OWNER/BUILDER INFORMATION
Dear Property Owner:
An application for a building permit has been submitted in your name listing yourself as the builder of the property
improvements specified.
For your protection you should be aware that as "Owner/Builder" you are the responsible party of record on such a
permit. Building permits are not required to be signed by property owners unless they are personally performing their
own work. If your work is being performed by someone other than yourself, you may protect yourself from possible
liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license
from the City or County. They are also required by law to put their license number on all permits for which they
apply.
If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should be
aware of the following information for your benefit and protection.
If you employ or otherwise engage any persons other than your immediate family, and the work (including materials
and other costs) is $200.00 or more for the entire project, and such persons are not licensed as contractors or
subcontractors, then you may be an employer.
If you are an employer, you must register with the State and Federal Government as an employer and you are subject
to several obligations include State and Federal income tax withholding, federal social security taxes, worker's
compensation insurance, disability insurance costs and unemployment compensation contributions.
There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious with
respect to worker's compensation insurance.
For more specific information about your obligations under Federal Law, contact the Internal Revenue Service (and, if
you wish, the U.S. Small Business Administration). For more specific information about your obligations under State
Law, contact the Department of Benefit Payments and the Division of Industrial Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their
work personally or through their own employees, without a licensed contractor or subcontractor, only under limited
conditions.
A frequent practice of unlicensed persons professing to be contractors is to secure an "Owner/Builder" building
permit, erroneously implying that the property owner is providing his or her own labor and material personally.
Building permits are not required to be signed by property owners unless they are performing their own work
personally.
Information about licensed contractors may be obtained by contacting the Contractors' State License Board in your
community or at 1020 N. Street, Sacramento, California 95814.
Please complete and return the enclosed owner -builder verification form so that we can confirm that you are aware of
these matters. The building permit will not be issued until the verification is returned.

1.0 EVALUATION SCOPE

2.0 USES
AquaSwim-N-Spa Prefabricated Plastic SwimSpa Shells are
products intended for recreational use with heated water
circulated in a closed system. The SwimSpas are
permanently installed either above or below ground, and
complywith the American National Standards Institute (ANSI) .
Z124.2-1997, referenced in Section AG104.1 of the IRC
through ANSI/NSPI-3-1999.
3.0 DESCRIPTION
The SwimSpa shells consist of thermoplastic polymer
material, overlaid with two or three layers of
fiberglass -reinforced resin. The SwimSpas are a minimum of
V, inch (6.4 mm) thick, depending on the SwimSpa design
and the location within the SwimSpa. The models listed in
Table 1 are recognized in this evaluation report.
Notice: The spa is designed to remain full of water at all
times. The shell may be damaged if the water level is allowed
to drop below the skimmer. When appreciable draw -down is
noticed or if it becomes necessary to drain the spa, contact
Rio Plastics or its dealers for instructions.
4.0 INSTALLATION
The SwimSpa shells are permanently installed either -above
or below ground level, as described in this report. All
plumbing and electrical work must comply with the relevant
codes in effect at the construction site at the time of
construction. The SwimSpas must be installed in accordance
with this report and the manufacturer's published installation
instructions. SwimSpas installed above ground or in the
ground must rest on a 3- to 4 -inch -thick (76 to 102 mm)
concrete slab, poured against the grade and extending a
minimum of 6 inches (152 mm) beyond the SwimSpa
perimeter. Concrete strength must comply with Section
R402.2 of the IRC and Section 1922.2.4 of the UBC.
Preservative -treated wood. posts must be installed in
accordance with the manufacturer's installation instructions
when installation is above ground or partially above ground.
Subject to the code official's approval, the SwimSpas may
be installed below ground level without a soil investigation by
a registered design professional, provided none of ,the
following conditions is encountered at the site:
1. The existence of groundwater within the excavation,
where'the spa floor will contact the soil at the time of
installation.
2. The existence of an uncompacted fill in contact with any
portion of the SwimSpa shell.
3. The existence of any expansive -type soils.
4. The existence of any soil types with an angle of repose
that will not support the walls of the excavation at desired
slopes.
5. Danger to adjacent structures posed by the proposed spa
location.
If any of the above conditions is encountered, excavation
must cease immediately. The specified conditions at the site
must then be reviewed, and recommendations made, by a
qualified engineer. The code official must approve the
engineer's report before work is resumed.
Details specifically for installations in expansive, clay, or
adobe soils apply only when supported by the registered
design professional's recommendations and approved by the
code official.
5.0 CONDITIONS OF USE
The Aquaswim-N-Spa Prefabricated Plastic SwimSpa Shells
described in this report comply with, or are suitable
alternatives to what is specified in, those codes listed in
Section 1.0 of this report, subject to the following conditions:

5.5 A barrier is required where SwimSpas are installed on
the premises of a Group R, Division 3, Occupancy. In
jurisdictions adopting the IRC, barriers must comply with
Section AG105. In jurisdictions adopting the UBC,
barriers must comply with Appendix Chapter 4, Division
I.
5.6 Slip resistance is outside the scope of this evaluation
report. Reports of slip resistance tests that demonstrate

7.0 IDENTIFICATION
Each SwimSpa shell bears a label with the Rio Plastics, Inc.,
name; the manufacturing plant location; the model
designation; the name of the inspection agency (Smith -Emery
Laboratories); the words "Shell Only" and "ANSI Z124.7-
1.997"; and the evaluation report number (ESR -2193).
A permanent label must be attached to the spa equipment
by the SwimSpa shell manufacturer or distributor, and must
give the distributor's name, address and telephone number.
