On 9-12-84 at about 8:00 a.m. Mr. Don Korte.dame in�h`'the Building.Department about
1. a correction notice that was given to him and.s.wife' on.9-10=84.at::about 3:00 p.m.,
which stated. that...he ,was in violation 'of. Section 308 of -.the -Uniform Administrative
Code 1979: Occupying a building.without a Cert.ofificateOccupancy and also
using power from a Temporary Power Pole for the construction of the building.
Mr. Don Korte. stated that' -we had no right -to come..on his personal property
without first obtaining his approval. I told-him.that-as long as the building
VMS under construction and -or' there was _a violation of the Miirii.cipA Code or
Building Codes that we as the legal representative of*the city had, -the right.
to coarse on his property or.in the structure until. the project -is completed and
issued a. Certificate of Occupancy.
At this point Mr—Korte tried to.argue about the fact,as..to if he was living
in the dwelling or not. I asked Mr. Korte.if:hie was sleeping iri the building
or not. He said that "sometime well most of; the.time'because`he had.had
$1,000 in cash stolen once and many tools stolen. He sai& the she'r'iff told
hime to stay there at night to insure that noting got stolen. -I told Mr.
Korte that that sounded.like a personal opinibri of the officer..
I asked if he had a place of residence at another location and he said."no",
we are staying in the bedroom. It is ' finished and soare :the- bath. and shower.
I reminded Mr. Korte that the building had•-not,even had a framing sign off
and he had completed that part of`.the.buildirig without'an.inspection. We did
not know if it was -safe or not without it ever being inspected.
At this point Mr. Korte said that he had..$200.00 missing from the bedroon
during the fifteen minutes that he and his'wife were...gone and upon
returning, Tom Hartung and I were in the house.' I. told him that he should
go file a complaint with the Sheriff's Department.
Mr. Korte asked what his choices were.. Could he live out of.his.truck in the
yard or what? I told him.that the Municipal.Code had no provisions for that
and if he'wanted to do that he would have to_go through planning, but our
immediate concern was that he was illegaly living in a structure:that
was not ready to be in and helhad.electrical power going to the building
illegally and in all illegal and unsafe manner..
Mr. Korte than stated that. he did not have. the money and :it was to hot to
complete the project at this time. So he may have-to'justboard 'up the
building and it may..not ever get.it.finished:, but that would be.G.K. because
it would not get on the tax role than.
Mr. Korte also.stated that he could not leave the,.building'because,the windows
would get broken out. I told Mr.-Kortethat..normally once,the windows
had been set that the glass.windows are removable -and could be 'taken out and
put in the garage. Mr.'Korte said that. -he did not want to do:that.
Mr. Korte said as he was leaving that he would just board the house up and
that he had to go because he had to go.see-an Attorney.
