The original parcels were subdivided in 1983, under Tentative Tract Map 19302. In 1985, the City Council of the City of La Quinta adopted Specific Plan 1985-005 for the re -alignment of Avenue 52, east of Avenida Bermudas. The proposed tentative parcel map is intended to accurately reflect the existing built environment since the adoption of the Avenue 52 specific plan. In February of 2010, The County of Riverside deeded the property containing the previous fire station, with the exception of the existing cell tower property, to the City of La Quinta and thus, per Government Code 66428(a)(2), created the separate lot that currently contains the existing cell tower. PROJECT REQUEST The project proposes to subdivide property that was previously subdivided by Tentative Tract Map 19203 (Attachment 2). The request will re -divide the parcels into no more than four (4) parcels, noting the area containing the cell tower is recognized as an existing separate lot to remain unchanged and is identified as "not a part" of this map. The applicant is requesting approval of the subject tentative parcel map to subdivide the parcels to better match the existing conditions in this portion of the City. ANALYSIS The proposed tentative parcel map will reconfigure the existing five (5) parcels into four (4) parcels that align with the existing road system in the vicinity, and reflect the built conditions of the City Corporate Yard, the County Fire Station, and Francis Hack Park. The subdivision will create separate parcels for the park, the Fire Station, and the City Corporate Yard. The subdivision will also establish a new parcel, north of Avenue 52. The four (4) parcels will range in size, from nearly six (6) acres to just over one (1) acre (Attachment 2). Parcel 1, "VACANT", creates a new parcel on the north side of Avenue 52. The new parcel is approximately 1.44 acres. The parcel is bounded by Avenue 52 to the south, Calle Amigo to the north, Desert Club Drive to the east, and Avenida Bermudas to the west (Attachment 2). Parcel 1 reflects current built conditions and establishes the existing vacant land as a new parcel in the City. The existing land is owned by the City of La Quinta Redevelopment Agency. Parcel 2, "PARK", is the largest parcel at 5.97 acres. The parcel reflects the boundaries and built conditions for the City owned Francis Hack Park. The parcel is bounded by Avenue 52 to the north, Francis Hack Lane to the south, and Avenida Bermudas to the east (Attachment 2)• 2 Parcel 3, "FIRE", is approximately 1.21 acres in size. The parcel reflects the boundaries and built conditioned for Riverside County Fire Station 32. The parcel is bounded by Avenue 52 to the north (Attachment 2). Parcel 4, "CITY", is 2.83 acres. The parcel reflects the boundaries and built conditions for the City Corporate Yard. The parcel is bounded by Francis Hack Lane to the south and Parcel 3 to the north. Parcel 4 also contains a 587.5 acre piece that is labeled "Not A Part" of this tentative parcel map (Attachment 2). The piece reflects a previous transfer of property between the City and Riverside County. The tentative parcel map does not address zoning for the newly created parcels. With the subdivision, the new parcels will retain the current zoning of Parks and Recreation (PR). Although the "PR" zoning designation allows the park as a principal use, the remaining parcels will need to be re -zoned to fit the existing uses at the site. A Zone Change application for the rezoning of the new parcels will follow the tentative parcel map application and will be addressed at a later time. Per La Quinta Municipal Code Section 13.12.130, specific findings need to be made for approval of a tentative parcel map (Attachment 3). The findings to approve Tentative Parcel Map 36329 can be made, and are included in the recommended Findings and Conditions of Approval. Environmental Review The City of La Quinta Planning Department has determined that this application is categorically exempt from further environmental review pursuant to the provisions of Section 15315 (Class 15, Minor Land Divisions) of the California Environmental Quality Act (CEQA). Public Notice This project was advertised in the Desert Sun newspaper and posted on December 1, 2010. All property owners within 500 feet of the site were mailed a copy of the public hearing notice. At the time of the filing of this report, staff had not received any correspondence or comments regarding this proposal. Public Agency Review All written comments received are on file with the Planning Department. All applicable agency comments received have been incorporated into the Conditions of Approval. 3 RECOMMENDATION Staff recommends that the Planning Director approve Tentative Parcel Map 36329, pursuant to the attached Findings and subject to the attached conditions of approval. California Environmental Quality Act - The La Quinta Planning Director has determined that the proposed Tentative Parcel Map 36329 is categorically exempt from further environmental review pursuant to the provisions of Section 15315 (Class 15, Minor Land Divisions) of the California Environmental Quality Act (CEQA), as the proposed map does not result in more than four (4) parcels that are adequately served by existing utility services. 2. General Plan Consistency The proposed Tentative Parcel Map conforms to the design guidelines and standards of the General Plan for Parks and Recreation (PR) designated properties, as set forth in the Land Use Element, as the proposed subdivision meets the approved PR land uses for minimum lot size and density. 3. Public Easements - The design of the proposed Tentative Parcel Map will not conflict with easements, acquired by the public utilities at large, for access through or use of property within the proposed subdivision, in that reciprocal access and fire suppression maintenance needs will be provided for within the project, including non-exclusive access to the "Not A Part" identified portion of the map, pursuant to the executed Quitclaim deed (Doc. #2010-0144189) between Riverside County and the City of La Quinta. 4. Design of the Subdivision - The design of the proposed Tentative Parcel Map complies with the La Quinta General Plan and Specific Plan 1985-005, in that the proposed parcels are in conformance with applicable goals, policies, and development standards, as governed by the Specific Plan for the overall project. 5. Suitability of the Site - The proposed design of the Tentative Parcel Map is physically compatible with the site with regards to level topography for the subject property. 6. Public Health - The proposed Tentative Parcel Map will not result in any increased hazard to public health or welfare, as the design has been reviewed by the appropriate responsible agencies for health and safety issues, with none identified, and the subdivision will not result in any further development within its boundary. 7. Parcel Map Required — A Parcel Map and Final Map are required based on the 61 CONDITIONS OF APPROVAL - RECOMMENDED TENTATIVE PARCEL MAP 36329 CITY OF LA QUINTA DECEMBER 15, 2010 Subdivision Map Act, Section 66426(f), and under authority of the City of La Quinta Subdivision Ordinance (Title 13, Section 13.20.020.A; La Quinta Municipal Code). CONDITIONS OF APPROVAL GENERAL 1 . This Tentative Parcel Map shall expire on December 15, 2012, unless recorded or granted a time extension pursuant to the requirements of La Quinta Municipal Code 9.200.080 (Permit expiration and time extensions). 2. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Tentative Parcel Map, or the Parcel Map recorded thereunder. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 3. This Tentative Parcel Map, and the Parcel Map recorded thereunder, shall comply with the requirements and standards of Government Code § § 66410 through 66499.58 (the "Subdivision Map Act"), and Chapter 13 of the La Quinta Municipal Code ("LQMC"). The City of La Quinta's Municipal Code can be accessed on the City's Web Site at www.la-guinta.org. 4. Approval of this Tentative Parcel Map shall not be construed as approval for any horizontal dimensions implied by any site plans or exhibits unless specifically identified in the following conditions of approval. 5. In accordance with Chapter 3.34 of the La Quinta Municipal Code, future development permits are subject to the Coachella Valley Multi -Species Habitat Conservation Plan/Natural Community Habitat Conservation Plan Mitigation Fee. PROPERTY RIGHTS 6. Prior to acceptance of the final parcel map, the applicant shall acquire or confer easements and other property rights necessary for proper functioning of the C CONDITIONS OF APPROVAL - RECOMMENDED TENTATIVE PARCEL MAP 36329 CITY OF LA QUINTA DECEMBER 15, 2010 proposed development. Conferred rights shall include irrevocable offers to dedicate or grant access easements to the City for emergency services and for maintenance, construction and reconstruction of essential improvements. 7. Pursuant to the aforementioned condition, conferred rights shall include approvals from the City of La Quinta over easements and other property rights necessary for proper functioning of the proposed development not limited to access rights over proposed and/or existing private drive aisles that access public streets and open space/drainage facilities of this tentative parcel map or as otherwise required by the City Engineer. 8. When the City Engineer determines that access rights to the proposed street rights -of -way shown on the approved Tentative Parcel Map are necessary prior to approval of the Final Map dedicating such rights -of -way, the applicant shall grant the necessary rights -of -way within 60 days of a written request by the City. 9. The public street right-of-way offers for dedication required for this development include: A. PUBLIC STREETS 1) Avenue 52 (Primary Arterial, Option A - 110' ROW) — No additional right of way is required for the standard 55 feet from the centerline of Avenue 52 for a total 110-foot-foot ultimate developed right of way. 2) Avenida Bermudas (Secondary Arterial, 88' ROW) — The standard 44 feet from the centerline of Avenida Bermudas. 3) Francis Hack Road (Local Street, 60' ROW) — No additional right of way is required for the 30 feet from the centerline of Francis Hack Road. 10. The applicant shall create perimeter landscaping setbacks along all public rights - of -way as follows: A. Avenue 52 (Primary Arterial) - 20-foot from the R/W-P/L. B. Avenida Bermudas (Secondary Arterial/Collector) - 10-foot from the R/W- P/L. 7 CONDITIONS OF APPROVAL - RECOMMENDED TENTATIVE PARCEL MAP 36329 CITY OF LA QUINTA DECEMBER 15, 2010 11. The applicant shall offer for dedication those easements necessary for the placement of, and access to, utility lines and structures, drainage basins, park lands, and common areas on the Final Map. 12. Direct vehicular access to Avenue 52, Avenida Bermudas and Francis Hack Road from lots with frontage along Avenue 52, Avenida Bermudas and Francis Hack Road is restricted, except for those access points identified on the tentative parcel map, or as otherwise conditioned in these conditions of approval. The vehicular access restriction shall be shown on the recorded final map. FINAL MAPS 13. Prior to the City's approval of a Final Map, mylars of the Final Map that were approved by the City's map checker shall be provided on a storage media acceptable to the City Engineer. The Final Map shall be 1 " = 40' scale. 14. The Final map shall identify the twenty (20) foot non-exclusive access easement across Parcel 4 to the benefit of the area identified as "Not A Part".
