Dear Mr. Stemmer:
This letter serves to relay approval of your recent application, for
a setback adjustment,, pursuant to Chapter 9.188 of the City of La
Quinta Planning and Zoning Regulations. The setback adjustment has
been approved subject to conditions and in accordance with attached
Exhibits A.
SETBACK ADJUSTMENT:
Five foot side setback reduced to three feet & four feet.
FOR: Swimming Pool &.Spa
CONDITIONS:
1. The Applicant shall comply with Municipal 'Code Fencing
requirements for pools & spas.
2. Ensure pool is reinforced to Building Code"requirements.
3. This setback adjustment does not apply to mechanical pool
equipment..
4. GTE requires that a three inch (3 -inch) PVC conduit, schedule
40 or better, be placed within the rear yard easement area.
This would facilitate their accessing the area in the future,
should the. need to replace the facilities,"'arise-. This conduit
is to be capped off within five.. feet (5 -feet) of the side
property lines,• and should be placed at a minimum depth of
thirty inches (30 -inches).
After review it was determined. that:
1. This adjustment is consistent with the intent and purpose of
the Zoning Ordinance.
