The applicant of Conditional Use Permit 2008-114 has verbally indicated her intent
to withdraw the application. Staff has requested written confirmation of the
applicants' intent for withdrawal; however, staff has not received such
confirmation (Attachment 1). Although written confirmation for withdrawal has not
been received by the Planning Department, staff believes that the applicant does
intend to withdraw the application and recommends the item be removed from the
Planning Commission Agenda.

As indicated in our phone conversation on November 3, 2008, you are no longer interested
in pursuing Conditional Use Permit (CUP) 2008-114 for an outdoor market at the Benjamin
Franklin Elementary School. Although, you have verbally indicated your wish to withdraw
the application, we require written confirmation of your request. Your written confirmation
allows us to maintain written documentation of your request and allows us to place the
documentation in the application's file. Since the permit is scheduled for a public hearing
with the Planning Commission on November 25, 2008, your confirmation letter for
withdrawal must be submitted to the Planning Department no later than 5:00 p.m. on
Friday, November 21, 2008. Failure to submit a letter of confirmation will result in the

Susan,
It has been my pleasure working with you to establish an outdoor market here in the City of La Quinta. Over the
past six months you have been in constant contact with City staff and have taken great steps in meeting our every
request. Unfortunately, many questions still surround your proposed event and the additional effort needed to
complete the process seems quite daunting. As indicated by our phone conversation earlier today, you wish to
withdraw the Conditional Use Permit. In order for the Planning Department to discontinue processing of the
permit, we need to received, in writing, a request to withdraw the application. The request needs to be dated and
signed by you and a hard copy mailed here to our department. Until the letter is received the file will remain open.
Once again it has been a pleasure working with you and I apologize for the response your request received at the
City's Planning Commission meeting. I wish you the best in which ever venture you decide to pursue next.

The Planning Commission, at it's meeting on November 12, 2008, continued the
above -referenced application until the following Planning Commission meeting held
on November 25, 2008, directed staff to meet with Commissioner Barrows and an
equestrian trail advocate, and requested that staff provide clarified maps of the
proposed trail revisions. Since that time, staff and Commissioner Barrows met with
Gayle Cady, a representative of the Desert Riders and a member of the Riverside
County Trails Committee, and have discussed the proposed changes. In addition,
staff has since received a handful of phone inquiries from residents of the adjacent
Trilogy project.
Staff is requesting additional time to further assess the interests of area residents
and local trail advocates and to prepare updated information for the
Commissioners' consideration. Staff will be available at the November 25, 2008
meeting to address any further questions the Planning Commission may have.

ACCORDANCE WITH THE REQUIREMENTS OF "THE
RULES TO IMPLEMENT THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT OF 1970" AS
AMENDED (RESOLUTION 83-63).
LDR (LOW DENSITY RESIDENTIAL)

Tentative Tract Map 33597 was originally approved by the City Council on July 5,
2005. Site Development Permit 2007-881 was approved by the City Council on
May 15, 2007. The project, as approved, includes 57 single-family residential lots,
recreational facilities and perimeter landscaping on 22 acres of land in south La
Quinta (Attachment 2). The Site Development Permit for the overall site layout,
architectural details, and preliminary landscaping plans were reviewed by the
Planning Commission on April 10, 2007.
The Planning Commission, at its June 14, 2005, meeting, recommended approval
of Tentative Tract Map 33597 to the City Council with a condition that the
"Perimeter wall designs, including height, color, material, design shall be approved
by the Architectural and Landscape Review Committee and the Planning
Commission prior to issuance of building permit for the wall" (Attachment 3)• The

Final Landscaping Plans submitted by the applicant provide details on the wall
design and have been brought forward by staff to the Planning Commission for
approval.
PROPOSAL:
The project's perimeter wall plans show the wall's location along Avenue 60 and
Madison Street and includes plans and details for the project's entry (Attachment
4). The wall plans contain details regarding the wall's design, including stucco,
decorative wrought -iron, and vehicle and pedestrian entrance gates.
Avenue 60
Two sets of walls are proposed along the project's main entry and water feature
design. The upper -most wall is placed along the property lines of the single-family
lots, and is a combination wall that incorporates both block wall and wrought iron
design. The upper wall will be stuccoed and will include brick caps. Pilasters are
placed at the intersection of property lines with the project perimeter. The lower
wall along the project's entry is a retaining wall and is incorporated into the design
of the water feature. The lower wall will also incorporate a stone veneer
(Attachment 4, Sheet L3.1 (E►► as well as boulders. This design will enhance the
overall design of the project's water feature.
Madison Street
The wall design along Madison Street is consistent with the wall design along
Avenue 60. The perimeter wall along Madison Street slopes upwards towards the
project's southern border. The increased slope is due to the Bureau of Reclamation
Flood Control Dike and the eventual Madison Street extension over the Dike. Two
walls are proposed along the Madison Street extension, one along the property
lines of the residential lots, and another along the Madison Street Extension.
Though similar in design with the walls along Avenue 60, the walls design along
Madison Street is limited to block and does not incorporate the use of wrought -
iron. The two walls will help to screen the views of vehicles on the Madison Street
extension into residential rear yards and will help to lessen noise impacts created
by vehicular traffic.
ANALYSIS
The perimeter wall plans are consistent and in conformance with the approved
preliminary wall plan design previously reviewed by the ALRC, the Planning
Commission, and City Council. The plans show perimeter wall location, wall height,
pilaster location, and project entry design. Additionally, the wall plans are in
conformance with the Conditions of Approval as placed on both the Tentative Tract
Map and the Site Development Permit, which are identified as follows:

COA #75: Perimeter wall designs including height, color, material, design shall be
approved by the Architecture and Landscaping Review Committee and the Planning
Commission prior to issuance of building permit for the wall.
The wall plans were reviewed by the Architectural Landscape Review Committee
(ALRC) on November 5, 2008. The ALRC upon review of the plans recommended
approval of the wall plans to the Planning Commission.

COA #29: Stucco finishes for the homes and perimeter walls shall be either smooth
or hand -troweled finish.
The submitted plans show a smooth stucco finish on all perimeter walls.
COA #30: The perimeter wall shall include pilasters at a separation not exceeding
50 feet on Madison Street, at all points where lot lines terminate on Avenue 60,
and at property corners in all other locations.
The wall plans place pilasters every 50 feet along Avenue 60 and Madison Street,
as required. Maximum wall height is shown at six (6) feet, and the proposed wall
material, CMU block with a smooth stucco finish, is a permissible building material
for perimeter wall design. The proposed wall plans are incompliance with the City
of La Quinta Municipal Code standards.
RECOMMENDATION
Adopt Minute Motion No. 2008 _, approving perimeter wall plans for Malaga
Estates as submitted:

72. The applicant shall make provisions for the continuous and perpetual
maintenance of all private on -site improvements, perimeter landscaping, access
drives, and sidewalks. In particular, the applicant shall provide language in the
CC&Rs for continuous and perpetual maintenance by the HOA of the
landscaped slope easement along Madison Street.
FEES AND DEPOSITS
73. The applicant shall comply with the provisions of Section 13.24.180 (Fees and
Deposits), LQMC. These fees include all deposits and fees required by the City
for plan checking and construction inspection. Deposits and fee amounts shall
be those in effect when the applicant makes application for plan check and
permits.
74. Permits issued under this approval shall be subject to the provisions of the
Infrastructure Fee Program and Development Impact Fee program in effect at
the time of issuance of building permit(s).
MISCELLANEOUS
75. Perimeter wall designs including height, color, material, design shall be approved
by the Architecture and Landscaping Review Committee and the Planning
Commission prior to issuance of building permit for the wall.
76. Proposed street names with a minimum of two alternative names per street
shall be submitted to the Planning Department for approval. Names to be
approved prior to recordation of final map.
77. All mitigation measures contained in Environmental Assessment 2005-541 shall
be met.
78. Prior to final map approval, the developer shall submit to the Planning
Department for review, a copy of the proposed Covenants, Conditions, and
Restrictions (CC&R's) for the project.
79. Production homes require approval of a Site Development Permit application by
the Planning Commission.
80. The westerly access shall be restricted to exit only for residents and emergency
access only for entry into the site by emergency vehicles.
