Bastasini/Tirschwell discussion: Background: On March 25, 1991 Frank Bastasini submitted on behalf of Joel an application for a patio extension at 76-973 Calle Mazatlan. The application was not signed by the owner as required by the CC&R's. Mr. Bastasini represented himself as property manager of this property. Mrs. Dowd received a telephone call from Sherry Sargent asking about a patio extension on the property as she had an offer on the property with a thirty (30) day time limit. She was told to get the forms from Desert Resort Management. As a courtesy Mrs. Dowd met with Mrs. Sargent to inspect the Property on an unofficial basis. Drainage problems were noted near the bedroom patio. It was also noted that there is a large, mature tree between 76-973 and 76-983 which could not be successfully transplanted. There were also several smaller trees approximately eight (8) feet from living room base. Sloping area to common property large drains. Mrs. Sargent was told lot should be staked and there might be problems regarding the tree and the drainage. April 2nd paper work was received requesting removal of the tree and full extension of the living room and bedroom patios. Committee Herb Lieberman, upon inspecting the property for proposed patio extensions, was confronted by Mr. Henderson who resides at 76-983, the adjoining property. Mr. Henderson voiced his objection to the e;:tension of the bedroom patio and the proposed removal of the mature Tai-Q� shade tree:..`.Mr.::Lieberman. suggested that Mr. Henderson write. a lettere to the ,Arc htectural;Committee noting his objections. Subsequently, the Committee instructed Melissa Layton to send an approval or .disapproval notification to the Hendersons to further clarify. their position as adjoining neighbors. Melissa Layton, Manager, on behalf of the Committee made contact. on May 10th to verify the neighbors position. 'Mr. Henderson informed Mrs. Layton that he had not "'changed. his position an"'referred her to his letter of April 10, 1991. Mrs. Layton stated that the written request was sent to update his position on this matter and that Mr. Henderson has referred it to his corporate headquarters (as the legal owners of the property). He indicated he would be opposed to the request. The Committee upon review of the request for reconsideration requests the owner -applicant arrange a meeting within thirty (30) days between their adjoining neighbors -,(the Hendersons themselves and the Architectural Committee to try to. mitigate all issues regarding this request for the benefit of all parties concerned. The Committee also will require the application be modified to contain an engineered drainage plan to insure the protection of both properties and common areas. The Manager will be directed to send a copy of these minutes to Mr. & Mrs. Henderson and the owner of the subject property. PROCEDURE RECOMMENDATION: It has been noted on several applications submitted to the Management by contractors that the owner's signature is missing. Upon advice of counsel, in the future the Architectural Committee and/or Management will review variance applications from the legal owner of rQcerd only. The present gate is illegal and we are grandfathered since it was built (before the city was incorporated) under county codes that no longer are in effect. b. If we add to the building or do any sort of remodeling, the city will require that we redo the front entry, move the gates and gate house back to allow stopping and stack up room for at least six (6) cars. This then creates a problem possibly for Madrugada exit near the gate. c. If we want an "on site office" for managing SRC HOOA only, the city would consider a plot plan amendment from residential to commercial office for either Ron Martel's unit or the La Quinta Joint Venture building since both of these locations housed offices in the past. We would have to show adequate parking for the people using the building. d. Elly Dowd relayed the above information to Mr. Allen. 6. Herb Lieberman.
