This Amended and Restated Covenant and Agreement Restricting the
Use of the Residence at 57715 Coral Mountain Court, La Quinta, California
("Agreement") is made and executed this 18t" day of March, 2020 by Bruce
R. Baumann and Janiffer.A. Baumann as the recorded owners of the property
described herein ('`Owners"). The City of La Quinta (°City" ), a California
Municipal Corporation, and, Charter City, is hereby made a party to this
Agreement for the purposes set forth below.
The undersigned Owners hereby certify that they are the property owner
of the following described real property:
57715 Coral Mountain Court
LOT 1, BLOCK 762, PAGE 44, TRACT 29963,
in the City of La Quinta, County of Riverside, State of California
The City of La Quinta issued a, building permit SFD-04-7914 for certain
improvements related to a guest house, which were constructed on said
property. The undersigned Owners, for the expressed benefit of the City, do
hereby covenant and agree to restrict the use of said property as follows:
1. The guest house may not be rented nor sold independent -of the main
single-family residence (Minor ,Use Permit No. 2005-639);
2. All on -site facilities are intended for the sole occupancy of the. property

owner(s), guests, and caretakers (i.e., a maid and/or housekeeper,
etc.); and
3. The guest house shall be used ,primarily as a sleeping facility, and shall
be maintained in accordance with all zoning and other codes as set forth
in the La Quinta Municipal Code, as may be amended from time to time.
This Agreement expressly supersedes that certain Covenant and
Agreement Restricting the Use of the Residence at 57715 Coral Mountain
Court, La Quinta, California, executed on the 315t day of May, 2005, and
recorded on the 8th day of June, 2005, as Instrument No. 2005-0452839 in
the Official Records of Riverside County, California ("Prior Covenant and
Agreement"), and hereby expressly removes the restrictions related to
"kitchen or cooking facilities" as set forth in the Prior Covenant and
Agreement.
This Agreement shall run with the land and shall be binding upon future
owners, their successors, heirs, or assigns, and the Owners themselves, and
shall continue in effect while said accessory building remains on the real
property or unless otherwise released by the authority of the City. All leases
of said, dwelling and/or property shall be subject to this Agreement and
restrictions herein. This Agreement shall be entitled to the remedy of
injunctive relief in addition of any remedy in law or equity.
This Agreement and the provisions hereof are irrevocable, except by the
written consent of all parties to the agreement, including the City. The City
shall have; the right to enforce each and every provision hereof and the parties
agree that the Agreement shall not be rescinded, revoked, modified, or
otherwise amended or changed, without the expressed written consent of the
City first being obtained.
In the event that the owners, their heirs, assigns or successors in
interest, shall fail to perform any obligation hereunder, they hereby agree to
pay all costs and expenses incurred by the City in securing performance of
such obligation, including attorney's fees.

Dear Sirs:
We are the contractor for Dr. & Mrs. Baumann. The set of plans for the
residence called out for an 800 amp electrical service. After requesting 800 amp
service from Imperial Irrigation District we were informed by Planner Sharon
Patino that Imperial Irrigation District does not allow 800 amp service panels for
single family residences. The Planner (Sharon Patino) told us to install 600 amp
and 200 amp services in the electric room at the main house. The 600 amp
panel serves the main house, guest house and pool. The 200 amp panel served
the detached garage/office building.
Imperial Irrigation District is now requesting an o.k. from the City of La Quinta to
use two services at this location.
We are respectfully writing this letter requesting approval for the 2nd electrical
service (200 amp).

230.1 Scope. This article covers service conductors and
equipment for control and protection of services and their
installation requirements.

I. General
230:2 Number of Services: A building or other structure
served shall be supplied by only one service unless
permitted in 230.2(A) through (D). For the purpose of
230.40, Exception No. 2 only, underground sets of
conductors, 1/0 AWG and larger, running to the same

(A) Special Conditions. Additional services shall be

(B) Special Occupancies. By special permission,

permitted for different voltages, frequencies, or phases, or

(E) Identification. Where a building or structure is
supplied by more than one service, or any combination of
branch circuits, feeders, and. services, a permanent plaque
or directory shall be installed at each service disconnect
location denoting all other services, feeders, and branch
circuits supplying that building or structure and the area
served by each. See 225.37.
230.3 One Building or Other Structure Not to Be
Supplied Through Another. Service conductors
supplying a building or other structure shall not pass
through the interior of another building or other structure.
230.6 Conductors Considered Outside the Building.
Conductors shall be considered outside of a building or
other structure under any of the following conditions:
(1) Where installed under not less than 50 mm (2 in.) of
concrete beneath a building or other structure
(2) Where installed within a building or other structure in a
raceway that is 'encased in concrete or brick not less
than 50 mm (2 in.) thick
(3) Where installed in any vault that meets the construction
requirements of Article 450, Part III
(4) Where installed in conduit and under not less than 450
nun (18 in.) of earth beneath a building or other
structure
230.7 Other Conductors in Raceway or Cable.
Conductors other than service conductors shall not be
installed in the same service raceway or service cable.
Exception No. 1: Grounding conductors and bonding
jumpers.
Exception No. 2: Load management control conductors
having overcurrent protection.
230.8 Raceway Seal. Where a service raceway enters a
building or structure from an underground distribution
system, it shall be sealed in accordance with 300.5(G).
Spare or unused raceways shall also be sealed. Sealants
shall be identified for use with the cable insulation, shield,
or other components.
230.9 Clearance from Building Openings.
Service conductors and final. spans shall comply with
230.9(A), (B), and (C).

70-63
(A) Clearance from Windows. Service conductors
installed as open conductors or multiconductor cable
without an overall outer jacket shall have a clearance of not
less than 900 mm (3 ft) from windows that are designed.to
be opened, doors, porches, balconies, ladders, stairs, fire
escapes, or similar locations.
Exception: Conductors run above the top level of a
window shall be permitted to be less than the 900 -mm (3 ft)
requirement.
(B) Vertical Clearance. The vertical clearance of final
spans above, or within 900 mm (3 ft) measured
horizontally of, platforms, projections, , or surfaces from
which they might be reached shall be maintained in
accordance with 230.24(B).
(C) Building Openings. Overhead service conductors shall
not be installed beneath openings through which materials
may be moved, such as openings in farm and commercial
buildings, and shall not be installed where they obstruct
entrance to these building openings.
230.10 Vegetation as Support. Vegetation such as trees
shall not be used for support of overhead service
conductors.
II. Overhead Service -Drop Conductors
230.22 Insulation or Covering. Individual conductors
shall be insulated or covered.
Exception: The grounded conductor of a multiconductor
cable shall be permitted to be bare.
230.23 Size and Rating.
(A) General. Conductors shall have sufficient ampacity to
carry the current for the load as computed in accordance
with Article 220 and shall have adequate mechanical
strength.
(B) Minimum Size. The conductors shall not be smaller
than 8 AWG copper or 6 AWG aluminum or copper -clad
aluminum.
Exception: Conductors supplying only limited loads of a
single branch circuit — such as small polyphase power,
controlled water heaters, and similar loads — shall not be
smaller than 12 AWG hard -drawn copper or equivalent.
(C) Grounded Conductors. The grounded conductor shall
not be less than the minimum size as required by
250.24(B).
230.24 Clearances. Service -drop conductors shall not be
readily accessible and shall comply with 230.24(A) through
(D) for services not over 600 volts, nominal.
