Dear Property Owner:
An application for a building permit has been submitted in your name listing yourself as the guilder of the property
improvements specified.
For your protection you should be aware that as "Owner/Builder" you are the responsible pirty of record on such a
permit. Building permits are not required to be signed by property owners unless they are personally performing their
own work. If your work is being performed by someone other than yourself, you may protect yourself from possible
liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license
from the City or'County. They are also required by law to put their license number on all ,permits for which they
apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should be
aware of the following information for your benefit and protection:
If you employ or otherwise engage any persons other than your immediate family, and the wcrk (including materials
and other costs) is $200.00 or more for the entire project, and such persons are not licensed as contractors or
subcontractors, then you may be an employer.
If you are an employer, you must register with the State and Federal Government as.an emplcyer-and you are subject
to several obligations including State and Federal income tax withholding, federal social security taxes, worker's
compensation insurance, disability insurance costs and unemployment compensation contributions.

There may. be financial risks for you if you do not carry out these obligations, and these risks art especially serious with
respect to worker's compensation insurance.

SUBJECT: Front yard garden wall construction:
Wall along north side of property is constructed on top of an existing masonry wall and concrete
footing. The wall at the north side of the property along side the adjacent home is an extension of a 6
foot tall wall built by my neighbor in accordance with City of La Quinta requirements. The new wall
was built on top of an existing 18" tall 8 inch thick masonry wall. The footing installed was the same
as the footing for the existing 6 foot tall wall at the rear and side yard of the adjacent property and
was designed to accommodate a 6 foot tall wall in the future.
The masonry walls were built as follows:
The north side wall adjacent to the adjoining property is an existing 3-course emu wall grouted solid.
The existing masonry wall was predrilled at 24 inches on center for installation of vertical No. 4
rebar. The holes were drilled and cleaned out with a nylon brush and blown clean with compressed
air in accordance with the epoxy manufacturers instructions. The epoxy used was Simpson Strong -
Tie Anchor System, ICBO No. ER5279. The holes were filled half way starting from the bottom and
then the rebar inserted till it hit the bottom. The rebar (No. 4 bar) was set in place in a hole
approximately 5/8" to a minimum embedment of 8 to 10 inches. The bars extend a minimum of 24"
above the top of existing wall and an additional bar (No. 4) was placed (tied) to extend up through the
new wall to the top course at about 6 feet above finished grade.
The new masonry wall has horizontal reinforcing consisting of No. 4's at every third course (24" o.c.)
The connection between the existing wall and the new wall (start of the new wall) was detailed as
follows; Existing wall was predrilled to accommodate No. 4 bars/anchors. The bars were set at 24
inches o.c. with an embedment of 8 to 10 inches and set in epoxy similar to the method used for
vertical bars described above.
The end of the new wall (pilaster) at the north east corner of the property has (2) No. 4 bars
continuous, from footing to top of pilaster pier. The bars extend from top of wall/pilaster then bend
and extend 24 inches horizontally into the bottom of the new concrete footing.
Masonry walls are 8" x 6" x 16" and are commercial grade block. The wall will be grouted solid and
receive a plaster finish to match existing walls.
Wall built along the east side of the property was built in accordance with the attached structurally
engineered design for footing and wall. Reference attached details.
The new front yard and side wall adjacent to the driveway will be a 6 inch "slump" block with
exposed grout at joints painted white to match the finish of the house and capped with red brick.

Statement of Fact.
On February One, 2002, an application for a block wall was received from
Mr. Bruce Fickett. He indicated at this time that the wall was already
partially constructed. Building & Safety Manager Greg Butler, made a site
visit and documented the status of construction photographically.
Subsequent to the site visit a plan check correction list was prepared and on
February 6,2002, a message was left at 650-333-4745. There was no
response to the message until March 4ffi, 2002, at which time we received a
request to fax the correction list(Which was done).
No further contact until 7-15-2002, when Mr. Fickett submitted 81 /2 x 11
information -at this time I accepted the documents, but due to heavy
workload at the counter I only gave the materials a quick glance. Two hours
later as I looked at materials more closely, I realized that we were missing
structural calculations and written responses to the correction list. I called
and left a message for Mr. Fickett at the aforementioned number. On 7-24-
2002, I called & informed Mr. Fickett that a letter was ready for him
regarding why his resubmittal was unacceptable. On 7-26-2002 Mr. Fickett
picked up the letter & was very hostile. He stated that he had followed the
instructions on the plan review correction list -when I asked how item #6 was
met, he produced a blank application for an encroachment permit. When I
explained that he needed to submit a completed application to public works
and, when approved, to provide a copy of the permit to this department, he
made a comment regarding "another (expletive deleted) bureaucracy",
uttered another expletive and left.
A few weeks later I was contacted by someone who identified himself as
Mr. Ficketts brother. He asked what steps needed to be taken to issue a
permit. I gave him a copy of the correction list.
A month later a person called on the phone, and identified himself as a
building official for another municipality. He asked what was needed to be
done -I explained the corrections -he stated he would have Mr. Fickett obtain
the needed plans & calcs & submit.
On 10-28-2002, a contractor came to the counter and asked what was
necessary to pull a permit for a block wall at 54-811 Rubio. I gave him a
copy of the correction list, he had the original application for an
encroachment permit dated July 2002,1 advised him to go to the Public
Works counter and submit the application for the encroachment permit. He
had new plans, but no itemized response to the correction list. I spent at least
20 minutes reviewing what had previously transpired and explained that
without the written instructions being followed, we would not be able to
accept his submittal. While"standing at the counter I gave the contractor
clear examples of what an acceptable response would be, such as "added
note 4 to page A-2 of plans". He wrote answers to the majority of
corrections at the counter. He then handed me the correction list, with no
response to item 7. I asked him to show me where the response to correction
7 was. He stated, " I'll just pencil it in." I explained that per the Building &
Professions Code, that plans that were stamped & signed by a licensed
Engineer or Architect could not be changed or altered by anyone other than
the licensed professional that prepared them, and that no drawings would be
accepted with pencil marks. He took the plans and correction notice and
stated he would return. On 11-15-2002, plans were re -submitted to Kay
Hensel, with pencil notes on the plans. The plans were processed per routine
and shipped to our structural consultant. Due to increased workload, instead
of the anticipated 5-7 working day turnaround, actual time was 11 working
days. Greg Butler notified applicant on 12-4-2002 that plans were ready for
correction. They were picked up on 12-5-2002 by someone identifying
himself as Mr. Fickett's contractor. I spent additional time going over the
correction list and gave examples of what type of plan check responses were
appropriate.
