INITIAL REDEVELOPMENT
AUTHORIZATION AGREEMENT
THIS AGREEMENT is made by and between the County of
Riverside, hereinafter referred to as "County"; the City of La
Quinta, hereinafter referred to as "City"; and the La Quinta Rede-
velopment Agency; hereinafter referred to as "Agency".
RECITALS
WHEREAS, on July 19, 1983, City requested that the
Board of Supervisors of County authorize Agency to undertake a
redevelopment activity that includes an area located within the
territorial limits of county, contiguous to City; and
WHEREAS, on July 26, 1983, the Board of Directors of
the Coachella Valley Water District requested that the Board of
Supervisors of County authorized agency to undertake a
activity that includes an area located within the territorial
limits of County, contiguous to City; and
WHEREAS, California Health and Safety Code Section
33213 permits a legislative body of a community that has territor
jurisdiction over an area that is contiguous to another community,
to authorize the other community to undertake redevelopment of said
area; and
WHEREAS, on August 9, 1983, the Board of Supervisors of
County adopted Ordinance No. 605 designating and authorizing
Agency and City to undertake activities in the area (hereinafter
referred to as "Area" or "Project.Area") as described in Exhibit
"A" of Ordinance No. 605, which said Ordinance and Exhibit are
attached hereto and by this reference incorporated herein; and

WHEREAS, Section 7 or Ordinance No. 605 requires the

effective date of said Ordinance, that contains the requirements

set forth in the Ordinance.

COVENANTS
6
For and in consideration of the covenants set forth
7
below, the parties agree as follows:
8
1. Studies, Investigations and Hearings: City
9
and Agency, as authorized by County Ordinance
10
No 605, shall take appropriate and necessary
11
actions, pursuant to the California Community
12
Redevelopment Law, to conduct studies, in-
13
vestigations, and hearings, for the purposes
14
df determining whether or not the project,
15
the flood control improvements to be con-.
16
structed, and the project area, are proper
17
and within the limitations and purposes of
18
the law pertaining to redevelopment.
19
2. Financial Information. City and Agency, as
20
soon as possible and not later than the:sub-.
21
mittal of a relevant redevelopment plan to
22
County for its approval, shall transmit to
23
County all information concerning the finan-
24
cial feasibility of the proposed redevelop-
25
ment project and any financial alternatives
26
to utilizing the redevelopment process.
27
3. Background Data. County shall make available

to Agency and City any information and back-

Planning Jurisdiction. City and Agency
shall have only those rights and privi-
leges with respect to the project area _
that are necessary for the purposes of
implementing the redevelopment pro-
posal. County shall retain all rights,
powers, and privileges with respect to
land use controls, development approvals
and authorizations affecting the real
property within the boundaries of the
project area as long as said area
remains unincorporated territory within
the County.
Compliance With The Community Redevelopment
Law. City and Agency shall, at all times
during the term of this Agreement, comply
with the law pertaining to Community
Redevelopment as set forth in California
Health and Safety Code Sections 33300
et.seq., including, but not limited to,
the development of data sufficient to
support a determinationof blight for -the
project area and economic feasibility of
the proposed redevelopment project.

6. Cooperation With Public Agencies Serving
Proiect Area. City and Agency shall
actively solicit the cooperation of
other public entities, having taxing
and public service jurisdiction within
the boundaries of the project area, for.
the planning and undertaking of this
redevelopment project. In this regard,
City and Agency, prior to the adoption
of the redevelopment plan pertaining
to the proposed project and project area,
shall attempt to negotiate and execute
cooperation agreements with the above
referenced public agencies for the pur-
pose of obtaining their mutual assistance
for the project and alleviating any finan-
cial detriment that will result from the
formulation and implementation of the
redevelopment project.
7. County Pass Through Agreement. Prior to
the approval of the final redevelopment
plan for said project by County, Agency.
and City shall endeavor to present to
County, a method to be used in a pass
through agreement whereby County and all
public agencies represented by County's
Board of Supervisors shall be reimbursed
a mutually agreeable percentage of their

prorata share of tax increment allocation
accruing from the project area for the
life and term of the project. Notwith-
standing the above, a pass through agree-
ment shall be mutually approved and exe-
cuted by the parties hereto, prior to
County's approval of the final rede-
velopment plan for the project and project
area.
8. Opinion of Legal Counsel. Prior to
County approval of the final redevelop-
ment.plan for the project and project
area, Agency shall provide to County,
a written opinion of its legal counsel
that the redevelopment plan, relevant
actions, proceedings and contracts, as
proposed or implemented by City and
Agency, are in accordance with the
applicable law.
9. Term and Termination By Parties. The
term of this Agreement shall be one year
from the date of the execution of this
Agreement, unless mutually extended by
the parties hereto. The Agreement may
be terminated by any party to this Agree-
ment, at any time, by transmitting a sixty-
day written notice of the termination to
the other parties of this Agreement.

AN ORDINANCE OF THE COUNTY OF RIVERSIDE
AUTHORIZING THE LA QUINTA REDEVELOPMENT AGENCY TO
UNDERTAKE REDEVELOPMENT OF A PORTION OF THE UNINCORPORATED
AREA CONTIGUOUS TO THE CITY OF LA QUINTA PURSUANT TO
SECTION 33213 OF THE CALIFORNIA HEALTH AND SAFETY CODE.
The Board of Supervisors of the County of Riverside,
State of California, do ordain as follows:
Section 1. The City of La Quinta has requested that the
Board of Supervisors pursuant to Section 33213 of the California
Health and Safety Code, designate and authorize the La Quinta
Redevelopment Agency to undertake the redevelopment of that certain
real property located within the territorial limits of the County
of Riverside, contiguous to the City of La Quinta, more particularly
described on Exhibit A, attached hereto. The Board of Supervisors
finds that said Section 33213 permits the Board to "authorize the
redevelopment of an area within its territorial limits by another
community if such area is contiguous to such other community,"
and determines that the subject properties hereinabove referred to
are contiguous to the City of La Quinta.
Section 2. The Board of Supervisors further finds, pur-
suant to said Section 33213 that any final redevelopment plan for
the project area must be approved by the Board prior to its final
adoption by the Redevelopment Agency and the Board requests the
submission of additional factual and financial information and data
by the Redevelopment Agency prior to the submission of the rede-
velopment plan to this Board for final approval.
Section 3. The City of La Quinta and the La Quinta
Redevelopment Agency are hereby authorized to undertake the rede-
velopment of the described area in all respects as if the area were

Section 4. The City Council and Planning Commission
of the City of La Quinta and the La Quinta Redevelopment Agency
shall have only those rights, powers and privileges with respect
to such area that are necessary for the completion of the proposed
redevelopment project.
Section 5. The redevelopment project area may include
all or any portion of the area described in the attached Exhibit
A, and the redevelopment plan for such area shall be approved in
accordance with all approvals and findings required by the
California Community Redevelopment Law.
Section 6. As long as the subject property remains
unincorporated territory within the County of Riverside, the
County of Riverside shall retain all rights, powers and privileges
with respect to land use controls and development review,
and authorizations for the subject property.
Section 7. Prior to the effective date of this ordi-
nance the City of La Quinta, the La Quinta Redevelopment Agency
and the County of Riverside, shall execute an agreement memorial-
izing the requirements and conditions of this ordinance which
agreement shall contain provisions indemnifying and holding harm-
less the County, its officers and agents, from any activities
undertaken by the City of La Quinta and the La Quinta Redevelop-
ment Agency with regard to all redevelopment activities in con-
nection with this proposed redevelopment project.

The Board of Supervisors of the County of Riverside, State of
California, do ordain as follows:
Section 1. The Board of Supervisors has been requested by the City
of La Quinta to designate and authorize the La Quinta Redevelopment Agency
to undertake the redevelopment of that certain real property located within
the territorial limits of the County of Riverside, continguous to the City
of La Quinta, more particularly described in Exhibit A, which is attached
hereto. The Board of Supervisors hereby authorizes the redevelopment of
such real property located in the County of Riverside by the City of La Quinta
and the La Quinta Redevelopment Agency. The City of La Quinta and the La

City .of La Quinta and the La Quinta Redevelopment Anency to undertake such
redevelopment, and prior to taking action on the Redevelopment Plan of the

completing the Redevelopment Plan. The County of Riverside shall retain all
rights, powers, and privileges with respect to land use controls, development
approvals, and authorizations affecting the unincorporated real property
within the project area as long as said property remains unincorporated
territory within the County of Riverside.
Section 4. The Redevelopment Plan is hereby approved and is
hereby designated as the official Redevelopment Plan for the project area.
