SUBJECT: Request for Legal Opinion and Course of Action .
A situation involving a septic tank which encroaches onto an
adjacent 'property has come to my attention. I would estimate that
the septic system and the structure that it serves ;to be .30 to 40
years old. The tank itself is actually."encroaching into a vacant
lot by at least 4 feet. The vacant lot is not owned by the same
person who owns the house.
At this time, the' owner of the vacant lot has not applied for a
building permit, but -may do -so in the near future: The location of
the tank would more than likely interfere with the development of
the vacant lot.
The structure is unoccupied at this time. Please advise me on:
a), the right of the owner of the structure;
b) the rights of the owner of the vacant 16t -.on which the
tank is located; and
c) how to proceed if an application for a building permit is
made for either property.
If it is at all possible I would appreciate your opinion on this
matter by September 7, 1990. Thank you in advance for your time:.,
