depending upon what city image is to be achieved. ANALYSIS 1. The draft regulations originally prepared by the Planning Department incorporate the policies of the General Plan and general comments made by the Planning Commission at previous study sessions. The comments expressed were: a. Provide flexibility; b. Encourage signage to project development. and be integrated into the overall 2. Significant points for attention within the regulations are noted as follows: a. There are two types of reviews contemplated: The Standard Sign Review, which is conducted by Staff, and the Planned Sign Program, which is considered by the Planning Commission. MR/STAFFRPT.006 When only one sign is proposed, Staff will administratively process the request using the Standard Sign Review Program. However, if two or more signs are contemplated or if site development review is otherwise required of the Planning Commission, the sign program will receive Commission consideration. This process is termed a Planned Sign Program. In actual practice, most new commercial development in La Quinta will occur and be established by means of Commission review, and a sign program will be part of this larger submittal and review. The Commission, in taking action on a request, may make adjustments, such as permitting additional sign area, number of signs, alternative location and different types of signs. b. The decision of the Planning Director or Planning Commission is final unless appealed. The regulations also identify exempt, prohibited and temporary signs. C. The permitted sign regulations (Section 9.45.120) are found on pages 14 through 19. This section identifies the general regulations which are used as a guide during Planning Commission review. The major types of residential and some special application for commercial uses have been noted. Those uses not otherwise individually listed are reviewed using the regulations (Section 9.45.120 B.) found on page 17. d. Existing signs are permitted to remain unless the sign is a danger to the public, or was installed or enlarged without a permit. e. Outdoor advertising signs are permitted in the Commercial Park land use designation of the General Plan. This does not preclude other temporary off -premise signs such as subdivision directory signs, which are permitted elsewhere in the regulations. 3. Special advertising devices, which include searchlights, banners and balloons, are governed under Chapter 5.64 of the La Quinta Municipal Code and are not addressed within the proposed sign regulations. PROCESS The Public Hearing is intended to provide public citizens opportunity to comment on these draft regulations. With the comments received and the Commission's input, at the close of the Public Hearing(s) the draft document will be altered as needed to a "Final Draft" version and transmitted to the City Council for their review and action. NO. 348, ARTICLE XIX) NG ORDINANCE TEXT AMENDMENT NO. 87-003 WHEREAS, the Planning Commission of the City of La Quinta, California, did, on June 23, 1987, hold a duly noticed Public Hearing in accordance with Section 65854 of the California Government Code to consider amending Riverside County Ordinance No. 348 (which was adopted by reference by City Ordinance No. 5, operative August 29, 1982) by repealing Article XIX, Advertising Regulations, and replacing it with new City Sign Regulations; and WHEREAS, said ordinance amendment has complied with the requirements of "The Rules to Implement the California Environmental Quality Act of 1970" (County of Riverside, Resolution No. 82-213, adopted by reference in City of La Quinta Ordinance No. 5), in that the Planning Director has determined after initial study (Environmental Assessment No. 87-074) that the amendment will not have a significant adverse impact on the environment and that a Negative Declaration should be filed; WHEREAS, at said public hearing, and upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said Planning Commission did find the following facts to exist to justify this approval of said ordinance amendment. 1. The new sign regulations are consistent with the La Quinta General Plan policies 5.2.4, 6.3.5 and 6.5.6, which identify the need for comprehensive sign regulations to prevent visual blight. 2. Approval of the amendment will not result in any significant adverse environmental impacts. 3. The amendment provides for flexibility and encourages a total sign design approach as it relates to the project development. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby confirm the conclusion of Environmental Assessment No. 87-074, in that the approval of this zoning text amendment will not result in a significant adverse impact on the environment, and that a Negative Declaration is appropriate for filing; MR/RESODRFT.006 ® 0 3. ROLL CALL Chairman Thornburgh requested Commissioners Moran, Steding, and Chairman Thornburgh. 7:00 p.m. the Planning Commission Flag Salute was led by the roll call. Present: Brandt, Vice Chairman Walling, Staff Present: Planning Director Murrel Crump and Principal Planner Jerry Herman. Chairman Thornburgh introduced Works, Frank Reynolds, who gave his background and experience. PUBLIC HEARINGS the new Director of Public a brief account regarding Chairman Thornburgh introduced the hearing items as follows: A. General Plan Amendment No. 86-016 - A request by Carl Meisterlin to amend the General Plan Land Use Map from Low and Medium Density Residential to High Density Residential for the property located in the northeast corner of Miles Avenue and Washington Street. 1. Planning Director Murrel Crump reviewed the request per the information contained in the Staff Report, a copy of which is on file in the Planning Department. 2. Chairman Thornburgh opened the Hearing for public comment. The Applicant, Mr. Carl Meisterlin, addressed the Commission. Mr. Meisterlin gave a brief history of his involvement with the property, dating back to his development plans prior to annexation. Mr. Meisterlin then introduced Mr. David Schey, from Benchmark MR/MIN06-09.DFT Consulting Services, who elaborated on their requested General Plan Amendment and further identified the tentative project. Mr. Schey introduced Mr. Gary Ferris, the architect representing the Applicant, who used illustrations to discuss the project. There being no further public comment, Chairman Thornburgh closed the hearing. Chairman Thornburgh then opened the matter for Planning Commission discussion. The Commission members discussed the request as submitted. The concerns of the Commissioners are summarized as not setting a precedent for creating a lot of high density in the area; the amount of Mixed -Use Commercial acreage along Highway 111, with its potential High Density development option; and their prior commitment to maintaining a lower density land use designation for that area generally north of Miles Avenue. A motion was made by Commissioner Brandt and seconded by Commissioner Moran to recommend to the City Council denial of General Plan Amendment No. 86-016, a request to amend the La Quinta Land Use Map from Low and Medium Density Residential to High Density Residential for the area in the northeast corner of Miles Avenue and Washington Street, per Planning Commission Resolution No. 87-005. 5. Upon a roll call vote, the motion was approved with Commissioner Walling voting against. IV. PUBLIC COMMENT No one wished to address the Commission. V. CONSENT CALENDAR Motion was made by Commissioner Steding and seconded by Commissioner Walling to approve the Planning Commission minutes of May 26, 1987, as submitted. Unanimously adopted. VI. BUSINESS A. Future agenda/discussion items were identified at this time. The Dark Sky Ordinance, water improvements in the Cove area, and design alternatives for building pad heights in the Cove area were requested to be on a future agenda. MR/MIN06-09.DFT 11 VII. OTHER A. Discussion Item: Sign Regulations 1. Chairman Thornburgh requested Staff presentation on the Sign Regulations. Planning Director Crump reviewed the draft regulations per the attached memo and further identified clarification issues. Chairman Thornburgh requested discussion among the Commissioners, who had no recommended changes to propose at this time. They, therefore, accepted the draft regulations and requested that the draft regulations, modified per the clarification conditions, be compiled in a hearing document and distributed to the Chamber of Commerce and the City Council, and further identified June 23, 1987 as the hearing date for the matter. VIII. ADJOURNMENT A motion was made by Commissioner Brandt and seconded by Commissioner Moran to adjourn to a regular meeting on June 23, 1987, at 7:00 p.m., in the La Quinta City Hall, 78-105 Calle Estado, La Quinta, California.
