FISCAL IMPLICATIONS: STUDY SESSION: PUBLIC HEARING: Dependent upon the Community Services Commission's direction, a recommendation to approve Art in Public Places (APP) funding of $18,000 for the purchase of two copper art pieces to be placed at the La Quinta Community Center will be forwarded to the City Council. Funding for these projects is available in the Art in Public Places Budget, Account No. 270-0000-451.74-80. BACKGROUND AND OVERVIEW: On February 24, 2011, the Community Services Director received a request from Desert Recreation District requesting consideration for two copper water features to be placed in the fitness area of the La Quinta Community Center (Attachment 1). The water features would be designed and installed by Oregon artist and La Quinta Arts Festival participant, Steve Davis, for $18,000 (Attachment 2). The first art piece is titled "LaQscape" (Attachment 3). This piece is a fountain made of copper and is 8' long and 3' high by 2.5' wide. This piece has three agave plants in an oval shaped container that serves as a holding pool. The second piece is titled "Oui, Marquise" (Attachment 4). This piece is a fountain made of copper and is 4' long and 6'8" high by 2'wide. The piece is an oval shaped piece tapered in the middle in which water flows from the top down the sides into a copper holding pool. Should the Community Services Commission determine that only one art piece is needed at the facility, the Desert Recreation District has identified the "Oui, Marquise" as their first priority. C^ Maintenance requirements for the art work require ongoing care of the water quality to avoid algae and eventual pump replacement. If approved by City Council, Desert Recreation District will be responsible for the maintenance of the artwork as part of an Art Purchase Agreement. ALTERNATIVES: The alternatives available to the Commission are: 1. Recommend the purchase of both "LaQscape" and "Oui, Marquise" for the La Quinta Community Center in the amount of $18,000 using APP funds; or 2. Recommend the purchase of "Oui, Marquise" for the La Quinta Community Center in the amount of $8,900 using APP funds; or 3. The artwork selected is the work of artist Steve Davis from Eugene, Oregon a past and present participant in the La Quinta Art Festival. Mr. Davis has submitted two complementary water features to be placed within the wellness center to enhance the "spa" feel and first rate appearance of the center. It will feature three, in -line agave plants, each its own adjustable height fountain. An 8' x 2' oval copper basin and large stones will surround all three fountains. The second piece entitled "Oui Marquise" is a 6'8" concave oval column of copper, also a fountain streaming from the top of the feature. This piece will be placed in the center of the east wall of the wellness center. The submitted drawing depicts a laser cut DRD logo which will not be included in the completed piece. Mr. Davis will be on hand to install both pieces. These pieces are to be installed within the wellness center. The facility is a public building and the staff will welcome anyone who wishes to view the art. The Desert Recreation District would also request that this location be a distribution location for La Quinta's Art in Public Places tour flyers to distribute to our patrons and guests. Our team members would assist in directing the public to the other locations and having a basic knowledge of all the pieces that APP provides. I am honored that you have selected our work to represent the city of La Quinta's Wellness Center. Copper prototypes have been previously submitted for preview, and the drawings are representative of the project. Descriptions of the three pieces submitted are as follows: 1) Oui, Marquise and Solar Pleds; flush -mounted cylindrical fountains approx. 3'6" w x 6' 8" h, with a 4'+ basin, each in hand -designed annealed heavy gauge copper, silver soldered and ground for a seamless fusion of the metals. Using an acetylene -oxygen torch, the sculptures are heated to bring out the brilliant colors innate to copper. Solar Plexis will have black onyx rocks set in the copper tray base, which will be provided. Oui, Marquise will have a copper catch basin for the water. Both fountain pumps allow water to bubble out of the top and cascade down the front, are adjustable for flow and sound, and are fully self-contained. Both pumps are quiet; neither the pumps nor the power supply cords are visible from any view. 2) LaQscape; fountain consisting of three hand -designed copper agave sculptures in a 2' x 8' oval heavy gauge copper basin With hemmed top. The sculpture is finished with a natural process to enhance the green patina of copper to emulate the green agave plant. Sculptures of the agave plants have been designed to drape over the basin, yet not exceed the 2.5' limit set forth in your requirements. Large rocks will be provided for the copper basin. The fountain pump will jet water through the center of each agave and is adjustable. All pumps are quiet and not visible from any view, and power supply cords are non - obtrusive. These copper fountains are one -of -a -kind pieces that we specifically designed for the Wellness Center and we believe they will reflect the reputation for health and aesthetics that you promote. You will be assured of having unique artwork to beautify your community area for many years to come. Variation in local water supply may affect the patina over time; part of the allure of copper is this natural color enhancement. The price per wall fountain (Oui Marquise or Solar Plexis) is $7,900. Respectfully submitted, j Steve and Kim Davis 13 Go With the Flow Copper Water Fountains Artists Kim and Steve Davis Biography steve's fascination with fire and copper began at age 14 when his artist -father, Walter and his mother, Eleanor, bought him a propane torch for his birthday. He pursued his passion as a hobby for many years, self-taught by watching other artists and "burning myself a lot". He received his Master's Degree in Organization Development from the University of Oregon and worked in hospital administration, private business consulting and teaching at the college level. Kim dabbled in many forms of art, and spent a year in Sweden mentored by her host who owned a weaving shop. She met Steve upon graduation from a medical transcription program where she was interning at the hospital where he worked. They were married in 1985 and both continued working in the corporate world until 1990 when Kim chose to stay home with their baby. Jake was born with Down Syndrome and autism, and, at 21 years old, continues to inspire the decisions and direction of the family. Necessity being the mother of invention, Steve and Kim combined their love for creating art with their self-taught skills; his from pursing his passion for the torch, and hers for design and creativity, and their second creation, Go With the Flow Copper Water Fountains was born. Soon after Jake's birth they left the sanctity of the corporate world in exchange for a home -business that allowed them the flexibility to set Jake's needs as a priority. The Davis' maintain their home -studio in the foothills of Eugene, OR. They use welding and braising techniques, copper, brass, silver solder, enamel, gemstones, acetylene and oxygen to achieve expressions of visual and tactile appeal. The minerals in the water help determine how copper may change over the years, which is one of its beauties. Periodically (once every other month) a small amount of chlorine will be added to the water to prevent any algae growth. A drop or two of water softener (recommended by the artist) will neutralize hard water. The water can be changed after a few months (may have to add some water periodically) by removing with a wet -vac and replacing with fresh water. BACKGROUND AND OVERVIEW: On October 5, 2008, a letter from Roger Hopkins was submitted to the City Council requesting additional dog parks in the City. At that time, the City had two dog parks; one located at Fritz Burns Park and one at Pioneer Park. City Council directed staff to research the potential for additional and expanded dog parks in the City. Staff prepared several alternatives for the Community Services Commission to consider that addressed the pros and cons of several sites including development costs and ongoing maintenance. Costs included fencing, irrigated turf (with the exception of two open space site considerations), shade structures with benches, bollards and/or low-level lighting, drinking fountains for both residents and dogs, signage, and dog bag dispensers. On January 12, 2009, the Community Services Commission reviewed staff's recommendations and listened to public comment regarding dog parks within the City. Some residents expressed their desire to have off -leash dog areas in open spaces such as the Cove Oasis. Residents also commented that they felt the Seasons Retention Basin had enough room to develop a dog park. The Commission recommended to City Council developing the Seasons Retention Basin and expanding the large dog park area at Pioneer Park. At the February 17, 2009 City Council meeting staff proposed a 20,000 square foot dog park at Seasons Retention Basin. Residents expressed concerns about the size of the park and suggested increasing the large dog area. The City Council directed staff to increase the size of the larger dog park area up to three acres. I On January 12, 2010, a Community Workshop to discuss plans for the new dog park was held at the La Quinta Library. Letters were sent to all residents within 500 feet of the potential project. There were approximately five people in attendance for this meeting. There were no concerns addressed at this meeting. The Seasons Dog Park was completed and opened the first week of January 2011. Improvements included tubular steel fencing, seating, shade, drinking fountains, low level lighting, and handicap access to the dog park (Attachment 1). Total cost for the park improvements was $215,935. On January 11, 2011, the City received a petition with over 85 signatures stating that they would like to see the small dog area at Seasons Dog Park made larger (Attachment 2). Staff met with representatives from the large and small dog owners and discussions began on possible options for increasing the size of the small dog area. Several small dog owners have expressed that they only use the large dog area because the small dog area is too small. Additionally, they believe that there are more smaller dogs using the facility than large dogs. Neighbors living adjacent to Seasons Dog Park are aware of the discussions with the dog owners and have asked to be involved in the discussions to express their concerns regarding the potential impacts. Residents on Desert Fall Way, one of two access streets to the park, believe the expansion of the small dog area will increase the traffic and parking in the neighborhood. Parking occurs along the adjacent street and there have been as many as 10 to 12 cars in front of the facility during peak times (Attachment 3). The residents are requesting that no changes be made to the new facility (Attachment 4). Scenario 1 (Attachment 5) will increase the small dog area to just over 7,100 square feet. This option would double the size of the existing small dog area and be the least expensive with an estimated cost of $5,750. Scenario 2 (Attachment 6) will increase the small dog area to over 19,000 square feet with an estimated cost of $7,100. This scenario would potentially impact the neighborhood due to its enhanced size and may attract more facility users. Another suggestion is to remove the center fence at the Fritz Burns Dog Park that divides the small and large dog sections to make only a small dog area. Due to the dog park construction at Pioneer and Seasons, the Fritz Burns facility was over- used and the turf conditions deteriorated. Now that all three facilities are open, the conditions of Fritz Burns will improve as the Bermuda grass grows from its' winter dormancy. This will work until more large dogs start to utilize this new and beautiful facility at which point many of us will feel the need to segregate our dogs by size for the obvious safety reasons. 2. Several City Hall people have come by the park and offered the suggestion that the Southeast fencing be removed and reused to extend the Northeast fence to the concrete wall on the sloped end of the wash. (Exhibit D).While this would certainly increase the area for LITTLE DOGS, most of this additional space is a fairly steep slope. This plan also leaves the little dog area without the benefit of any shade trees, which the LITTLE DOGS as well as their owners would so appreciate during the hot summer months. We think that a better plan would be to remove the Northeast fence and reuse it to extend the Northwest fence to the decorative concrete North wall; (exhibits A B and C) this would provide additional flat terrain as well as 2 or 3 shade trees depending on where you install the fencing. I am attaching drawings A,B,C,D and comments in order of preference for a suggested improvement to the existing installation. All of these considerations for increasing the size of LITTLE DOG PARK leave plenty of space for their larger friends: A. Adds large amount of flat terrain and 3 shade trees B. Adds some flat terrain and 2 shade trees C. Adds minimal flat terrain and 2 shade trees D. While it doubles the existing space, it adds almost no flat terrain and not one shade tree. 3. in my several conversations with Mr. Steve Howlett, he has indicated the possibility of revamping Fitz Burns doggie area by removing the center fence, adding lighting and drinking fountains and converting it exclusively into a Small Dog Park. Several of us question the necessity of this plan along with its expense to the City. It's proximity to SEASON'S PARK almost precludes its use, in favor of our new and beautiful Park, particularly if the any of the above improvements are made for the UITTLE DOGS. In addition, some of us are 2 dog owners (both little and big) and need a park where we can bring both our 4-legged friends. 4. We do not have the time to "oppose" the the people who are wanting changes to the Seasons Dog Park (who are likely retired with lots of time on their hands.) In addition, we feel that we have been extremely cooperative and reasonable about the dog park even though it effects our lives on a daily basis and directly impacts the safety, traffic and quiet enjoyment of our homes. We were told from the beginning that the purpose of this new dog park was to accommodate the large dogs and serve as an "additional" dog park to the city. We were also told that our concerns about traffic and safety would not be a problem because we should not expect over 7 cars at the maximum at any one time. We now know that traffic, safety, noise and disruption to our neighborhood is vastly increased due to the dog park. This burden lies heavily upon the Season Neighborhood. We have even taken it upon ourselves to attempt to alleviate some of that detriment, at our own expense, by putting up signage to help direct traffic. We are also aware that little has been done, and is presently being done, to improve the Fritz Burns dog park, (with tons of parking and no disruption to an immediate residential neighborhood). Because that dog park is in such disrepair, that further drives traffic and detriment to the Seasons Neighborhood. That the La Quinta Community Services Commission and/or the City of La Quinta would even entertain making further structural changes to the Seasons Dog Park at the request of some dog owners is inconsiderate of the full-time residents of Seasons Neighborhood. While we have been 26 more than willing to cooperate and work with the city to find a middle ground, should the needs of the dog owners be further put above the needs of the Seasons Neighborhood residents, we will be forced to begin taking more assertive steps. It is our strong request, as residents of Seasons Neighborhood, that the city of La Quinta consider improving Fritz Burns Dog Park to satisfy the dog owners who are not happy with Seasons Dog Park exactly the way it is. This sign identifies the additional 9 acres of property that was added to the Nature Preserve by the City Council on January 19, 2010. The entire 28 acre facility has eleven signs that are located at the entry points of the property. These signs are all made out of recycled materials and were purchased with grant funds. The population of ducks at the Civic Center Campus has reached a level where it is now necessary to reduce their numbers through non -lethal methods. A contractor will be at the Campus on a daily basis with equipment that will encourage the waterfowl to migrate to another location. This non -lethal program has been used successfully at golf courses throughout the valley and the contractor is highly recommended. In recent years, it has become popular for residents to visit the Campus and feed the ducks. Unfortunately, any wild population will grow to the level of available food. Now, the large duck population is causing damage to the turf, defecation on the walkways, and there is additional concern about sanitation and health.
