Dear Mr. Guenther,
This letter is to confirm our conversation on October 19, 1998, outlining allowable
improvements to vacant land that you recently purchased.
The land, described as Lot 13, Block 204, Santa Carmelita at Vale La Quinta, Unit
No. 20 (APN: 774-065-011), is situated at the northeast corner of Avenida Navarro
and Calle Monterey, in the City of La Quinta.
For approximately the past five years, it has been the City's policy not to allow the
importation of fill dirt on vacant property until a building permit has been issued for
the primary structure on that property. As we discussed, we can allow you to use
only soil native to the lot to build a berm, not greater than 2-1/2 feet high, for the
purpose of establishing a planter bed along the east property line, against your
existing combination retaining / garden wall. The berm shall taper down to natural
grade not more than five feet west of the wall.. You may plant vegetation in the
berm suitable to soften the appearance of your wall.
