Gentlemen:
This is to report that.. the Planning Department has, granted
approval of the above mentioned request for a.2 -foot partial
encroachment into the side yard of a dwelling, based upon the
following findings:
1. That there are circumstances applicable to the
property's shape -and configuration which. limit the
ability to develop the site in common with
surrounding properties;
2. That, approval of the adjustment will not be
detrimental. to the health, safety or general
welfare,of the community at large, nor detrimental
to surrounding properties;.
3.. -That the adjustment is consistent with the intent
and purpose of.the La Quinta Land Use Ordinance.
Approval for this setback' adjustment' shall be as shown on
Exhibit A (copy enclosed) as contained. in the Planning and
Development Department's file for Setback Adjustment #89-006.
The approval shall be used within one year from the date of
this letter; otherwise, it shall be null and void,and of no
effect whatsoever. The term "used" shall mean that substantial
construction shall have been completed in reliance on the
