This letter also notifies you of the suspension of the Certificate of Occupancy for that address. I will address your response items in the order in which you presented them as follows: 1: Your letter of August 7, 1997, enclosed a copy of Section 3039 from Title 25. That section does not provide the written evidence of State approval of the panels as requested. We have been informed by the State that only fourteen panels have been approved to date, Written evidence would be the results of testing by a recognized agency accepted by the State being performed upon a representative sampling . of the panels used in the construction of the dwelling at 51-295 Calle Quito. 2. I did receive a phone call today from Mr.. Babayan indicating he would be running some calculations in the near future on the dwelling to see if it'would comply structurally should the panels not be acceptable.. His busy schedule, however, does not relieve you of your.obligation to provide the written evidence requested. 3. The evaluation of the structure by Mr. Babayan will not be sufficient as. written evidence for acceptance of the panels. He may design any structural revisions for the dwelling should the panels tested not meet the design criteria set forth by the State. In order to conduct hearings to determine the suitability of alternate materials and methods of installation, a board of appeals is established. A. Membership. The board of appeals shall consist of five members, one of whom shall be a general contractor, two of whom shall be structural engineers or architects, one of whom shall be a specialty contractor, all of whom shall be qualified by experience and training, and one of whom shall be a member of the public who is not one of the foregoing. Members of the board of appeals shall be appointed by and serve at the pleasure of the city council. Each member shall comply with applicable provisions of the Political Reform Act of 1974, California Government Section 81000, et seq. Any person aggrieved by a decision of the building and safety department related to any matter within the purview of this title shall have the right to appeal the decision. I did receive a phone call today from Mr. Babayan indicating he would be running some calculations .in the near future on the dwelling to see if it would comply structurally should the panels not be acceptable. His busy schedule,- however, does not relieve you of your obligation to' provide the written evidence requested. 3. The evaluation of the structure by Mr. Babayan will not be sufficient as written evidence for acceptance of the panels. He may design any structural revisions for the dwelling should the.panels tested not meet the design criteria set forth by the State. As stated in correspondence to you dated July 24, 1997, failure to provide written evidence of State approval and testing of the panels used at.51-295 Calle Quito by August 7'. 1997 could result in the suspension of the Certificate of Occupancy for the residence. As indicated above, written evidence has not been provided, therefore, we must revoke the. Itis impossible for anyone to state that the presses are not adequate. Somzthing is correct to have the repeatability for these 30 years. Further the panels are usualy cut for windows and door openings and certainly any problems would show up in amost every third or fourth panel. Most walls are not.more than four panels long such that any skin problems would show up. Further the new U.B.0 requires that the Structural engineer provide cortinious inspection during the errection process. Another assurance that the panels meet the requirements is. that the usual man handling by the carpenters will peal off skins should there be a glue line problem. There are so .,many checks and balances in the manufacture, handling, shipment, installation and -cutting in the field any problem will show up in any one of these actual quality tests. It therefore speaks we - 1 of the integrity of the assembly. As amatter of fact this sane batch of panels were used on a two story custom above Carson Valley in Nevada where the winds were clocked in excess of 125 mph.and 5' of snow on top. I trust that.his should clean up our past production of Model CDC 721. Further approval of additional panels was subject to the modification of the "press" to assure adequate pressure for proper glueline bonding. Since Super-Struct did not respond on the "press" modification and due to non payment of inspection fees, Inspection Concepts canceled inspection services October 18, 1995. Of the 300 State labels issued initially, 16 labels were approved by me, which leaves 284 State labels missing. If we can find the serial number of any labels which were on the panel, we can find out if the labels were part of the missing lot.
