I believe you made an error with the date, of August. 1, 20(2. Neither my husband nor I had any contact with the City'and/or your inspector informing us there was an issue and/or problem with our entry at that time. Rather, Mr. Showalter was at our home sometime late in September for an inspection of block wall footings in the rear of our home_ . As he was leaving he suddenly, for the first tirr e, noticed the entry :structure and commented. a that it "might be problem". At the time he first mentioned the iss ue, the home had been stuccoed and exterior painting had started. Some days later, approximately September 2511,, 2002, you telephoned me requesting a meeting, I promptly set one up for 3:30 on September 27th and at that time my husband arid I were informed by you (for the 151 time) that there was a problem and we were to remove or alter the column to the City's satisfaction or you would not approve the final inspection for our home. Your statement that there was an emotional discussion/meeting iE absolutely correct. We have approved plans that clearly show the entry treatment as we have. constructed it. You have inspected the foundation, framing, roofing, lath and many other inspections. At no time, prior to late S 3ptember, was our entry in question. The meeting was emotional for me because, during the meeting you acted as thougn this was completely our problem and that the City bears no responsibility for your errors in approving the plans and your failure to discover the problem at the framing stage of construction. Mr. Showalter had suggested to my husband that obtaining a letter from the 1 neighbor affected might help in resolving the problem. Your reaction was that you would speak to him for even suggesting a solution. Your redesigns of my entry would have substantially degraded the ;appearance of my home. Genovese, City Manager DATE: February 11, 2003 RE: Blunt Letter Please find attached a letter that was sent to the Blunt's regarding a setback violation for a newly constructed dwelling. As you recall, Mrs. Blunt Spoke during public comment several meetings ago about this issue. They have not contacted the City since the 9th of January. As of this date the house has not been finaled. The Blunts were first made aware of,the violation in September. They chose to, ignore the problem until it was time to get a final on the house. When staff informed them that the house could not be finaled until the issue wa addressed, they decided to appear at the City Council meeting to seek relief from the requirement. The Blunt's position is that since the City did not catch the violatior in a timely manner, that it should be approved as is, or alternatively the City should be responsible for the costs of altering the structure to conform. Our first discussion occurred in the lobby outside the City Council meeting on January 7, 2003. At that time, I agreed that the City would issue a temporary Certificate of Occupancy for your house at the -above-mentioned adjress, if you would agree to address the setback violation. We agreed that ninely days would be. a sufficient amount of time to address the situation. The options we discussed at that time included a lot line adjustment or physically removing thE� portion of the entry structure that was higher than 6 feet and closer than 4' 6" to the property line. At that time I accepted several drawings from you, that proposed a solution to the setback encroachment, should the lot line adjustment not be obtained. As presented, the drawings did not comply with the zoning regulations and could not be approved administratively. I made the necessary corrections and faxed an amended, unsigned drawing to you on January 8, 2003. Upon your receipt of the faxed copy of the above mentioned drawing, you faxed me a response on January 9, 2003, stating that the revised plan you received would not be economically feasible and that you would continue tc pursue the lot line adjustment. Per your faxed request, you were sent the necesEary forms to process the lot line adjustment. In the same fax, dated January 9, 2003, you also implied that rif you were not successful in obtaining the lot line adjustment, you would seek Cit; Council intervention in resolving -the issue. As a point of clarification, the City Council does. not have the ability to waive or amend the setback requirement. The only way to obtain approval for a side yard setback closer than 4' 6" to the property y line is through the variance process: To process a request for a variance, you must submit an application with a non-refundable processing fee of $1,700. The Planning Commission must make certain findings that show because of special circumstances that exist (such as size, shape, topography or location', the .property owner would be deprived of privileges enjoyed by other prop=erty owners in the vicinity who are subject to the same zoning regulations. The Gommunity Development Department would not be able to recommend that the variance be approved. .,The City is still willing to issue a Certificate of Occupancy for the structure based on your agreement, in writing, to address the setback encroachment one way or another by April 7, 2003. Please be advised that the structure has nz)t been approved for occupancy and to inhabit the building would be a code violation.
