The Community Development and Public Works Departments are currently processing
LLA 2003-407 based on your November 13In application. We have determined that
Parcel "C" cannot be included in the adjustment request per Section 13.32.020(C) of
the Subdivision Ordinance in that the parcel was involved in LLA 2003-398. Our Code
states an affected property may not be readjusted by the same property owner within
a one year time period from the date of approval (i.e., 6-19-03), meaning the
boundaries of Parcel "C" are retained until June 19, 2004. It is our understanding that
LLA 2003-398 was recorded with the Riverside County Recorder's Office on July 7,
2003.

1332.010 Purpose.
This chapter establishes procedures for adjusting the boundary lines between two or more existing parcels.
(Ord. 272 § i (part), 1995)
1332.020 Applicability.
Lot line adjustment may be utilized to reconfigure the size or shape of one lot provided that:
A. All property line segments adjusted are boundary lines of the subject lot (though the extensions of
the adjusted segments may affect several lots);
B. The lot line adjustment does not alter the number of lots; and
The applicant and/or owner of the property has not received approval of a lot line adjustment affecting
any of the lots to be altered, or lots abutting any of the lots to be altered, for a period of twelve months
immediately preceding the date of the current application. (Ord. 326 § 3, 1998: Ord. 272 § 1 (part), 1995)
1332.030 Filing of lot line adjustments.
Requests for a lot line adjustment shall be filed with the community development department on an approved
city application form. (Ord. 272 § 1 (part), 1995)
1332.040 Application materials.
Applications for lot line adjustments shall include the following materials:
A. Grant deeds and/or title reports for all properties affected;
B. An acceptable legal description of each existing and new lot/parcel to be created. Legal descriptions
shall be prepared by a registered land surveyor or registered civil engineer;
C. Four copies of a plat map displaying the new lot or parcel configurations and one reproducible reduction,
eight and one-half inches by eleven inches in size;
D. City processing fees including the cost of map, plat and/or legal description checking as established
by resolution or ordinance of the city council;
E. The location of all structures on the affected properties. (Ord. 295 § 1 (part),1997; Ord. 272 § 1 (part),
1995)
1332.050 Processing procedures.
A. Once an application has been accepted for filing, the community development director shall distribute
the lot line adjustment request for review and comment to the public works department and other appropriate
departments or agencies.
B. Within thirty days of acceptance of the application, the community development director shall either
approve the lot line adjustment, approve with conditions, or deny the lot line adjustment.
C. The applicant shall record new grant deeds which reflect the approved lot line adjustment and shall
provide the city with certified copies of the recorded deeds.

The Community Development Department has reviewed and approved the above referenced
application. Enclosed are the original approved Exhibits A-1 through A-3 (legals for Lots 55,
56 & 57) and B (parcel plat); these items must be filed for recordation by Riverside County
along with revised grant deeds for the subject properties. A copy of the recorded deeds must
be submitted to the Community Development Department along with any future permit
application(s). Please prepare your grant deeds to reflect Exhibits A and B, as approved, and
to indicate the subject case number on all documentation filed for record.
As the applicant, it is your responsibility to record these documents. The City cannot file them
for recordation on your behalf as we have no ownership interest.. The Riverside County
Recorder's office can be reached at 909-486-7000 for further information on fees, etc.
Enclosed is a letter to the County Recorder verifying City approval of the adjustment, and
requesting its recordation.
This application was sent to utility agencies which may have easements affected by this
approval. While no adverse comments were received, the City has approved this adjustment
based on zoning compliance and correctness of the metes and bounds legal descriptions. Any
potential conflicts with recorded utility easements should be investigated by the developer at
the earliest opportunity. By execution of this approval, the applicant agrees to indemnify,
defend, and hold harmless the City of La Quinta from any legal claim or litigation arising out
of the City's approval of this lot line adjustment.

It seemed that in 1991 the zoning for the Sienna site was R-5 (Open Space) and that our 1992 GPA modified this property
to LDR. So, I guess my land use assumption was correct. If you have any follow-up land use information, let it rain.

LLA for Sienna - Hummingbird/Fiesta Area
Kris Schultz states that they are aware of my letter to remove Parcel C from the LLA, but they hope it doesn't affect their
plan check review with PW. I guess they'll pull out the parcel on the next plan check review per Mike Rowe.
Regarding the above problem, I'd recommend that the City's LLA provision be revised to allow LLA's to be processed to
correct legal problems between two parties regardless of the 12 mo. time period (i.e., wall or building encroachments,
etc.). Or, set the LLA legal period to 6 months (two per year). I'd recommend that both provisions be implemented during
a LQMC update.
Brian, did you receive the legal documents from CVWD for this project?

A little background as I know it, and some extra dressing:
This irregularly shaped piece has always been designated for LDR development in all 3 iterations of the GP. So the land
use has never changed. Periodically we have had people come in to ask about developing it, but the logistics of doing so
over time have apparently never penciled out until now. As we discussed, I spoke to some people earlier this year about
this site - they had indicated doing something along these lines. I do not recall a specific product, lot count, etc. As this is
not technically a map (though it is a mapping process under the SMA), they don't need ALRC/PC approval for units. But,
compatibility requirements may apply as this is originally part of TR 2180, and under the PM for Home Depot this was a
remainder and NAP of that map. I think they would be considered pre-5/97 (setback rule to maintain 10' rear yards).

Some of the property owners have gotten wind of LLA 03-407 and are planning to meet with Mike Rowe about this
Admin. request. Questions they have are:
1. When did the land use change? I think this area was changed during the 1992 GP Update. Should I converse with
Land Use Expert Fred Baker?
2. Will two story houses be built? The RL Code would allow this to happen and they don't have an HCA. As the lots
exist, no PC review is required. Did you want to allow 10' rear yards for existing lots, or are they required to have the
20' provision? This Code provision needs to be clarified re: LLA actions (e.g., I'll review policy booklet).
3. Will utilities be undergrouded? I told her that from the pole to the future houses they will, but the developer can go
beyond this requirement with Ill
4. Will these estate houses be allowed the storage of construction equipment? I guess there is a plumbing business
on Hummingbird that has a number of truck and employees come to the site before work. They have complained to
Code Compliance in the past w/ little success.
5. The adjacent residents seem to support residential even though this area was supposed to be golf course open
space. Again, see Item #1.
6. Is Sienna going to try to build more than two houses (e.g., future TPM)?
7. What is your opinion of this creative LLA request?
They don't seem upset about the new CVWD well sites because they've spoken with CVWD about the requirements.
I'm checking ownership history as LLA 398 affects this site. A precise grading plan has been routed to Wally for this
site.
PW states the legals are being revised due to minor errors as noted by their outside consultant. The revisions should
be here soon.

be based on SHORT TERM RATE
NOTE NO. 2: THIS COMPANY REQUIRES CURRENT BENEFICIARY DEMANDS PRIOR TO CLOSING.
If the demand is expired and a current demand cannot be obtained, our
requirements will be as follows:
(a) If this Company accepts a verbal update on the demand, we may hold an
amount equal to one monthly mortgage payment. This hold will be in
addition to the verbal hold the lender may have stipulated.

INFORMATION NOTES:
NOTE NO. 1: The charge for a policy of title insurance, when issued through this title order, will
be based on SHORT TERM RATE
NOTE NO. 2: THIS COMPANY REQUIRES CURRENT BENEFICIARY DEMANDS PRIOR TO CLOSING.
If the demand is expired and a current demand cannot be obtained, our
requirements will be as follows:
(a) If this Company accepts a verbal update on the demand, we may hold an
amount equal to one monthly mortgage payment. This hold will be in
addition to the verbal hold the lender may have stipulated.
(b) If this Company cannot obtain a verbal update on the demand, we will
either pay off the expired demand, or wait for the amended demand, at our
discretion.
(c) All payoff figures are verified at closing. If the customer's last payment was
made within 15 days of closing, our Payoff Department may hold one
month's payment to insure check has cleared the bank (unless a copy of
the cancelled check is provided, in which case there will be no hold).
NOTE NO. 3: California Insurance Code Section 12413.1 regulates the disbursement of escrow
and subescrow funds by title companies. The law requires that funds be deposited
in the title company escrow account and available for withdrawal prior to
disbursement. Funds deposited with the Company by wire transfer may be
disbursed upon receipt. Funds deposited with the Company via cashier's or teller's
checks drawn on a California based bank may be disbursed the next business day
after the day of deposit. If funds are deposited with the Company by other
methods, recording and/or disbursement may be delayed. All escrow and sub -
escrow funds received by the Company will be deposited with other escrow funds in
one or more non -interest bearing escrow accounts of the Company in a financial
institution selected by the Company. The Company may receive certain direct or
indirect benefits from the financial institution by reason of the deposit of such funds
or the maintenance of such accounts with such financial institution, and the
Company shall have no obligation to account to the depositing party in any manner
for the value of, or to pay to such party, any benefit received by the Company.
Those benefits may include, without limitation, credits allowed by such financial
institution on loans to the Company or its parent company and earnings on
investments made with the proceeds of such loans, accounting, reporting and other
services and products of such financial institution. Such benefits shall be deemed
additional compensation of the Company for its services in connection with the
escrow or sub -escrow.
Outgoing wire transfers will not be authorized until we have confirmation of our
recording and one (1) of the following:
1. We have received confirmation of the respective incoming wire.
2. Collection of a deposited check.

delivery services. Such charges include the cost of such messenger service and the
Company's expenses for arranging such messenger service and its overhead and
profit. Special messenger services will be billed at the cost of such services. There
will be no additional charge for pickup or delivery of packages via the Company's
regularly scheduled messenger runs.
