A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LA QUINTA, CALIFORNIA, APPROVING
ARCHITECTURAL PLANS FOR A SINGLE FAMILY
DWELLING WITHIN THE ACACIA SUBDIVISION, SUBJECT
TO CONDITIONS
CASE NO.: SITE DEVELOPMENT PERMIT 2001-715
APPLICANT: SEAN KEARNEY
WHEREAS, the Planning Commission of the City of La Quinta, California,
did on the 23rd day of October, 2001, hold a duly noticed Public Hearing to consider
the request of Sean Kearney to approve architectural plans for a new single family
home to be constructed at 78-775 Lowe Drive within the Acacia Subdivision, more
particularly described as:
APN: 604-233-003
WHEREAS, said Site Development Permit has been determined to be
exempt from California Environmental Quality Act requirements under Section 15303,
Class 3 (A) of the Guidelines For Implementation; and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons wanting to be heard, said
Planning Commission did find the following facts and reasons to justify approval of
said Site Development Permit:
1. The proposed residence is similar to the existing residences. The design is
compatible with the existing units in terms of architectural materials, style,
colors, size, and is one story for compatibility.
2. The recommended approval and Code requires a minimum of one 24" box size
tree in the front yard. This will be required as a part of the landscaping
approval.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of La Quinta, California, as follows:
1. That the above recitations are true and constitute the findings of the Planning
Commission in this case;

2. That it does hereby approve Site Development Permit 2001-715 for the reasons
set forth in this Resolution, subject to the Conditions labeled Exhibit "A",
attached hereto;
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta City Planning Commission, held on the 23rd day of October, 2001, by the
following vote, to wit:
AYES: Commissioners Butler, Kirk, Robbins, Tyler, and Chairman Abels

CONDITIONS OF APPROVAL - FINAL
SITE DEVELOPMENT PERMIT 2001-715
OCTOBER 23, 2001
1. The applicant agrees to defend, indemnify, and hold harmless the City of La
Quinta (the "City"), its agents, officers and employees from any claim, action
or proceeding to attack, set aside, void, or annul the approval of this tentative
map or any final map thereunder. The City shall have sole discretion in selecting
its defense counsel.
The City shall promptly notify the applicant of any claim, action or proceeding
and shall cooperate fully in the defense.
2. The front yard landscaping shall comply with the requirements of the Zoning
Code and the plans shall be submitted to the Planning Commission for approval.
