A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LA QUINTA, CALIFORNIA, ANNOUNCING
FINDINGS AND GRANTING A VARIANCE TO PERMIT A
WALL HIGHER THAN SIX FEET ON TENTATIVE TRACT
26524 ALONG 50TH AVENUE AND AROUND THE
COACHELLA VALLEY WATER DISTRICT WELL SITE
CASE NO. VARIANCE 91-015
WHEREAS, the Planning Commission of the City of La Quinta, California,
did on the 11th day of June, 1991, hold a duly noticed Public Hearing to consider the
request of the Chuck Strother for a Variance to the La Quinta Planning and Zoning
Regulations in order to permit a perimeter wall to reach up to 9.64 feet in height
along the 50th Avenue frontage and around the Coachella Valley Water District well
site.
WHEREAS, said Variance case has complied with the requirements of
"The Rules to Implement the California Environmental Quality Act of 1970" (County
of Riverside, Resolution 82-213, adopted by reference in City of La Quints Ordinance
#5) , in that the Planning Director conducted an initial study, and has determined
that the proposed Variance will not have a significant adverse impact on the
environment; and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be heard, said
Planning Commission did find the following facts to justify the approval of said
Variance case:
1. The Applicant is required to provide a sound attenuating perimeter wall along
50th Avenue more than six feet high in compliance with the acoustical study
for Tentative Tract 26524.
2. A berm/wall combination would be unfeasible because the construction of a
berm would result in the elimination of a large number of existing mature
citrus trees.
3. Coachella Valley Water District requires an eight foot wall around the well site
for noise attenuation and safety reasons.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of La Quints, California as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That it does hereby confirm the conclusion of the Environmental
- Assessment of this Variance;

3. That it does hereby approve the above -described Variance 91-015 for
the reasons set forth in this Resolution and subject to the attached
conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quints Planning Commission, held on this llth day of June, 1991, by the following
vote, to wit:

CONDITIONS OF APPROVAL
VARIANCE 91-015 - ADOPTED
JUNE 18, 1991
1. Variance shall generally conform with exhibit contained
in the file for Variance 91-015, unless otherwise amended
by the following conditions.
2. The extent and construction of the perimeter sound
attenuation wall along 50th Avenue shall comply with the
requirements contained in the acoustical study for
Tentative Tract 26524.
3. If any of the citrus trees located between 50th Avenue
and the proposed wall die or are severely damaged or
diseased these shall be replaced by trees of a similar
size and type.
4. The Homeowner's Association for Tentative Tract 26524 and
Tentative Parcel Map 26525 shall maintain the perimeter
wall and perimeter landscaping.
