PCRES 1995-025PLANNING COMMISSION RESOLUTION 95.025 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF L~1 QUINTA, CALIFORNIA, RECOMMENDING CERTIFICATION OF A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT fOR ENVIRONMENTAL ASSESSMENT 95-299 PREPARED FOR TENTATIVE TRACT 28189 ENVIRONMENTAL ASSESSMENT 95-299 • WINCHESTER DEVELOPMENT WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 27th day of June, 1995, hold a duly noticed Puhlic Hearing to consider the proposed Tentative Tract 28189; and, WHEREAS, The Planning Commission of the City of La Quinta, California, did approve the certification of the Environmental Assessment to the City Council; and, WHEREAS, said Tentative Tract has complied with the requirements of "The Rules to Implement the California Environmental Quality Act of 1970" las amended) (Resolution 83-68 adopted by the La Quinta City Council) in that the fommunity Development Department has prepared Initial Study Environmental Assessment 95.299; and, WHEREAS, the Community Development Director has determined that ;said use permit will not have a significant adverse effect on the environment and that a Negative Declaration of environmental impact should he filed; and, WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts, findings, and reasons to justify certification of said Environmental Assessment: The proposed tentative tract will not be detrimental to the health, safety, or general welfare of the community, either indirectly or directly. 2. The proposed tentative tract will not have the potential to degrade the equality of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number of restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of Califoirnia history or (prehistory. 3. The proposed tentative tract does not have the potential to achieve short-term environmental goals, to the disadvantage of longterm environmental goals. 4. The proposed tentative tract will not result in impacts which are individually limited or cumulatively considerable. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California, as follows: RESOPC.162 Planning Commission Resolution 95-025 That the above recitations are true and correct and constitute the findings of the Commission for this environmental assessment. 2. That it does herehy recommend certification of Environmental Assessment 95-299 for the reasons set forth in this resolution and as stated in the Environmental Assessment Checklist and Addendum, labeled Exhibit "A" contained in the staff report.
