Dear Mrs. Diane Money:
In response to your request for the Building Department. to review our March 5, 1996 letter
requesting the repair of a retaining wall and fence on the north property •line we submit the .
following response and retraction.
Reviewing our County records it- is clear that 52-560 Aveinda Ramirez was constructed
before 52-520 Avenida Ramirez, Because County standards were different from, those
enforced by the City, the City is unable to determine who actually owns the•*etaining wall
and fence and therefore whose responsibility it is to maintain it. This issue has become a
civil matter to correct.
It is our hope and we encourage both you and your neighbor to resolve your differences and
come to a mutual agreement for repairs and maintenance of the retaining wall and fence,
this benefits you both.

It has come to the attention of the City of La Quinta's Building Department that your side yard fence
and retaining wall has fallen and is in need of repair. City of La Quinta Municipal Code Section 9.42.070
section F. Fencing, paragraplti 4. Maintenance, requires all walls and fences shall be continuously
maintained in good repair.
The Property owner has thirty days after receiving notice to repair a wall or fence. Please except this as
your notice to repair your fence. If you have any questions please feel free to contact our Building
Inspector, at 777-7027.
