KSL Desert Resorts, lne., ("Desert Resorts") is the owner of the golif course property
immediately adjacent to the rear property line of the above refaced residential property and the
benefited party to a rear yard setback of 5 feet along the property line abutting the golf property (the
"Setback"). The Setback provides that water features, including swimming pools and spas, are not
allowed to be constructed in the Setback area unless specifically approved by the golf course owner.
Properly Owner and the poo{ contractor have contacted Desert Resorts regarding Desert
Resorts' approval of the encroachment of the pool deck within the Setback area. This letter shall
serve as your notice that Desert Resorts approves of the construction of a concrete pool deck on the
above referenced property, as depicted on Exhibits A and B attached hereto, subject to the following
conditions:
1, A minimum setback of one (1) foot six (6) inches from the rear yard property line to
the edge of the deck- and
2. No other permanent improvements with- the Setback area may be constructed or
installed without the express written approval of Desert Resorts. in its sole discretion.
