PCRES 1990-041PLANNING COMMISSION RESOLUTION 90-041 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A VARIANCE FROM MAXIMUM WALL HEIGHT LIMITATION. CASE NO. VAR 90-014 -WILLIAM & LESLIE PUGET WHEREAS, the Planning Commission of the City of La Quinta, California, did, on the 13th day of November, 1990, hold a duly noticed Public Hearing to consider the request of William and Leslie Puget for a Variance to Section 9.204.020 of the La quinta Municipal Code (LQMC), permitting a wall height of nine feet for property located at 77-600 Avenida Fernando, more particularly described as: REFER TO EXHIBIT "A" WHEREAS, said Variance request has complied with the requirements of "The Rules to Implement the California Environmental Quality Act of 1970" (County of Riverside, Resolution 82-213, adopted by reference in City of La Quinta Ordinance 5), in that the Planning Director conducted an Initial Study, and has determined that the proposed project will not have a significant adverse impact on the environment; and WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to justify the approval of said Variance: The strict application of the maximum wall height requirement to the subject property will deprive it of privileges such as privacy and quiet enjoyed by other similarly zoned property in the area, in that there is a special circumstance due to location of surroundings (i.e., the Hotel parking area) which deprives this property of those privileges. Approval of the Variance as conditioned will not constitute the granting of a special privilege inconsistent with limitations on other similarly zoned property in the area as other properties do not share the same proximity to the Hotel parking area. 3. The Conditions of Approval will assure that the permitted 3-foot increase in wall height will not adversely affect adjacent parcels. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California as follows: That the above recitations are true and correct and constitute the findings of the Commission in this case; That it does hereby confirm the determination of the Planning Director, which indicated that the Variance request will have no significant impact on the environment . RESOPC.009 3. That it does hereby grant said Variance 90-014 for the reasons set forth and subject to the conditions labeled Exhibit "B" attached hereto.
