Dear Mr. Johnson:
My wife and I moved to La Quinta and bought a house at Point Happy in 1966. Several
years later we bought the adjacent empty lot from our neighbor. Until recently, the lot
was never a concern but now it seems to be regarded by outsiders as anaccess route and a
place to leave trash.
If a landscaper's truck with a trailer has difficulty negotiating our cul de sac, they drive
over the curb onto the lot to complete their turn, When Time Warner Cable needs to
examine their equipment on the pole at the corner of the lot, they simply gc over the curb
and drive to where they want to be. If a repairmen or construction crew wants access to
any of the three neighboring.. lots, they do not hesitate to drive onto the empty lot to do
their work. Usually they leave behind trash from their activities Other forms of trash
also are deposited; fast food wrappers,soft drink containers and beer bottles are tossed
onto the lot. Dog poop and cigarette butts are left behind as well. In short; the empty lot
is open, accessible and convenient -- to an outsider it is seemingly a public space that can
be used at will without responsibility. '
The wooden fence on the south side,of our house was recently taken down because it
could no longer be repaired. Instead of replacing the fence, I would like to enclose the
empty lot by building a block wall with a gate on the street side. This would, in effect,
serve to enclose both lots.
When I visited the Planning. Department yesterday (Jul. 31S`), I was told the Municipal
Code does not allow a wall on the street side of an empty lot. It is my belief the Code is
intended in part to enhance the appearance of our community but in this instance, not
having a wall tends to work against that objective. A few years ago our neighbor was
permitted to put up a wall on the street side of his empty lot. It is directly across the
street from our lot and I would like to do the same. I am requesting permission to do so.
Enclosed are photographs showing the setting of our empty lot on Palm Garden Place and
