TEMPORARY STORAGE TRAILER - 54-940 AVENIDA RUBIO
Dear Mr. Van Patten:
The Planning Department has reviewed your request to place a temporary storage
container at the property located at 54-940 Avenida Rubio in La Quinta, California.
Our Department hereby. approves your request subject to the exhibits on file and the
following Conditions:
1. The applicant/property owner agrees to defend, indemnify, and hold
harmless the City of La Quinta (the "City"), 'it's agerts, officers .and
employees from any claim, or litigation arising out of the City's approval of
J this project. This indemnification shall include any award toward attorney's
fees. The City of La Quinta shall have the right to select its defense counsel
in. its sole discretion.
The City of La Quinta shall promptly notify, he applicant of *Eny claim, action,
or proceeding and shall cooperate fully in the defense.
2. The applicant shall comply with all provisions of the La Quinta' Municipal
Code (LQMC).
3. .The. trailer can remain on-site for a three month period. Unless there is
evidence of an extreme extenuating circumstance, the Planning Department
may or may not grant an extension for this application. The storage container
shall be removed from the site prior to March 31, 2008.
4. Use of the container shall be for storage purposes only and is limited to the
house of construction as listed in the La Quinta Municipal Code (Chapter
-6.08 Nuisances). A copy of this time schedule can be obtained form the
Building and Safety Department.

5. The storage container. shall be placed on the subject property, behind the,
existing walls/fences-on the property. The. storage container may ' not bef
located on the street or on the front lawn.
`6. The storage container shall comply with Code Section 9.6C.050 Storage and
Other Accessory Buildings, and shall comply with Code Section 9.60.210
Construction and Guard Offices.
7'. The storage- container shall 'be immediately removed by the authorized
disposal service at. the applicants expense if any noxious or nuisance odors
are found to emante from the container.
8. It is the responsibility of the applicant to ensure that refuse stays within the
container by use of a tarp or .netting under -windy or other, adverse weather
conditions.
9. The dumpster may not be used to remove hazardous waste. It if the
responsibility of the applicant to properly dispose of any anc all waste.
10. Approval of this Minor Use Permit' application •will not result in conditions
detrimental to public health, safety and general welfare, nor injurious to or
incompatible with other properties and uses in the vicinity.

The City may, elect to add Conditions to- this application request to mitigate any
problems that arise not previously addressed herein.
This decision. may be appealed to the Planning 'Commission by anyo-ie provided they
submit the necessary paperwork,and filing fee of $175.00 to this office within 15 .days
of approval of this permit.

Dear Mr. Van Patten:
This letter is to report that the Planning Department has reviewed your Minor
Adjustment application, pursuant to Section 9.210.040 of the City of La Quinta Zoning
Code.
Request:
Allow a 10% adjustment for a front yard garage.
Decision: s
Approval is granted for the requested reduction, based on the following findings:
• Minor Adjustment 2008-601 is consistent with the La Quinta General Plan, in that
the reduction proposed does not alter the approved land use for the property, or
affect land .use on surrounding similar properties.
• Minor Adjustment 2008-601 is consistent with the intent of the La Quinta Zoning
Code, in that the requested adjustment will retain adequate rear yard separations
as required under said Zoning Code.
• Processing and approval of Minor Adjustment .2008-601 is in compliance with the.
California Environmental Quality Act. The adjustment requested falls under
CEQA Guidelines Section 15305(a), which includes minor setback and parcel
adjustments as Categorically Exempt under this Section.

• Approval of Minor Adjustment 2008-601 is not detrimental to the public health,
safety and general welfare, nor injurious or incompatible with other properties
and land use in the vicinity. The adjustment has no impact on health or safety
issues, and will not affect physical land use characteristics in the vicinity.
Please be advised that this approval relates only to allowance of the reduction as stated
above, and does notimply any entitlement or approval of a building permit for any
structures shown on the plans on file. All other setback provisions and development
standards of the La Quinta Zoning Code are applicable and shall to adhered to in
preparing plans for building plan check.
