PCRES 1996-012PLANNING COMMISSION RESOLUTION 96-012 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, RECOMMENDING CERTIFICATION OF A NEGATIVE DECLARATION OF ENVHtONMENTAL IMPACT FOR ENVH2ONMENTAL ASSESSMENT 96-318 PREPARED FOR GENERAL PLAN AMENDMENT 96-052 AND ZONING ORDINANCE AMENDMENT 96-050 (ZONING CODE) ENVIItONMENTAL ASSESSMENT 96-318 CITY OF LA QUINTA WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 23rd day of April, 1996, and 14th day of May, 1996, hold duly noticed Public Hearings to consider the proposed General Plan Amendment and Zoning Ordinance Amendment, and; WHEREAS, said acquisition has complied with the requirements "T'he Rules to Implement the California Environmental Quality Act of 1970" (as amended) (Resolution 83-68 adopted by the La Quinta City Council) in that the Community Development Department has prepared Initial Study EA 96-318; and, WHEREAS, the Community Development Director has determined that said Zoning Ordinance Amendment and General Plan Amendment will not have a significant adverse effect on the environment and that a Negative Declaration of environmental impact should be filed; and, WHEREAS, upon hearing and considering all testimony and arguments, if any of all interested persons desiring to be heard, said Planning Commission did find the following facts, findings, and reasons to justify a recommendation for certification of said Environmental Assessment: The proposed Amendment will not be detrimental to the health, safety, or general. welfare of the community, either indirectly or directly in that the new standards and regulations are brought into conformance with the 1992 update of the City's General Plan. Tlie Ordinance will apply City-wide and provide a comprehensive set of standards and regulations for development thereby improving the quality of life for City residents. 2. The proposed Amendment will not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. Appropriate mitigation measures have been adopted in the La Quinta General Plan to ensure minimal impact. 3. The proposed Amendment will not have the potential to achieve short-term e:nviromnental goals, to the disadvantage of long-term environmental goals in that it will establish more stringent standazds and regulations according to the goals and objectives of the General Plan. resopc.203 Planning Commission Resolution 96-012 4. The proposed Amendment will not result in impacts which are individually limited or cumulatively considerable. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quints, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission for this environmental assessment. 2. That it does hereby recommend certification of Environmental Assessment 9fi-318 for a Negative Declaration for the reasons set forth in this resolution and as stated in the Environmental Assessment Checklist and Addendum, labeled Exhibit "A" on file in the Community Development Department.
