This approval authorizes you to conduct the event pursuant to the application on file' as TUP 2011-1086 -and SA 2011-1584, and in compliance with all Conditions of this letter. However, please be aware that this a . pproval only constitutes an allowance to conduct this'. event. You must obtain any permits as may be required below in order to physically set up the event. Of course, any. requirements listed herein, which you may have already complied with to date; will be considered moot. The sign permit approval is also incorporated as part of these Conditions. The approval of this event is subject.to the following Findings and Conditions: f FINDINGS 1 A. The public roadways surrounding the event areas are capable of handling the anticipated traffic volumes generated from this event. No significant effects are.anticipated which would be detrimental to the health; safety and public welfare of the community, with implementation of the proposed traffic control plan and required Conditions of. Approvej. B. Page 2 Section 15304(e), Minor Alterations to Land. C. Temporary facilities such as parking, concessions, restrooms, security, lighting, fire and medical services, seating, lighting, etc., will be provided and/or required to accommodate volunteers; employees, and event guests. D. The required Conditions will ensure that residents within the surrounding . area will not be adversely affected by this event. E. Temporary signs directing patron's to the event .will. be displayed along various public streets. in the City. The signs will be placed so that they do not interfere with traffic safety signs or other traffic safety facilities (i.e. signals, warning signs, etc.). Sigh removal- will occur after the event in order to return to the typical traffic condition. CONDITIONS 1. By holding .this outdoor event, the applicant agrees. to indemnify, defend and hold harmless the City of La. Quinta in the event of any legal claim or litigation :arising out of the City's approval of this event. The City of La Quinta shall have the right to select its defense counsel at its sole discretion. 2. The applicant shall comply with all provisions of the La Quinta Municipal Code (LQMC), except where these Conditions call out specific exceptions. 3.. Permits for any temporary structures (e.g. tents exceeding 200 square feet and/or canopies exceeding 400 square feet), stages or open flame devices shall be obtained prior. to their installation. Prior to the event set-up, please contact the La Quinta Building and Safety Department and Riverside County Fire -Safety at 7B_) 863-8886, Planning and Engineering, for any additional requirements .of the Fire Marshal. Fire lanes shall be established and/or maintained during the event. 4. La Quinta Arts Foundation shall contract with the Riverside County Fire Department for provision of services necessary to insure public safety, as determined by their agency through such contractual arrangements. All such contractual arrangements shall include coverage for all City properties used in conjunction with this event. The City. shall. have no responsibility, financial or otherwise,. in establishment or implementation 'of. such contractual obligations. 5. The La Quinta Arts Foundation shall. contract with the Riverside County Sheriff's Department for traffic and - crowd control,, and internal/external security in conjunction. with private security for public safety, as determined by their agency through .contractual arrangements.. All such contractual arrangements shall include traffic. control and security coverage for all City properties used in conjunction with this, event. For any additional - requirements, please contact 'Sgt. John . Crounse at (760) 771-4052..The City shall have no responsibility, financial .or otherwise, in establishment or implementation.of such contractual obligations: 6. Security personnel shalf be easily identifiable to the public by the provision of uniformed personnel.` All designated private security personnel must be licensed by the State 'of California and possess a valid Private Security license. 7. Notice shall be given, to existing property owners and residents surrounding the event areas prior to the event; informing them of the provisions, restrictions and event conditions that .will affect -area, traffic patterns and other routine daily operations in the area. 8... Applicant shall, provide _to the City 10, copies of a contact person information sheet,' listing all designated, event liaisons and their contact information. Specifically, event management staff shall be identified, with their respective 24-hour contact phone, numbers.. This list shall be submitted . to the City's Planning Department, for distribution, no later than March 7, 2012. 9. Applicant shall obtain all City, and County: approvals as necessary, for_ all event -related facilities located outside La. Quinta's jurisdictional boundaries. 10. Certain areas providing access -to the event area are public and, as such, general public access, may not be denied or restricted in any manner that extends beyond the .limits of this event as approved, this includes residential ' access to the neighborhood south of the La Quinta Campus. l 3 Ms. Christi Salamone Temporary Use Permit 2011-1086 La Quinta Arts Festival February 6, 2012 Page 4 11. The applicant shall obtain a (special inspection) building permit for temporary electric service and any other required items (e.g. bleacher, portable generators, etc.). Contact the Building and Safety Department at (760) 777- 7012 for permit requirements. The total fee for special permits is $100 payable at the time of permit issuance. Submit to the Building and Safety Department an application for the above permit. The permit application should name the properly licensed electrical contractor taking responsibility for the installation. The contractor can schedule the site inspection once the work is complete, but before the start of the event. For coordination questions, contact the Building Department at (760) 777-7012 to speak to Burt Hanada. 12. Portable generators shall be shielded to prevent accidental contact with guests. Extension cords shall be ground -secured to prevent tripping. Any lighting shall be directed away from surrounding roadways and surrounding residential properties. No spot or searchlights are permitted. 13. An adequate number of portable restroom facilities shall be provided, to accommodate participants and guests. ADA -compliant portable restrooms shall be provided as required by the Building and Safety Department. 14. All temporary electrical wiring to any concession/vendor spaces shall be secured to prevent physical hazards to the public and participants. Wiring/cords shall not be subjected to environmental or physical damage. Portable generators, Jf used, shall be shielded to prevent accidental contact with guests. Extension cords shall be secured to the ground to prevent tripping. 15: No on -street parking outside the approved event area may be utilized for valet parking services, other than the areas along. Avenida La Fonda which have been identified in the traffic control plan..All on -street parking areas not otherwise restricted under the traffic control plan as approved shall remain available for public use. 16. Prior to use of the off-site unpaved parking lot(s), the applicant shall comply with the requirements for Fugitive Dust Control per Chapter 6.16, L.Q.M.C. The applicant shall provide written evidence acceptable to the City Engineer to ensure that construction and stabilization' of the unpaved parking lots for 4 Ms. Christi Salamone. The applicant shall reserve'the north parking. area of the Library for library patron parking on Thursday- and Friday, as stated in and consistent with the proposed Traffic .& Parking Control Plan. A monitor shall, be - provided during event hours to coordinate pedestrian and 'vehicular traffic into the site e from the north entry driveway. -19. Parking -monitors shall wear light-colored clothi ng and reflective vests as heeded. Flash lights shall be used after dusk.. Parking monitors shall be posted ..at the north, and. south City . Hall parking lots, to. enforce the provisions of the traffic control plan. Parking Monitors shall .allow ingress and egress of the City Hall, parking lottostaff, residents and visitors. during City Hall operating hours (M Th. 7:30 6 -.m. 5:00 a.m.- 5:30 p.m., F. 8:00. a p.m.) 20. The southt parkin - parking lot at City Hall may. be used for eveg on then Thursday and Friday before the event. Loadin.g and unloading of work by participating, vendors may occur in the south "parking lot only on March 7 - 9, 2012, and March 12,. 2012. -, Parking is limited to the - southernmost row of park . ing spaces during the Thursday and Friday of the event. Guest. vendor, artist, and Volunteer parking are 'permitted in the 'south parking. lot ONLY on..Mar.c.h .10 -. 11, 2012...Parking within the south --parking lot shall be reserved for Saturday and Sunday. of the event.' 21. The applicant shall reserve one-half of the City. Hall north parking lot I and driveway area for City Hall -related business parking on. A monitor shall be provided during event hours to coordinate pedestrian and vehicular traffic into the site from .the north entry driveway. b. The monitor shall be stationed at the Calle Tampico driveway in order to limit the number of Festival vendor vehicles,. ensure that City Hall - related customers have access to the parking lot at all times, and enforce the ".Fire Lane" no parking within the entire north and south parking lots. C. No vehicle in the north parking lot shall park'or stand on Calle Tampico within 150 feet in each direction of the driveway. 22. Provide barricade protection at the north dead-end of Calle Kalima to prevent short -cutting by residents and access by. non-residents. 23. If any ground excavations are required, please contact Underground Service Alert (USA) at 1-800-227-2600 or 1-800422-4133. This service is free of charge provided USA is given two days notice prior to commencement of work. 24. The applicant shall obtain an encroachment permit for the off=site directional sign, promotional signs, pole banners and traffic controls placed in the City's rights -.of -way that are allowed and as conditioned with this permit. Traffic control plans shall be submitted along with 'the permit application for City approval. Please contact Ms. Amy Yu, Assistant Engineer II at (760) 777- 7047 to finalize your traffic control plan needs. 25. The applicant shall update the event dates on Notes 4, 7, and 15 on Sheet 1 . of the Traffic Control Plan. In general,. the traffic, c:o.ntrol plan appears complete, except as noted., but additional signs may be required after issuance of this Temporary Use Permit if deemed necessary by the City Engineer. The City of La Quinta reserves the right to require modifications of the work be made at permittee's sole cost for proper sight distance requirements per guidelines in. the AASHTO "A Policy on Geometric Design of Highways and Streets, 5th Edition" or latest, in the installation of •all appurtenances abutting and within the public street right-of-way, 27. The applicant shall I remove all non-appii.c.able traffic control devices on Calle Tampico and Avenida La Fonda during non event hours. Barricades to Calle Guatemala, Calle..Hueneme, Calle. Iloilo; Calle Jacumba and Calle Cadiz may remain during non-event hours but must have adequate reflectorization and visibility 28. The applicant _ shall provide access for the residents along Avenida Nuestra, Calle Guatemala, Calle Hueneme, Calle Iloilo, Calle Jacumba and Calle Kalima within the event area, their .guests, mail carriers, and companies delivering. to them, from Desert Club Drive via Calle Fortuna and Calle Cadiz and Avenida Nuestra, and•. as determined by the' City of -La Quinta. Additionally, the applicant shall provide a simplified traffic control plan to residents showing the access 'routes and restrictions to be in force during the event. 29. At all times .durin the event,'thea lic n 9 �pp a t shall allow residents living on the south side of Avenida La Fonda within the event area, their guests, mail carriers, and companies delivering: to them, access to the westbound one- way Avenida La Fonda and as determined by. the City of La Quints. The applicant shall issue each resident'svehicle a resident placard for access and provide a simplified traffic controlplan to residents showing the access routes and restrictions to be in force during the event. 30. All vendors shall obtain a City Business License. The serving of food and alcoholic beverages! during the event shall be subject to the rules and requirements. of the. Riverside County Health Department and State of` California Alcoholic Beverage . Control, respectively. The applicant shall provide the. City with proof of _ABC approval prior to the event. 31. ' Any damage to public hardscape caused by this event shall be repaired' as directed by the Cityi Engineer. Temporary trash receptacles shall be provided in and around the event areas. All event areas shall be left free .of debris at the end of each day's activities, and after the event concludes. 33. Temporary security fencing shall be installed prior to the event. Perimeter fence installation shall not begin prior to March 1, 2012. Public access to the park shall remain in effect until March 6, 2012. 34. The applicant shall provide parking placards to all City of La Quinta employees. In addition, all. Senior Center employees shall be given wristbands. 35'. The proposed Artist Awards Ceremony 'at the Civic Center Campus is approved, subject to the following requirements: a.. The ceremony. shall take place only on Thursday, March 8, 2012 from 5;30 pm to 7:00 pm. b.. Security personnel must be in attendance at all times during 'the ceremony. 36. Applicant shall comply with the Conditions for Sign Application 2011-1584. FIRE DEPARTMENT 37. Smoking shall not be permitted in any tent or canopy or in any adjacent area where hay, sawdust or any other combustible materials are stored or used unless approved by the fire inspector. NO SMOKING signs shall be posted in all tents and canopies. 38. No fireworks, or open flame, or any other device emitting flame or fire or creating. a .glow capable of igni.tin.g .co.m.b.ustib.les s- hall -be- permitted -.- 39. .. ermitted 39... All . extension cords shall be over current protected and or ground fault interrupter. protected.' No additional taps are to be in any device. The minimum number of extinguishers needed to protect this event is . outlined on the site map. Extinguishers shall be securely installed and .,"mounted 3-5 feet from the ground. Fire extinguishers shall be inspected at time of final inspection. 41. All tent and canopy plans shall meet the requirements of the 2007 California Fire Code. 42. All motor vehicles shall be parked in designated parking areas. Designated Fire Lanes are to be ;kept open with minimum of 20 feet unobstructed access:. at all times. Fire lanes shall be clearly outlined in an approved manner throughout the event grounds. by posting "NO PARKING FIRE LANE".. 43... Generators and internal combustion power sources shall be .separated from tents/canopies by a.1minimum of 20 feet 'an the public., d be isolated from contact with 44.. No fire-lanes, fire hydrants or any. other Fire Department appliances shall be blocked. or obstructed, 45. LP-Gas containers shall be located outside and adequately protected to prevent .tampering, damage by vehicles or other hazards. Equipment such as tanks, valves, tubing.!and other related components shall -be -approved. 46. At least one 40BC or, Class K type fire extinguisher shall be provided for each kitchen with a deep fat fryer, power generator, transformer, cooking operations and at locations where flammable or combustible liquids are stored ed or dispensed. ,.47..- _Location- oofconcession stands -utilized- for- cooking-shall-have -a minimum of 20 feet of clearance from other. concession stands, cooking ten"ts, outdoor cooking, and rides. 48. Operations such as warming of foods, cooking demonstrations and similar operations that use solid flammables`, butane or other similar devices which do not pose an.' ignition hazard, shall be approved upon inspection. 50. Applicant/installer shall. be responsible to contact the Fire Department to schedule a final inspection. A re -inspection fee will be required if more .than one (1) inspection is necessary. Requests for inspections are to be made at least 72 hours in advance and may be arranged by calling (760) 863-8886. The City may elect to add Conditions to. this application request to mitigate any problems that arise not previously addressed herein. This .decision may be appealed to the Planning Commission, provided the written appeal and filing fee of $175.00 are submitted to this Department within 15 calendar days.
