RE: Patio cover installation/removal 77-770 Calle Colima
The attached documents reflect permit issuance and reimbursement for a patio
cover installed and removed at the above address.
On or about June 15, 2004, 1 discovered a patio cover being installed at 77-770
Calle Colima without a permit. I made contact with the installer on the job and
informed him that a permit was required for this type of work and advised him to
suspend further work until a permit was in place. I also informed him that, due to
its location on the property, I didn't think that a permit would be able to be issued
for setback reasons.
Shortly thereafter, Kirk Kirkland was scheduled to do an inspection on the patio
cover and questioned its location. Although a permit had been issued on 6/21/04,
staff had incorrectly interpreted the drawing, which actually showed the patio
cover in an unapprovable location. The owner was informed that the patio cover
must be removed.
The property owner negotiated a settlement with the City wherein the City would
reimburse her for expenses she would not have incurred if staff had correctly
interpreted the drawings and declined to issue the building permit.
Per telephone calls on 6/15/04, neither the installing contractor nor the store
where purchased refunded any amount to Ms. Bishop.
