SUBJECT: NEW CARPORT STRUCTURE
Dear Mr. Hartman:
On July 3,.1.995, we received your application to build a detached, carport structure at your
home at the southwest corner of Calle Arroba and Avenida Mendoza. We have reviewed
your preliminary plan and cannot approve your request to have a side -loaded carport within
11 -feet of Calle Arroba, a public street. The SR Zoning Code requires a carport or garage
structure to be a minimum of 20 -feet from the property line whether it is front- or side -
loaded. However, a Setback Adjustment Application can be applied for if the support
post(s) is a minimum distance of 16 -feet from your front property. An application can be
picked up at our department if you wish to revise your request. The filing fee is $100.00.
If the carport is built, staff must require a concrete driveway to the structure pursuant to
Chapter 9.42.070 (D) of the Municipal Code.

You have both been identified through the Riverside County Assessors files that you both are joint
owners of the referenced property.
In January of this year (1995) you were notified that the structure at the northwest corner of your
property was built in violation of both State Building Code requirements, as well as City Code
requirements in that the structure was erected on or near your property lines and the structure was
constructed without benefit of a building permit pursuant to requirements of La Quinta Municipal
Code Section 8.01.060. - Permits Required. Pursuant to the aforementioned code section
requirements, you are in violation in that you have failed to obtain all required permits for the erection
of the referenced structure and in addition, have failed to comply with the mandatory requirements
of demolition and removal of said structure of which you were notified of on January 17, 1995.
Based on your failure to comply, you are hereby NOTIFIED AND ORDERED to remove the
referenced structure from your property within thirty (30) calendar days of receipt of this NOTICE
AND ORDER. There will be no exceptions or extensions of time granted in this case due to the
extended length of time that has elapsed since the initial warning and removal request was issued.
If you fail to comply with this Notice and Order within the specified time period, all avenues of legal
remedy will be immediately pursued to gain full and complete compliance.

La Quinta Municipal Code mandates that it is a criminal misdemeanor to be in violation of the
referenced code and the City is obligated to pursue legal remedy in this manner by the filing of
misdemeanor charges against the property owner(s) with the Riverside County Judicial Court System
and all costs incurred for this action, as well.as all administrative costs of abatement of the structure
by the City will be in addition to any fines that may be imposed upon you by the court.
