Dear Homeowners:
I .am .pleased to •.inform you .that on August 24, 2013, .the :Board .of .D.irectors of .the Legacy Villas
at La Quinta Homeowners Association (the "Association'); sitting as the. Architectural
Committee, approved your application to expand the patio of the above -referenced unit subject to
the following conditions and limitations:
1. The expansion area, as built, shall be no more than 146 square feet in total.
2. The proposed expansion extending up to 7 feet, 7 inches westward (toward the
mountain) is approved as depicted on the plans you submitted with your
application.
3. The proposed expansion southward towards the building immediately adjacent to
the above -referenced unit is not approved and may not be built. The current patio
wall on the south side of your unit may not be moved.
4. The scalloped patio wall next to the bedroom of your unit may be removed.
5. The scallop feature must be exactly replicated on the new wall that will extend
westward from your unit toward the mountain.
6. The new and/or relocated water and natural gas lines are approved as depicted on
the plans you submitted. The number and location of the water and natural gas
outlets and may not be changed without a new application.
7. The electrical outlets are approved as depicted on the plans you submitted, but your
proposed low voltage lighting is not approved and my not be built. The number and
location of the electrical outlets and may not be changed without a new application.
8. The drainage system for your patio is approved, as depicted on the plans you
submitted. Weep holes are not allowed and ri dynot be nstarlled.
9. No common area landscaping or irrigation lines may be removed or relocated,
except as specifically depicted on the plans you submitted. All common area
.irrigation lines must be replaced in .accordance with applicable law and industry

standards. All landscaping that is replaced must be replaced with the- same type of
plants as currently exist and must be of equivalent size.'
-10. The proposed expansion must be constructed in accordance with all applicable
building codes and the Patio Expansion Guidelines published by the Association.
Building permits must be obtained.at your expense if required .by law. Only licensed
contractors may be utilized.
11. You and your successors in interest will be responsible for maintaining your entire
patio and all additions and modifications to your unit that you construct pursuant to
this approval. You and your successors in interest will be solely liable for all
damage attributable in whole or in part to your patio expansion or any additions.or
modifications to your unit that you construct pursuant to this approval. The
Association shall have no liability by virtue of approving your proposal as described
in this letter.
12. Prior to .beginning work, you must execute .a Maintenance and Indemnity
Agreement (MIA) suitable to the Association, and the MIA must be recorded in the
Official Records of the County of Riverside, California.. No sample or exemplar of any
MIA that anyone may have furnished you should be considered to be acceptable to
the Association.
13.. You, as applicant, must promptly reimburse the Association for all expenses
incurred in connection with evaluating this application, including without limitation,
legal fees, costs to prepare .the MIA, fees to record the MIA and incidental expenses.
In addition, as you may be aware, soil in the vicinity of your proposed patio expansion may
have become unstable due to the recent torrential rains. Although not a condition of
approval, before you begin work, the Association strongly urges you to engage a licensed
civil engineer and/or geotechnical engineer to examine the area on which you propose to
construct your patio expansion and provide appropriate recommendations.
Finally, the Association has incurred legal expenses totaling $1,185.79. in connection with
evaluating your application and preparing a MIA for you to sign. Please send your check to
reimburse the Association for this expense to me at 48-800 Legacy Drive, La Quinta,
California 92253 within fourteen.days of the date of this letter.
