I. CALL TO ORDER A. Roll Call. It was moved and seconded by Commissioners Puente/Sharp to approve the minutes of September 20, 2007, as submitted. Unanimously approved. V. BUSINESS ITEMS: None. VI. COMMISSIONER ITEMS: A. Staff distributed a memo from the City Attorney explaining that since there was a potential litigation regarding the Morgan House it was her opinion there should be no discussion regarding this issue. 1. Commissioner Wright stated the City had previously asked KSL to make this a historic site and they refused. Can the City research and find out what the City can do as a Certified Local Government to make this a historic site, or is it up to the landowner. Planning Director Les Johnson stated a request to give a property landmark status can be made by anyone. The State process is different. Commissioner Wright asked if there was any authority the City has to push this forward. Planning Director Les Johnson stated not with the State, but the City can and went over the process it would take; however, the property owner has to agree with landmark status. The City can then have some say in regard to the building permit process. 2. Commissioner Wilbur asked why KSL did not want to have the National Historic status. Commissioner Wright explained it set in place a lot of steps for the landowner that were very restrictive and the landowner was not willing to accept those steps. Commissioners discussed historic structures and the demolition process that has been put into place to protect historic properties. B. Historic Context Statement 1. Principal Planner Stan Sawa presented the changes that had been made by staff and asked for Commissioner input. a. Commissioner Redmon asked if she would be able to send staff her edits. Staff stated yes. Commissioner Redmon asked about the ability to retrieve artifacts that had been collected previously to put into the museum upon its completion. Staff stated it would be possible. b. Chairman Wilbur asked that all corrections be returned at the next meeting of the Commission. He also asked if there was a possibility of making it a publication. Joint Meeting of City Council and Historic Preservation Commission 1 . Staff informed the Commission of the joint meeting and asked if there were any additional items they would like to have added to the agenda. 2. Sawyer Management Assistant age,- - - L V J 0 FILENAME \p P:\Reports - HPC\2007\12-6-07\Draft Minutes 10-18-07.doc0 3 I 5L. 4I:I ITEM: LtX31Lt77 APPLICANT: CONSULTANT BACKGROUND: HISTORIC PRESERVATION COMMISSION STAFF REPORT DECEMBER 6, 2007 HISTORICAL/ARCHAEOLOGICAL RESOURCES SURVEY REPORT FOR TENTATIVE PARCEL MAP 31876 NORTH SIDE OF FRED WARING DRIVE, BETWEEN WASHINGTON STREET AND PALM ROYALE DRIVE THE ROBERT MAYER CORPORATION (LARRY BROSE) CRM TECH (MICHAEL HOGAN, PRINCIPAL) The study area is a 25 ± acre site located on the north side of Fred Waring i Drive, between Washington Street and Palm Royale Drive in north La Quinta. The property is vacant except for some sparse native desert vegetation. The applicants have applied for permits to construct a retail center on the west half and medical office complex on the east half of the property. A Phase I (survey level) Archaeological/Historical Resources Assessment has been completed for the property. The Assessment includes a record search, historical background, and field reconnaissance of the property. This Assessment will be part of the environmental review required by the California Environmental Quality Act (CEQA) for the project application. In this case an environmental impact report is being prepared due primarily to traffic impacts. DISCUSSION: An archaeological and historic records search for the property was conducted at the Eastern Information Center located at UC Riverside. The records search indicated the portions of the study area have been included in three previous cultural resources surveys and no cultural resources had been recorded within or adjacent to the site. Within one mile of the site the records search showed at least 60 previous cultural resource surveys, resulting in 14 archaeological sites, four historic -era buildings, and 18 isolated artifacts. None of these sites or isolates was found in the immediate vicinity of the project area. No cultural resources nor significant buildings, structures, or other objects more than 50 years of age were identified during the field survey where visibility was excellent. A request was made of the Native American Heritage Commission for a check of their Sacred Lands file. Seven Native American representatives were contacted. Two 006 P:\Reports - HPC\2007\12-6-07\mayer ph 1 archaeo rpt.doc responses were received, with requests that any monitoring crew include a Native American archaeological monitor during earth -moving activities and that any discovery of native American remains or artifacts be treated as required by law. The report concludes that since no "historic resources" were encountered during the course of the study, CRM TECH is not recommending monitoring during gradiing and trenching operations. The HPC policy has been to require monitoring by qualified archaeologists during all earth -moving and trenching operations in the City. RECOMMENDATION: Adopt Minute Motion 2007- , accepting the "Historic/Archaeological Resources Survey Report, Tentative Parcel Map No.31876, City of La Quinta, Riverside County, California", as prepared by CRM TECH and subject to the following conditions: 1. The site shall be monitored during on- and off -site trenching and rough grading by qualified archaeological monitors, including a Native -American. Proof of retention of monitors shall be given to the City prior to issuance of the first earth -moving or clearing permit. The monitor shall be empowered to temporarily halt or divert equipment to allow for City notification and analysis. 2. The final report on the monitoring shall be submitted to the Community Development Department prior to the issuance of a Certificate of Occupancy for the project. 3. Collected archaeological resources shall be properly packaged for long term curation, in polyethylene self -seal bags, vials, or film cans as appropriate, all within acid -free, standard size, comprehensively labeled archive boxes and delivered to the City prior to issuance of first Certificate of Occupancy for the property. Materials shall be accompanied by descriptive catalogue, field notes and records, primary research data, and the original graphics. 4. The conditions of approval for this item shall be included in the submitted Phase I report prior to issuance of the first permit requiring monitoring. 5. If prehistoric or historic resources are discovered during monitoring or the subsequent construction phase, the Community Development Department shall be notified immediately. ....
