You stated in your letter that Stephanie Eichel informed me that my fence would consist of boards nailed to the neighbor's fence. This is not true and I would have never consented to it. Tdid not know it was constructed that way until my neighbors tore the fence down. When I contacted you about it, you had me call the police, which I did. It was ridiculous of you to have me calling the police claiming you had no responsibility, you knew the fence wasn't built to code. The police told me at that time the fence was not built properly and I should contact you again. I thought then that you would take care of it, but you did not. According to the city inspector they "do not allow" fences to be built the way you chose to do it. Clearly you knew that, . and I have given you 4, months to take care of it. . 3' 2. Regarding the carpet, there is a serious problem. Without even seeing it, you claim the`stains are caused by customer neglect. I assure you, I have not caused huge, 4 feet discoloration in two rooms. These stains increase in number and severity each week If I had caused these problems, or even if cleaning it would solve the problem, I would -gladly do so. Two professionals have looked at the carpet and believe that cleaning it would make it worse since they believe that the problem is either defective carpet, or more likely coming from underneath the carpet.. I will be hiring an inspector to determine the exactcause of the problem if you continue to chose not to respond. , 3. It was also your responsibility to address the spaces in the tile, which you agreed to before I moved in. 4. Tub has still not been repaired, constant problems with both toilets. 5. The fence posts DO interfere with the sprinklers since 1 is to the left of a post and the, other 2 are to the right of the remaining post's. 6. Additional rock to cover the bare spaces in my yard (which was addressed and agreed to in the walk through). 7. I'll accept your excuses for not addressing the other issues on my previous list since my main concern at this point are the carpet and the fence. In addition to the above items I have had constant problems with this house including: 1. No heat in December for almost 10 days, failure to provide proper drainage for heater. 2. No stove for 2:weeks because you did not convert it properly. 3. You built the house with both the washer and dryer connections on the same side of the closet, as well as nothing to connect the dryer to. Therefore I had no washer and dryer for a month, and then you tried to charge me for it. 4: You offered to have someone clean after the tile person since he neglected to cover anything. Everything I own was covered with debris and you, neglected to honor your word. 5. Attempted to amicably resolve problems while you refuse to respond to messages., 6. You have continually talked about.the "quality" of your work'when there wasn't even one appliance in this house that has worked correctly. 7.' Neglected to honoryour word.regarding the finish on the dining room floor. You have treated my concerns with total disrespect, as if I just enjoy complaining. The new fence mentioned in our purchase contract reads "new wood fencing" this was due to the instructions given to your real estate agent that there would only be fence over fence. An entire new fence was not to'be constructed. Additionally the fences were complete prior to close of escrow and you were satisfied at the time. Any matters arising after the close of escrow that were not builder defects are irrelevant. The position of W -R. Enterprises is this. We have made several attempts to re -satisfy your fence issues and once again you stated that the fence was fine and that you were satisfied. We will now consider this issue closed. 2. The sprinklers in the rear yard cannot be obstructed by a 4" post, and if it were possible to be obstructed your Gardener can easily re -adjust the.sprinkler head by turning a screw. W -R Enterprises position on this matter.is this. The item is not a warranty issue therefore it will have no considerationfor repair. Irl the future please reference your home owners manual for industry standards, practices, and repair policies as it Will save both yourself and W -R Enterprises time. 3. The carpet stains are not a warranty issue. As stated before the carpet was new and in perfect condition when you signed off on the walk throughstatement prior to close of escrow. Additionally the statement that you left on my voice mail regarding your carpet cleaner's opinion is just that, it is his opinion and has no relevancy. The carpet installed in your home was purchased through the mill on the same roll and batch as three other homes W -R Enterprises has constructed in your area, and you are the only customer with a problem, thus leading us to believe that the bold stains are from customer neglect. There are no gaps, there is a gap,,and this should have been addressed when the tile setter was out repairing the cracked tiles back in December. We will see if we can get the the setter back to your house while he is in the area. 6. The tile in•your dining room was "the same exact tile from the same manufacturer, however, tiles vary in color batches etc... therefore this is a non issue. Every attempt was made by insuring we used the same manufacturer and tile. 7. There will be no further seeding of the yards. Please reference your home owner's manual or consult a gardener for the best watering methods and maintenance for your yard. 8. Non issue 9: The key to your home is being returned included in this letter envelope. 10. No representative of W -R Enterprises agreed to repair any Stucco or concrete cracks; all were within industry standard and are very minimal. Please reference your home owner's manual. If you feel any of our information is in error please do not hesitate to contact us.
