This letter is to report approval of the setback adjustment application pursuant to Chapter
9.188 of the City of La Quinta Planning and Zoning regulations, subject to Conditions and
according to the attached exhibits.
SETBACK ADJUSTMENT REQUEST: To reduce the rear and side yard setbacks from
Y to Y to construct an irregularly-shaped swimming pool.
CONDITIONS:
1. Obtain a building permit from the Building & Safety Department.
2. Maintain a minimum of 5 feet from the side property line for the pool equipment as
shown on Exhibit A.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of the Zoning
Ordinance to allow development of accessory swimming pools in the R-1
District.

2. Special circumstances applicable to the property, such as size, shape,
topography, location or surroundings that justify approval of the adjustment,
are based on the private rear yard's narrow configuration relative to the
existing house siting and yard improvements, dictating an offset pool design
3. This adjustment will not be detrimental to the health, safety, and general
welfare of the community because an existing 6-0" high masonry . wall
encloses the rear and side yards housing the future.'swimming pool and spa
facilities. The existing wall will provide adequate security for the property
owner and adjacent neighbors.
Please be advised that by ordinance effective September 5, 1996, swimming pools may be
located a minimum of 3 feet from any property line, measured from water's edge, and a
minimum of 4 feet from any structure (this would include pool equipment if higher than 30
inches). A setback adjustment application will no longer be necessary, but no further
adjustment to these new setback requirements will be permitted.
