1. The proposed development is within the Duna La Quinta
Specific Plan. This plan provided for development of
various phases, each having developed at different
densities. This proposal is within the approved maximum
density and number of units of the Specific Plan.
2. The project was adequately reviewed in the Certified
Environmental Impact Report for Duna La Quinta Specific
Plan. The traffic generation attributed to this
development is less than anticipated as noted within the
EIR.
3. The Duna La Quinta Specific Plan was conditioned to
provide a City neighborhood park, or, as an alternative,
an agreement to provide other park land. The Applicant
proposes to satisfy the condition with a park elsewhere.
Therefore, the City is in a position to exercise some
degree of choice as to securing in -lieu improvements to
existing parks or possibly the development of parts of
the storm water system into a lineal park. A condition
to address this prior Specific Plan condition has been
recommended.
Permits and/or clearances from the City Engineer
(encroachment permits; public and private street
improvement plan; grading plan, including geological,
soils, hydrology, hydraulic studies/reports; and drainage
disposal facilities plan), Coachella Valley Water
District (grading, landscaping and irrigation, sewer, and
water plans), and Fire Marshal (water system and
emergency access) are needed prior to Final Map
approval. Desert Sands School District mitigation fees
are required prior to issuance of any residential
building permits.
Perimeter landscaping within the setback area between the
proposed perimeter walls and public street rights -of -way
has not been provided.

6. A suggestion for a secondary access to Calle Rondo or
Calle Tampico was advanced, but not incorporated as part
of the tract layout.
7. The intersection of Park Avenue and Calle Tampico will be
designed with a knuckle to provide safe turning movement.
8. A design for Phase 5 (multi -family) has not been
submitted at this time.
9. A number of the conditions of the Duna La Quinta Specific
Plan apply to this particular project. Pertinent
conditions have been repeated in the set of recommended
tentative map conditions.
10. Maintenance of common areas will be the responsibility of
a homeowners association. A condition has been provided
to ensure the maintenance of these areas. The landscape
buffer areas between the perimeter wall and street
right-of-way can be included into a lighting and
landscape maintenance district (Streets and Highway Code
22600, et seq.).
FINDINGS:
Findings for the proposal can be found in the attached draft
Planning Commission Resolution No. 88-007.
RECOMMENDATION:
By adoption of the attached Planning Commission Resolution No.
88-007, recommend to the City Council concurrence with the
environmental analysis and approval of Tentative Tract Map No.
23292, subject to conditions.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF LA QUINTA, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF TENTATIVE TRACT MAP NO.
23292, TO ALLOW THE CREATION OF A
SINGLE-FAMILY LAND SALES SUBDIVISION
AND MULTI -FAMILY LOT.
CASE NO. TT 23292 - LANDMARK LAND COMPANY INC.
WHEREAS, the Planning Commission of the City of La
Quinta, California, did, on the 12th day of April, 1988, hold a
duly -noticed Public Hearing to consider the request of Landmark
Land Company Inc. to subdivide 95.1 acres into 193
single-family lots, 1 multi -family lot, and numerous street and
common lots, generally located between Avenue 50 and the Calle
Tampico extension, and Calle Rondo and Park Avenue alignment,
more particularly described as:
A portion of Section 6, Township 6 south,
Range 7 east, SBBM; and,
WHEREAS, said tentative map has complied with the
requirements of "The Rules to Implement the California
Environmental Quality Act of 1970" (County of Riverside,
Resolution No. 82-213, adopted by reference in City of La
Quinta Ordinance No. 5), in that the Planning Director has
determined that the proposed tentative tract has been
previously assessed in connection with the Duna La Quinta
Specific Plan for which an Environmental Impact Report was
approved; and,
WHEREAS, at said Public Hearing, upon hearing and
considering all testimony and arguments, if any, of all
interested persons desiring to be heard, said Planning
Commission did find the following facts to justify the approval
of said tentative tract map:
That Tentative Tract Map No. 23292, as
conditionally approved, is consistent with the Duna
La Quinta Specific Plan, the goals, policies and
intent of the La Quinta General Plan, and the
standards of the Municipal Land Division Ordinance.

environmental concerns of this tentative tract;
3. That it does hereby approve the above -described

1. Tentative Tract Map No. 23292 shall comply with the
requirements and standards of the State Subdivision Map
Act, conditions of Duna La Quinta Specific Plan, and the
City of La Quinta Land Division Ordinance, unless
otherwise modified by the following conditions.
2. This tentative tract map approval shall expire two years
after the original date of approval by the La Quinta City
Council unless approved for extension pursuant to the
City of La Quinta Land Division Ordinance.
3. Prior to final tract approval, the Subdivider shall
comply with development requests of the Fire Marshal,
Public Works Department, and Coachella Valley Water
District. Written clearances from these agencies must be
provided to the Planning and Development Department.
TRAFFIC AND CIRCULATION
4. Subdivider shall comply with all requirements of the
Public Works Department, including the following:
a. Dedication of all necessary public street and
utility easements as required. At a minimum, the
following half -street rights -of -way shall be
provided:
Avenue 50 ........... 50 feet
Calle Tampico ....... 30 feet
Calle Rondo ......... 30 feet
Avenida Ultimo ...... 30 feet
b. All street improvements shall be constructed to the
requirements of the City Engineer and the La Quinta
Municipal Code, as follows:
(1) Full street improvements along Calle Tampico
from Washington Street to the intersection of
Calle Rondo and Calle Tampico, including
appropriate street transition.
(2) Half -street improvements along Calle Rondo
and Avenida Ultimo.

(3) Three -quarter -street improvements along Calle
Tampico from the intersection of Calle Rondo
eastward to Park Avenue, and Park Avenue from
Calle Tampico to Avenue 50.
(4) Three -quarter -street improvements along
Avenue 50 for the length of the tract. These
improvements shall include an appropriate
raised median, and eight -foot sidewalk with a
two percent cross slope.
(5) The private streets are to be developed
pursuant to City construction standards for
public streets.
C. Access along Avenue 50 for Lot 195 is prohibited.
d. Subdivider shall dedicate, with recordation of the
final tract map, access rights to Avenue 50, Park
Avenue, Calle Tampico, and Calle Rondo for all
individual lots which front or back-up to the
right-of-way.
e. Provide adequate storm water retention.
f. The Subdivider shall comply with the action of the
Traffic and Safety Committee for the installation
of (1) a City traffic signal at the intersection of
Avenue 50 and Park Avenue (with concurrence of
Council), (2) raised median design along Avenue 50,
and (3) bikeway path along Calle Tampico and Park
Avenue.
g. Provide a dimensioned, detailed Park Avenue access
entry design, including access control system
location and turn -around area, for the purpose of
demonstrating adequate stacking area for
development entry.
h. Provide 10 copies of the revised tentative tract
maps, pursuant to the Conditions of Approval, via
the Planning and Development Department.

5. A minimum 20-foot landscaped wall setback shall be
required along Avenue 50, and 10-foot landscape wall
setback along Calle Tampico and Park Avenue. Design of
the setback areas shall be approved by the Planning and
Development Department. Along Avenue 50, the landscaping
should incorporate slope stabilization. Setbacks shall
be measured from ultimate right-of-way lines.

a. The minimum setback area may be modified to an
"average" if a meandering or curvilinear wall
design is used.
b. Setback areas shall be established as a separate
common lot and be maintained as set forth in
Condition No. 15, unless an alternate method is
approved by the Planning and Development Department.
6. The Applicant shall prepare, for Planning Commission
review and approval, architectural standards for the
future residences. These standards shall be recorded
within the C.C. & Rs of the tract.
7. Any lots within 150 feet of the ultimate right-of-way of
Avenue 50 shall be limited to one story, not to exceed 20
feet in height.

8. All perimeter tract boundary walls, landscaping, and
streets shall be installed/constructed as part of Phase
One improvements.
9. A temporary emergency access prior to implementation of
Phase Four shall be provided as may be required by the
Fire Marshal.
10. Provide temporary turnarounds at all dead-end streets.
PUBLIC SERVICES AND UTILITIES
11. The Subdivider shall comply with the requirements of the
City Fire Marshal.
12. The Subdivider shall comply with all requirements of the
Coachella Valley Water District. Any necessary parcels
for district facility expansion shall be shown on the
final map and conveyed to the Coachella Valley Water
District, in accordance with the Subdivision Map Act.
WALLS. FENCING. SCREENING AND LANDSCAPING
13. Prior to issuance of a grading permit, the Subdivider
shall submit to the Planning and Development Department
an interim landscape program for the entire tract, which
shall be for the purpose of wind erosion and dust control.
14. Prior to final map approval, the Subdivider shall submit
to the Planning Division for review and approval a plan
(or plans) showing the following:

a. Landscaping, including, but not limited to, plant
types, sizes, spacing locations, and irrigation
system for all common areas.
b. Location and design detail of any proposed and/or
required walls.
C. Exterior lighting plan, emphasizing mitigation of
light and glare impacts to surrounding properties.
15. Prior to final map approval, the Subdivider shall submit
criteria to be used for landscaping of all individual lot
front yards. At a minimum, the criteria shall provide
for two trees and an irrigation system.
MISCELLANEOUS
16. Provisions shall be made to comply with the requirements
of the City's adopted Infrastructure Fee Program in
effect at the time of issuance of building permits.
17. A noise study shall be prepared by a qualified acoustical
engineer, to be submitted to the Planning and Development
Department for review and approval prior to final map
approval. The study shall concentrate on noise impacts
on the tract from perimeter arterial streets, and
recommend alternative mitigation techniques.
Recommendations of the study shall be incorporated into
the tract design. The study shall consider use of
building setbacks, engineering design, building
orientation, noise barriers (berming and landscaping,
etc.), and other techniques with attention given to
avoiding the isolated appearance given by
continuously -walled developments.
18. The Subdivider shall make provisions for maintenance of
all common areas by the following methods prior to final
map approval:
a. Subdivider shall consent to the formation of a
maintenance district under Chapter 26 of the
Improvement Act of 1911 (Streets & Highways Code,
Section 5820 et seq.) or the Lighting and
Landscaping Act of 1972 (Streets & Highway Code
22600 et seq.) to implement maintenance of all
street and landscaped buffer areas. It is
understood and agreed that the developer/Applicant
shall pay all above costs of maintenance for said
improved landscaped areas until such time as tax
revenues are received from assessment of the real
property.

b. The Subdivider shall submit to the Planning and
Development Department a Management and Maintenance
Agreement, to be entered into with the lot owners
of this subdivision, in order to insure that
private streets and common lots/facilities will be
maintained. A homeowner's association shall be
created with the unqualified right to assess the
owners of the individual lots for reasonable
maintenance costs. The association shall have the
right to lien the property of any owners who
default in the payment of their assessments.
The private streets and common lots/facilities to
be maintained are as follows:
(1) Storm water retention system.
(2) Lots C through J, L through U, Lots X through
AA (Lots V, W, A, B, and K are public street
dedications).
(3) Common Lots 197 through 201.
19. The Applicant acknowledges that the City is considering a
City -Wide Landscape and Lighting District and, by
recording a subdivision map, agrees to be included in the
District. Any assessments will be done on a benefit
basis, as required by law.
20. The developer shall retain a qualified archaeologist
immediately upon discovery of any archaeological remains
or artifacts and employ appropriate mitigation measures
during project development.
21. The Applicant shall provide an acceptable alternative to
the park dedication as required in the Duna La Quinta
Specific Plan. The alternative shall include (1)
dedication of parkland elsewhere, or value in -lieu fee,
or a combination of the two; or (2) pay the value
equivalent in development of an existing City park or
proposed park. The value shall be based upon 7-1/2 acres
of developable land within this tract.
22. The appropriate Planning approval shall be secured prior
to establishing any of the following uses:
a. Temporary construction facilities;
b. Sales facilities, including their appurtenant
signage;
C. On -site advertising/construction signs.

CALL TO ORDER
A. The meeting was called to order at 7:00 p.m. by
Chairman Walling. The Flag Salute was led by
Commissioner Bund.
ROLL CALL
A. Chairman Walling requested the roll call.
Present: Commissioners Bund, Zelles, Moran, and
Chairman Walling. Commissioner Steding was absent.
B. Staff Present: Planning Director Murrel Crump,
Principal Planner Jerry Herman, and Department
Secretary Mariellen Ratowski.
C. A motion was made by Chairman Walling and seconded
by Commissioner Moran to excuse Commissioner
Steding from the meeting. Unanimous.
HEARINGS
Chairman Walling introduced the Public Hearing Item
as follows:
A. Change of Zone No. 87-029 and Tentative Parcel Map
No. 22596; a request by Michael Shovlin for a
Change of Zone from R-3 to C-P-S for +.9 acres of
a 6.2-acre parcel and Parcel Map to create three
commercial parcels, located on the north side of
Highway 111, +700 feet west of Washington Street.
1. Planning Director Crump presented the
information contained in the Staff Report, a
copy of which is on file in the Planning and
Development Department. During this
presentation, Mr. Crump revised Condition No.
7, replacing the phrase "...two approved
parcels." with "...eastern parcel and the
property line to the east."

2. Chairman Walling opened the Public Hearing.
The Applicant's representative, Mr. Bob
Lotito of KWL Engineers, addressed the
Commission, requesting clarification of
Condition No. 7 and expressing
dissatisfaction with Condition No. 3, which
provides for the creation of two parcels
rather than three. Mr. Michael Shovlin,
Applicant, addressed the Commission
explaining why he proposed three parcels.
3. There being no further public comment,
Chairman Walling closed the Hearing and
opened the matter for Commission discussion.
4. Following discussion, a motion was made by
Commissioner Zelles and seconded by
Commissioner Moran to adopt Planning
Commission Resolution No. 88-004, approving
Change of Zone No. 87-029, and Planning
Commission Resolution No. 88-005, approving
Tentative Parcel Map No. 22596, with
Conditions as amended. Following a roll call
vote, the motion was unanimously adopted.
IV. PUBLIC COMMENT
No one wished to address the Commission.
V. CONSENT CALENDAR
A motion was made by Commissioner Moran and
seconded by Commissioner Zelles to approve the
minutes of March 8, 1988. Unanimously approved.
VI. BUSINESS
Chairman Walling introduced the Business Item as
follows:
A. Redevelopment Project Area No. 2; a request by the
City of La Quinta selecting the redevelopment
project area and approving the preliminary plan,
for an area located north of Avenue 50.
1. Commissioner Zelles excused himself from
consideration of the matter due to a
potential conflict of interest. The Staff
Report, a copy of which is on file in the
Planning and Development Department, was
presented by Consultant David Meyer.
2. Following discussion, a motion was made by
Commissioner Bund and seconded by

Commission Resolution No. 88-006, approving
the adoption of Area No. 2. Unanimous.
OTHER
Continued discussion of joint Council/Commission
meeting - it was the consensus of the Commissioners
that the session should be held after the
completion of their Highway 111 study, and that
they should compile suggestions for discussion
topics.
ADJOURNMENT
A motion was made by Commissioner Moran and
seconded by Commissioner Bund to adjourn to a
regular meeting on April 12, 1988, at 7:00 p.m., in
the La Quinta City Hall, 78-105 Calle Estado, La
Quinta, California. This meeting of the La Quinta

MINI -PARK PLANS
In your previous meeting packet was included, for your
information, an advance copy of a report prepared for the City
Council on the Cove Mini -Park plans containing three major
alternatives (no park on the site, 2-1/2-lot park, or 4-lot
park) with some other options. At their meeting of April 5th,
City Council heard residents' comments, discussed alternatives,
and gave Staff direction.
STAFF DIRECTION
1. Narrow the range of alternatives to the 2-1/2-lot-size
park, oriented primarily to preschool and early school age
children, and include some low level lighting and security
lighting, striving not to create a glare problem for
neighboring properties. Do not include restrooms in the
plans.
2. Proceed with refinement of park planning and design. As a
first step, review the plans for the park with the
Planning Commission and the Community Services
Commission. Report back their separate recommendations at
the Council meeting of May 3rd.
3. Develop strategies and make arrangements to implement the
park construction immediately after a final Council
decision on May 3rd, so that as much construction as
possible can be accomplished during the remainder of this
fiscal year.

the plans at your Study Session. At your regular meeting as a
Business Item, you are invited to review the plans and

After consideration of the plans for the Mini -Park, adopt, by
Minute Motion, a recommendation to City Council of one of the
following alternatives:
A. That City Council adopt the plans for the 2-1/2-lot
park, with lighting, as presented; or
B. That City Council adopt the plans for the 2-1/2-lot
park, with lighting, as presented with the
following alternatives or refinements...; or

STATUS REPORT ON VILLAGE ZONING PACKAGE

experiencing continued growth and before long the market
potential will be recognized by more commercial ventures,
resulting in more small projects requesting plot plan reviews.
Overall, consistent, high quality development of the Village
depends on early application of the development guidance to be
made possible through the zoning amendments.
The amendments occur in two areas. The first is a "package" of
text amendments. The second is an amendment of the official
zoning map which changes the designation of the zoning on the
land consistent with the new text. Our strategy is to work
first on the adoption of the text, then immediately following
that, 'present the map for adoption. (The property owner needs
the text to appreciate the consequences of the map changes.)
The "Village Package" of Text Amendments:
The amendment to the text of Land Use Ordinance has a number of
coordinated pieces:
A. Creation of a new Zone "C-V (Commercial Village)" as a new
Chapter 9.90. This chapter implements the General Plan
Land Use designation of "Village Commercial" and the

content of the Village Specific Plan. The chapter
presents the Commercial Village Zone, its purposes and
themes; the array of permitted uses, accessory uses, not -
permitted uses, and conditional uses; refers to the
requirements for commercial plot plan and design reviews;
and sets up four sub -zones -one for each portion of the
Village; then elaborates the uses and development
standards for each sub -zone. (The double spaced draft is
now 58 pages.)
B. Creation of a new residential zone "R-V
(Residential -Village)," a new Chapter 9.50, to support the
special themes of the Village Specific Plan in the
residential areas surrounding the Village Commercial
areas. (The double spaced draft is now six pages.)
C. Creation of a new procedure in a new Chapter 9.183 "Design
Review" along the lines of the concept discussed and
recommended earlier this year. (The double spaced draft
is now 13 pages.)
D. Amendment of Chapter 9.180, "Plot Plans", to include a
reference to Design Review as one component of
applications. (1 page)
E. Amendment of Chapter 9.182, "Residential and Commercial
Development Plot Plans", to include Design Review
compliance among the requirements for approval of a plot
plan. (1 page)
F. A total re -write of Chapter 9.160, "Off -Street Parking",
to accomplish two objectives:
1. To make possible a response to the unique parking
constraints in the Village Commercial Zone, and
2. To up -date the obsolete (County origin) parking
standards now contained in the Ordinance.
This component will serve not only the Village Zoning package,
but is also an early installment in the overall Land Use
Ordinance reconstruction which is a top priority for advanced
planning activities for this year.
This section is partially complete. The portion of the draft
which addresses the Village (objective #1) is complete.
(Double spaced draft is 11 pages.) The second objective is not
as far along and will take more work. We are evaluating the
present standards, looking at recently revised standards of
other Valley cities (such as Palm Springs), and studying some
national standards as well. It may be necessary to segment the
adoption of amendments for parking into two stages, leaving the
parking standards (Sections 9.160.080 and .090) for later
hearings and adoption.

Strategy and Timetable
The next step is to circulate the Staff drafts to a number of
technical review points:
Current Planning,

Development, Public Works,
Building Division,
and
City
Manager. Their review comments
will be incorporated
into
the
next draft. This will then
become a Hearing Draft of
the
text
of the "Village Package". At
that point we would undertake
the
public discussion, hearing and
adoption process.
Our present plan is to present the Hearing Draft text package
and zoning map to your body in your Study Session Monday, April
25, 1988. If we conclude from your discussion a general level
of (unofficial) acceptance, the next morning we would file with
the newspapers a Notice of Public Hearings for both your
Planning Commission meetings of Tuesday, May loth and the City
Council meeting of Tuesday, May 17, 1988 for the first reading
of the Ordinance. You would have an additional opportunity for
discussion on your Study Session agenda for Monday, May 9th
before your actual hearing the next evening. These two
hearings would cover the text only.
The Zoning Map Amendment would be informally discussed with you
on April 25th Study Session, heard in formal Hearing by your
body Tuesday, May 24th, and heard (along with the second
reading of the text Ordinance) by City Council on Tuesday, June
7, 1988.
This timetable is the earliest feasible schedule for adoption
of the Village Ordinance and Map Amendments. If we encounter
any significant problems, the process of course, can be
lengthened as much as may be necessary.
RECOMMENDATION
The Hearing Draft of the text and a draft map will be provided
in your next meeting packet. Staff will present the content
and rationale of the text and map at your Study Session Monday,
April 25th. It is recommended that you review the text and map
in some depth before the Study Session, noting any areas where
you have questions or concerns with a colored pen. After the
general presentation, Staff will go back through the text page
by page to allow you to raise and discuss your suggestions in
order. Following that procedure, Staff will recap your
suggestions and formulate, for your comment, a sense of Staff
direction:
A. Proceed with the Hearing Draft with the minor refinements
discussed according to the proposed Hearing Schedule; or
B. Re -draft sections and amend the Hearing Schedule to
permit another opportunity for review; on ;
