PCRES 1995-016PLANNING COMMISSION RESOLUTION 95-016 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA CERTIFYING A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR ENVIRONMENTAL ASSESSMENT 95.294 PREPARED FOR CONDITIONAL USE PERMIT 95-017 ENVIRONMENTAL ASSESSMENT 95.294 J. L. JARNAGIN WHEREAS, the Planning Commission of the City of La Quints, California, did on the 25th day of Apri1,1995, hold a duly noticed Public Hearing to consider the request oP J. L. Ja~vagln for a Conditional Use Permit to allow a full service carwash and detail shop on the north side of Highway 111300-feet west of Adams Street; and, WHEREAS, said Conditional Use Permit has complied with the requirements aP "The Rules to Implement the California Enviromnental QuaDty Act of 1970" (as amended) (Resolution 83.68 adopted by the La Quanta City CouncD) in that the Community Development Department has prepaeed Initial Study EA 95-294; and, WHEREAS, the Community Development Director has determined that said. Conditional Use Permit wiH not have a significant adverse effect on the environment due to mitigation requirements and flat a Mitigated Negative Declaration of Environmental Impact should be flied; and, WHEREAS, upon hearing and considering all testimony and arguments, of any, of all interested persons desiring to be heard, said Planning Commission did find the following facts, findings, and reasons to justify certification of said Environmental Assessment: 1. The proposed project will not be detrimental to the health, safety, or general welfare of the community, either directly or indirectly. 2. The proposed project will not have the potential to degrade the quaDty of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number m' restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 3. The proposed project does not have the potential to achieve short-term environmental goals, to the disadvantage of long-term environmental goals. 4. The proposed project wiH not result in impacts which are individually Dmited, but cumulatively considerable. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of ttte City of La Quanta, California, as follows: RESOPC.143 Resolution 95- 016 That the above recitations are true and correct and constitute the findings of the Commission for this Mitigated Negative Declaration oP Environmental Impact. 2. That it does hereby certify Environmental Assessment 95.294 with the adoption of a mitigated Negative Declaration for the reasons set forth in this Resolution and as stated in the Environmental Assessment Checklist and Addendum, labeled Exhibit "A" - EA, mi file in the Community Development Department.
