PCRES 1990-033PLANNING COMMISSION RESOLUTION 90-033 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL CONCURRENCE WITH THE ENVIRONMENTAL DETERMINATION AND RECOMMENDING APPROVAL OF TENTATIVE TRACT 24507, AMENDMENT #1. CASE NO. TT 24507, AMENDMENT #1 -STEVEN BRUMMEL WHEREAS, the Planning Commission of the City of La Quinta, did, on the 8th day of August, 1989, hold aduly-noticed Public Hearing to consider the request of Steven Brummel to subdivide +35 acres into 25 single family development lots for sale, one well site parcel, along with various common area parcels, generally located on the north side of 52nd Avenue, +2650 feet east of the Jefferson Sfreet centerline, and more particularly described as: BEING A PORTION OF THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 4, T6S R7E, S.B.B.M. WHEREAS, said real property is within an area which is part of an approved Sphere of Influence of the City of La Quinta; and, WHEREAS, said real property area is currently under consideration for annexation into the City of La Quinta; and, WHEREAS, California Government Code Section 66454 provides that a city may take action on a tentative subdivision map of unincorporated property adjacent to that City, provided that approval of said map is conditioned upon annexation of said property to such City; and, WHEREAS, the City Council of the City of La Quinta, California, did on the 6th day of September, 1989, hold a duly noticed Public Hearing to consider the Applicant's request and recommendation of the Planning Commission concerning the environmental analysis and Tentative Tract Map 24507; and after such consideration, did adopt City Council Resolution 89-99 making findings and granting approval of said Tentative Tract; and, WHEREAS, the Applicant, Steven Brummel, has requested an amendment to revise Condition #35 of said Tentative Tract Map as adopted by City Council Resolution 89-199; and, WHEREAS, the La Quinta Planning Commission did, on the 14th day of August, 1990, hold a duly noticed public hearing to consider said amendment request for Tentative Tract 24507; and, RESOPC.001 WHEREAS, the Planning and Development Director has determined that the proposed amendment is exempt from CEQA; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify recommendation for approval of said amendment request: Approval of Tentative Tract 24507, Amendment #1, will not have any adverse effect on the environment, as the original design has not been altered, and therefore, the initial determination that Tentative Tract 24507 will not have any significant impact on the environment, remains valid. That the approval process for Annexation #5 has delayed implementation of Tentative Tract 24507, as conditionally approved, and the proposed amendment is justified in order to compensate for that delay. That the proposed Tentative Tract 24507, Amendment #1, as conditionally approved, is consistent with the goals, policies, and intent of the La Quinta General Plan for land use density, circulation requirements, zoning district development standards, and design requirements of the Subdivision Ordinance and the La Quinta Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California as follows: That the above recitations are true and correct and constitute the findings of the Commission in this case; That it does hereby recommend confirmation of the Planning and Development Director's determination relative to the environmental concerns for this amendment request. That it does hereby recommend approval to the City Council of the subject Tentative Tract Map 24507, Amendment #1 for the reasons set forth in this Resolution and subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the La Quinta Planning Commission, held on this 14th day of August, 1990, by the following vote, to wit: AYES: Commissioners Mosher, Barrows, Steding, Chairman Moran NOES: None ABSENT: None ABSTAIN: Commissioner Zelles RESOPC.001 ATTEST: RESOPC.001
