CC Resolution 2000-077 RESOLUTION NO. 2000-77
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA ESTABLISHING THE NUMBER OF TIMES THAT THE
GENERAL PLAN MAY BE AMENDED PER YEAR.
WHEREAS, Government Code Section 65358 provides that with certain limited
exceptions, the mandatory elements of the City's General Plan may be amended no
more frequently than four times per year; and
WHEREAS, the City, as a Charter City, may set its own rules and regulations
regarding the frequency with which its General Plan may be amended; and
WHEREAS, due to the high level of development being processed, the City has
determined that greater flexibility is needed in the processing of development projects
and that the limitation imposed by Government Code Section 65358 are too restrictive
as applied to the City;
WHEREAS, it has become increasingly difficult to combine the processing of
multiple applications for General Plan Amendments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La
Quinta, California as follows:
1. That the above recitations are true and correct and constitute the findings of the
Council for this project.
2. It is hereby established that no mandatory element of the General Plan of the
City of La Quinta shall be amended more frequently than twelve times during
any calendar year.
PASSED, APPROVED and ADOPTED at an adjourned regular meeting of the La
Quinta City Council held on this 5th day of July, 2000, by the following vote:
