1. CALL TO ORDER
A. Chairman Thornburgh called the Planning Commission meeting to order at
7:00 p.m. Chairman Thornburgh called upon Commissioner Lucia Moran to
lead the flag salute.
2. ROLL CALL,
A. Chairman Thornburgh requested the roll call.
Present: Commissioners Brandt, De Gasperin, Moran, and Chairman
Thornburgh
Absent: Commissioner Walling
Moved by Chairman Thornburgh, seconded by Cannissioner Moran to
excuse Commissioner Walling.
Also present was Ccmmmity Development Director Lawrence L. Stevens
and Principal Planner Sandra L. Bonner.

A. Moved by Commissioner De Gasperin, seconded by Commissioner Brandt_
to approve the minutes of the regular meeting of July 23, 1985.
1. The minutes of the regular meeting of July 23, 1985, were approved
as submitted. Unanimously Adopted.
5. BUSINESS
Chairman Thornburgh introduced the first item of business as follows:
A. Street Vacation No. 85-009, a request to determine general plan
consistency of a proposed vacation of portions of Calle Yucatan;
1) Calle Yucatan west of Avenida Juarez, and 2) Calle Yucatan at
intersection of Avenida Rubio; Coachella Valley Water District,
Applicant.
Chairman Thornburgh then called for the Staff Report.
1. Sandra L. Bonner, Principle Planner, explained that the vacations
of Calle Yucatan west of'Avenida Juarez and a portion of Calle
Yucatan at Avenida Rubio are consistent with the Circulation
Element of the General Plan. Also, the portions of Calle Yucatan
requested for vacation are not needed to serve any substantive
public benefit associated with traffic circulation or emergency
vehicle access. The anticipated area traffic and related circula-
tion needs within the area are not sufficient to indicate that: the
roads proposed for abandonment are necessary for future public use
as road rights -of -way. Portions of the abandoned road rights -of -way
will be used for future public benefit as part of flood control
improvements to the area and the proposed abandonments will acco m odate
this need. Approval of the requested street vacation will not. cause
a significant impact on the environment and the preparation of an
Environmental Impact Report is not necessary. Based on these findings,
Ms. Bonner stated that the Conu nnity Development Department recommends
that Resolution No. P.C. 85-007 determining that this street vacation
is consistent with the La Quinta General Plan be adopted, and further
recommends that the Planning Commission support the attached conditions
if Street Vacation No. 85-009 is approved by the City Council.

During a discussion period, the Planning Commission reviewed the
Proposed conditions of approval, including Staff's recommendation
for a modification of the area proposed for vacation west of
Avenida Juarez. Their consensus was to support Staff's recomvan-
dation to vacate the entire full width of Calle Yucatan west of
Avenida Juarez, with the exception that a portion of the right-of-
way will be retained for road purposes to allow for the future
construction of standard knuckle street improvements at the corner
intersection. The Planning Commission also agreed that the City
should retain ownership of that portion of the vacated roadway west
of Avenida Juarez not required by Coachella Valley Water District
until such future time that the City Council determines the appro-
priate use for the land. Deferring the decision on the ultimate
use of this property will enable the City to expedite the recordation
of this vacation and the transfer of the title to that portion of
the property necessary for the construction of Bear Creek Stornwater
Channel. It was the Planning Commission's consensus to also support
the proposed vacation of that portion of Calle Yucatan located at
Avenida Rubio.
There being no further discussion, Chairman Thornburgh called for
a motion.
2. Commissioner Moran made a motion based on the findings in the Staff
Report to adopt Resolution No. P.C. 85-007 determining that Street
Vacation No. 85-009 is consistent with the La Quinta General Plan,
subject to the attached conditions if Street Vacation No. 85-009 is
approved by the City Council. Commissioner Brandt seconded the
motion. Unanimously adopted with Commissioner Walling absent.
Chairman Thornburgh introduced the next three items of business as follows:
B. Plot Plan No. 85-194, a request to construct a single-family dwelling
on the west side of Avenida Mendoza, 250' south of Calle Colima;
Rick Johnson Construction, Applicant.
C. Plot Plan No. 85-195, a request to construct a single-family dwelling
on the southeast corner of Calle Colima and Avenida Obregon:
Arthur Anderson, Applicant.
D. Plot Plan No. 85-196, a request to construct a single-family dwelling
on the west side of Avenida Vallejo, 150' south of Calle Nogales:
Leonard M. & Kerry A. Meier - Kam Construction Co., Inc., Applicants.
Chairman Thornburgh then called for the Staff Report.
1. Director Stevens explained that the three plot plan requests are
consistent with the requirements of the R-1 Zone and the goals and
objectives of the La Quinta General Plan, their building designs
are corn atible with area development and the projects will not. have
a significant impact on the environment. Therefore, based on these
findings, Staff recommends approval of these plot plans subject to
the attached conditions.
There being no further discussion on these matters, Chairman Thornburgh
called for a motion.
2. Comnissioner De Gasperin made a motion based on the findings in the
Staff Reports to approve Plot Plans Nos. 85-194, 85-195 and 85-196,
in accordance with Exhibits A, B and C and subject to the attached
conditions of approval, with the following revisions:
Add Conditions Nos. 12 and 13 to Plot Plan No. 85-195 as follows:
"12. Prior to issuance of a building permit for Plot Plan No. 85-195,
the Applicant shall submit to the Community Development Director
for review and approval, a master plan with specific information
or details on stucco color, texture, trim, roof design, other
architectural features, and landscaping which will vary the
appearance from nearby dwellings having the same design as approved
under Plot Plans Nos. 85-191, 85-192, 85-193 and 85-197.

"13. The interior garage dimensions shall have minimum 20' width
and 20' clear depth."
Add Condition No. 12 to Plot Plan No. 85-196, as follows:

Chairman Thornburgh seconded the motion. Unanimously Adopted with
Commissioner Walling absent.

Commissioner Brandt made a motion to adjourn to a Study Session at this time.

Request: Approval to Construct a Single -Family Idling Intended for Sale
1. General Plan: Low Density Residential (375 Dwellings Per Acre).
2. Zoning: R-1*++ (One -Family Dwellings, 17' Height Limit, 1200-Square-Foot
Minimum Dwelling Size).
3. Existing Conditions: The 50' x 100' lot is located on the east side of Avenida
Obregon approximately 50' south of Calle Colima. The surrounding area has been
developed with a variety of housing designs and roofing materials. Almost all
of the houses in the area are built on single lots. Of the 24 lots within the
project site's block, six (6) are built upon.
4. Environmental Considerations: The project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) and a Notice of
Exemption will be filed with the County Recorder.
5. Description of Request: The Applicant, who is a contractor, is requesting
approval to construct a single-family home intended for sale. The Applicant has
received approval for six (6) other similardesigned houses. Four (4) of these
are currently under construction.
The house contains over 1400-square-feet of usable floor area with three bedrooms,
two baths, and an attached, double -car garage with a connecting pedestrian door.
The maximum height of the building is 153-, feet. The 4 and 12 pitch, sloping roof,
which has 24" eaves, incorporates dark brown asphalt shingles. The house will
have an eartht:one, Bauers Adobe colored stucco exterior.
The house is oriented in an east -west manner with the garage facing onto Avenida
Obregon. The setbacks are as follows:

STAFF COMMENDS AND DISCUSSION
The floor plan, height and setbacks of the proposed house comply with the R-1*++ Zone
and the City's adopted minimum standards for single-family dwellings. The house's
design, siting, size and bulk are compatible with surrounding existing and developing
neighborhood architecture.
The Applicant has received four (4) approvals for the same house design, all within
300 feet of each other along the same street. A land use review map of these plot
plans is attached (refer to Attachment No. 1). The status of all five (5) houses is
as follows:

As indicated in previous staff reports, this will present a homogeneous design
appearance problem in the neighborhood. A condition of approval for the Applicant's
previous houses required that the Applicant modify his plans to include varying roof
designs, contrasting architectural design features, differing exterior colors, and
varying landscape designs between these houses. It is expected that with appropriate
design changes to the subject house plans, the neighborhood block will be developed
with some architectural variety.
The Applicant has recently submitted a plan of design changes for three of the five
subject houses. The specific design changes are as follows:
° Plot Plan No. 85-192; Addition of rough sawn, cedar wood detailing
to the front of the house. Change exterior color to Rose Quartz.
• Plot Plan No. 85-193; Add a one -foot -wide, built-up, exterior band
along house facing. Add a decorative brick wall facing along the
front of the house.
° Plot Plan No. 85-195; Add a one -foot -wide, built-up, exterior band
along house facing onto Calle Colima and Avenida Obregon. Construct
a three--foot-tall decorative wrought iron fence along side of house
facing onto Calle Colima.
° Landscaping will vary from house to house with a variety of street
trees and ground cover.
Overall, these changes are expected to create an adequate diversity in design character
to the neighborhood.

With regard to the proposed garage, the clear depth is 18 feet and width is 18.5
feet. City policy requires a minimum clear depth and width of 20 feet. The
Applicant shall revise the plans to meet the minimun clear dimension garage area
of 20' x 20' and also meet all other adopted standards including, but not limited
to, setbacks, bedroan clear dimensions and usable floor area. The Applicant is
encouraged to revise his plans to provide an internal garage depth clearance of
24' to meet FHA financing eligibility.

1. The project will not have a significant adverse impact on the environment.
2. The request is consistent with the requirements of the R-1*++ Zone and goals
and objectives of the La Quinta General Plan.
3. The building design is compatible with the area development contingent upon
the conditions of approval.
STAFF RECOMMENDATION
Based upon the above findings, the Co muuiity Development Department recce mends
approval of Plot Plan No. 85-197 in accordance with Exhibits A, B and C and subject
to the attached conditions.

1. The development of the site shall be in conformance with the Ddiibits A.
B and C contained in the file for Plot Plan No.85-197 , unless otherwise
amended by the following conditions.
2. The approved plot plan shall be used within two years of the approval date;
otherwise, it shall become null and void and of no effect whatsoever. By
"use" is meant the beginning of substantial construction, not including
grading, contemplated by this approval which is begun with the two-year
period and is thereafter diligently pursued to oarpletion.
3. Water and sewage disposal facilities shall be installed in accordance with
the requirements of the Riverside County Health Department.
4. Fire protection shall be provided in accordance with the standards of the
Uniform Fire Code as adopted by the City of La Quinta.
5. Prior to the issuance of a building permit, the developer shall submit
and have approved, a detailed landscape plan for the front yard shaving
the species, size, location and spacing of all planting materials, including
a minimum of two (2), 15-gallcn, street trees. The plan shall indicate the
irrigation system and the location of the required three (3) outdoor water
spigots. Prior to the issuance of a Certificate of Occupancy, the Applicant
shall install landscaping in accordance with the approved landscape plan.
All trees and plants shall be maintained in viable condition for the life of
the approved use.
6. The heating and cooling mechanical equipment shall be ground mounted, or
screened entirely by the roof structure.
7. Refuse containers and bottled gas containers shall be concealed by fencing
or landscaping.
B. The driveway shall be surfaced with concrete and have asphaltic concrete
connecting pavement (a 2" x 4" header) to the existing street pavement.
9. The Applicant shall obtain clearances and/or permits from the following
agencies prior to submitting these plants to the Building Department for
plan check:

° City Fire Marshal
e Om unity Development Department, Planning Division
Desert Sands Unified School District
10. The Applicant shall pay a school development fee as determined by the Desert
Sands Unified School District in accordance with the school mitigation agree-
ment as approved by the City Council and in effect at the time of issuance of
a building permit. A letter from Desert Sands Unified School District stating
that these fees have been paid shall be presented to the Camminnity Development
Department, Building Division, prior to issuance of a building permit.
