We are in receipt of your letter requesting that residential lots on the subject
project 'be allowed to build patio covers that extend to the limits defined by the
concrete patio areas.
After reviewing the proposal with the Building and Safety Department 9 has been
.concluded that your request to amend the interior side yard setback cannot be
granted based on the following reasons: A) the California Building Code does not
allow structures to extend beyond any property lines; B) to allow less than a three
(3) foot setback, the typical patio structure proposed, such as an alumawood
patio, would have. to be classified as one-hour fire • resistive and ir, any case
would not be allowed more than two- (2.) feet for overhang�or projection fro the' .

from. any rear property line adjacent to any common use
easement or open space or recreational area which is at
least ten feet deep.
