STAFF REPORT
AGENDA TITLE. APPROPRIATE $5,500,000 OF UNASSIGNED RESERVES TO THE LAND
ACQUISITON FUND FOR PROPERTY ACQUISITION
RECOMMENDATION
Appropriate $5,500,000 from Unassigned Reserves to the Land Acquisition Fund.
EXECUTIVE SUMMARY
• City staff has been actively working with property owners, brokers, and end users of
vacant properties to refill or reposition these properties.
• When these properties are in foreclosure, the City receives short notice; appropriating
funds reduces the time to respond to foreclosure sales.
• Per State and City codes, the Council must approve expenditures and property
acquisition.
FISCAL IMPACT
Funds are available in Unassigned Reserves ($16,949,526). Appropriating $5,500,000 to the
Land Acquisition Fund (101-1007-74010) would reduce the Unassigned Reserves amount to
$11,449,526.
BACKGROUND/ANALYSIS
During the past four years, the City has been working with property owners, brokers and end
users to fill vacant properties. Some of the reasons these properties have not been re-
occupied are title restrictions that do not readily accommodate new uses, and/or physical
configurations that do not accommodate new users. Some of these properties are not
maintained and have become blighted. The community has often weighed in, requesting
that the City take action to remedy these situations.
Some of these properties are near foreclosure, which provides the opportunity for purchase.
When this occurs, the City must determine, in short order, whether to participate in the sales
process. Appropriating these funds would position the City to purchase properties if
foreclosures occur. Per State laws and City Codes, the Council must approve all expenditures
from this fund and any property purchases.
ALTERNATIVES
Council may deny this request or reduce the appropriation.
