A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF LA QUINTA, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF GENERAL PLAN AMENDMENT NO.
91-036 AND PREANNEXATION ZONING CASE
NO. 91-064; A REQUEST TO AMEND THE LA
QUINTA GENERAL PLAN LAND USE MAP TO ADD
A 1.61 ACRE AREA FOR ANNEXATION AND TO
DESIGNATE SUCH AREA AS LOW DENSITY
RESIDENTIAL, AND ZONE THE AREA AS R-1.

WHEREAS, the area to be proposed for annexation currently
lies within the incorporated limits of the City of Indio; and,
WHEREAS, on February 7, 1990, the Indio City Council did
take action to allow detachment of said area from the City of
Indio; and,
WHEREAS; California Government Code Section 65859 allows
for cities to prezone property adjacent to its corporate limits
for purposes of determining appropriate zoning prior to
annexation of such property; and,
WHEREAS, the Planning Commission of the City of La
Quinta, California, did, on the 12th day of March, 1991, hold a
duly -noticed Public Hearing to consider the request of Don
Howard and the City of La Quinta to amend the La Quinta General
Plan Land Use Map and Zoning Map to include an additional 1.61
acres, located at the easterly termination of Vista Grande
Street, and to designate the additional area as Low Density
Residential (2-4 du/ac), and zone the area as R-1; and,
WHEREAS, said preannexation zoning and General Plan
Amendment has complied with the requirements of "The Rules to
Implement the California Environmental Quality Act of 1970"
(County of Riverside, Resolution No. 82-213, adopted by
reference in City of La Quinta Ordinance No. 5), in that the
Planning Director has determined, after reviewing the General
Plan, the area to be annexed, the potential residential density
and numbers, the adjacent land uses, and related matters, that
the preannexation zoning and Amendment to the General Plan are
consistent with the General Plan and with the Master
Environmental Assessment, and that no significant adverse
environmental impact will result from the proposed Amendments;
and,

WHEREAS, at said Public Hearing, upon hearing and
considering all testimony and arguments, if any, of all
interested persons desiring to be heard, said Planning
commission did find the following facts and reasons to justify
the recommendation for approval of said preannexation zoning
and General Plan Amendment:
1. The property is suitable for development under the
proposed General Plan Designation of Low Density
Residential at 2-4 units per acre, and preannexation
zoning of R-1.
2. The City of Indio General Plan designates the property,
as well as the surrounding area as single family
residential at 0-10 dwelling units per acre.
3. The proposed City zoning classification of R-1 is
compatible with the existing City of Indio zoning
classification of R-1-6. J
4. The development of this property at this residential
density will be consistent with existing adjacent single
family development within the City of La Quinta.
5. Environmental Assessment 91-188 identifies no significant
adverse environmental impact from the proposed
preannexation zoning and General Plan Amendment
designating the property as Low Density Residential, and
zoning the property as R-1.
6. The property is contiguous to La Quinta's present
corporate limits, and represents a part of a logical
extension of La Quinta and its General Plan, in that the
property has approved access from the City of La Quinta
and is separated from developable Indio property by the
confluence of two drainage ways.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of La Quinta, California, as follows:
1. The above recitations are true and correct and constitute
the findings of the Commission in this case;
2. That it does hereby confirm the conclusion of
Environmental Assessment 91-188, in that the
preannexation zoning and General Plan Land Use Map
Amendment will not result in a significant adverse impact
on the environment;

That the Planning Commission does hereby recommend to the
City Council approval of preannexation Zoning Case No.
91-064, subject to the condition that the property be
annexed to the City of La Quinta, and General Plan
Amendment No. 91-036 consisting of a Zoning Map Amendment
and Land Use Map Amendment as described in Exhibits "A"
and "B", attached hereto.
PASSED, APPROVED and ADOPTED at a regular meeting
of the La Quinta Planning Commission, held on this 12th day of
March, 1991, by the following vote, to wit:
