A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LA QUINTA, CALIFORNIA RECOMMENDING
CERTIFICATION OF A MITIGATED NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT FOR
ENVIRONMENTAL ASSESSMENT 95-307 PREPARED FOR
GPA 95-050 AND ZC 95-079.

THE KEITH COMPANY
WHEREAS, the Planning Commission of the City of La Quinta, California,
did on the 12th day of September, 1995, hold a duly noticed Public Hearing to
consider the request of The Keith Co. (For Dutch Parent) for the redesignation of a
138-acre site from single and multi-family residential and commercial to single and
multi-family residential, commercial, and office east of Washington Street and north
of Fred Waring Drive; and,
WHEREAS, said General Plan and Zone Change Amendments have
complied with the requirements of "The Rules to Implement the California
Environmental Quality Act of 1970" las amended) (Resolution 83-68 adopted by the
La Quinta City Council) in that the Community Development Department has prepared
Initial Study EA 95-307; and,
WHEREAS, the Community Development Director has determined that
said Land Use Change will not have a significant adverse effect on the environment
due to mitigation requirements and that a Mitigated Negative Declaration of
Environmental Impact should be filed; and,
WHEREAS, upon hearing and considering all testimony and arguments,
if any, of all interested persons desiring to be heard, said Planning Commission did
find the following facts, findings, and reasons to justify certification of said
Environmental Assessment:
1. The proposed project will not be detrimental to the health, safety, or general
welfare of the community, either directly or indirectly, in that traffic measures
will be employed when the site is developed. Additionally, mitigation measures
will be required during any on-site construction.
2. The proposed project will not have the potential to degrade the quality of the
environment, substantially reduce the habitat of a fish or wildlife population to
drop below self sustaining levels, threaten to eliminate a plant or animal
community, reduce the number or restrict the rancle of a rare or endangered
plant or animal or eliminate important examples of the major periods of
California history or prehistory.

3. The proposed project does not have the potential to achieve short-term
environmental goals, to the disadvantage of long-term environmental goals,
that will be analyzed further at such time as a development plan is presented.
4. The proposed project will not result in impacts which are individually limited,
but cumulatively considerable.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of La Quinta, California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the Commission for this Mitigated Negative Declaration of Environmental
Impact.
2. That it does hereby certify Environmental Assessment 95-307 with the
adoption of a Mitigated Negative Declaration for the reasons set forth in this
Resolution and as stated in the Environmental Assessment Checklist and
Addendum, labeled Exhibit "A" - EA, on file in the Community Development
Department.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta Planning Commission held on this 12th day of September, 1995, by the
following vote, to wit:
