PCRES 1990-038PLANNING COMMISSION RESOLUTION 90-038 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A VARIANCE TO PERMIT AN OFF SITE MONUMENT IDENTIFICATION SIGN, FOR TENTATIVE TRACT 25389 (BROCK DESERT FAIRWAYS) LOCATED AT THE NORTH WEST CORNER OF TENTATIVE TRACT 25389 (SIGN LOCATED +1530 FEET WEST OF THE SOUTHWEST CORNER OF PARK AVENUE AND 50TH AVENUE) FOR M. J. BROCK & SONS. CASE NO. VARIANCE 90-012 WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 9th day of October, 1990, hold a duly noticed Public Hearing to consider the request of the M. J. Brock & Sons for a Variance to the requirements of the Sign Regulations (Section 9.212.120(A)(3) and (C)(2), La Quinta Municipal Code) in order to permit one off site monument sign located at the northwest corner of Tentative Tract 25389. WHEREAS, said Variance case has complied with the requirements of "The Rules to Implement the California Environmental Quality Act of 1970" (County of Riverside, Resolution 82-213, adopted by reference in City of La Quinta Ordinance #5), in that the Planning Director conducted an initial study, and has determined that the proposed Variance will not have a significant adverse impact on the environment; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify the approval of said Variance case: "Special circumstances" due to the access limitations of the development due to the project not having its major entrance off 50th Avenue, as required by the City, that the Variance warrants favorable consideration. Approval of the Variance would not constitute granting of a special privilege inconsistent with limitations on similarly zoned property in the area. A condition has been attached to the approval of this Variance requiring the Applicant to obtain permission to locate the sign on land owned by CVWD. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California as follows: That the above recitations are true and correct and constitute the findings of the Commission in this case; That it does hereby confirm the conclusion of the Environmental Assessment of this Variance; RESOPC.006 3. That it does hereby approve the above-described Variance 90-012 for the reasons set forth in this Resolution and subject to the attached conditions .
