The proposed 8.06 KW PV Array roof mounted photovoltaic system application, in accordance with the California Solar Rights Act mandated guidelines and the product specification/drawing submittal prepared by SolarCity, has been accepted in accordance with the Architectural Guidelines, Association's CC&R's, andMaintenance & Indemnity Agreement' The conditions and/or requirements are applicable to this acceptance. 1. The "Licensing, Maintenance, and `Indemnity" remains a condition 'to finalizing` an .Architectural Variance Application request. As 'explairied, this is, without exception, required of any__ modification to properties within the homeowners' association. The reasons and requirements are described in the,.CC&R's. The "LMI'•' agreement, transfers the HOA's responsibility for the property to the homeowner for the , area of the proposed additions, modifications'or new construction and adjacent work/access area: The area is to include the solar panel system installation and the adjacent T-0" of area for access and work. The roofing area structure, roofing materials and incidentals will never be the same after the Solar System is installed.. Therefore, the. transfer of the HOA responsibilities to the homeowner, and succeeding homeowners, is recorded with the county by the "LMI" agreement. 2. The SolarCity contractual conditions with their client are not a part of this application's review. The homeowner and HOA's relationship is governed by the CC&Rs. Those conditions prevail; the HOA and Architectural Committee's review of your application will not change the governing statutes. 6. The homeowner will provide a written description from SolarCity to the proposed conditions of the warranty at the end of the 20 -year lease. The information is to address the issue of a 20 - year life of the system and status of the installation at that time. 7. The homeowner is responsible to protect both the "LMI" defined area as well as the other roof areas. The HOA maintained roof is subject to damage during this installation, therefore, the homeowner's contractor must prevent damage. 8. The HOA requires notification prior to maintenance of, or additional construction to, the solar system and/or the roof. The following inclusions are pertinent to this application. 1. The homeowner and contractor are to'meet with the Maintenance Manager, William Aceves, prior to the start of any work, in order to document the pre -construction condition of the roof. 2. The panel attachment and framing system being used are a lower profile and closure detail than the prior installation. 3. All damage done to existing HOA property during the construction is to be repaired by the contractor and done to the satisfaction of the HOA. 4. The contractor to repair and./or replace any damaged irrigation, landscape, hardscape, lights or street surface to the satisfaction of the HOA. 5. The contractor is to observe all Association rules and regulations. Contractor vehicles are to be parked on one side of the street. 6. The contractor is not allowed to stockpile any material, equipment or construction debris in the street. All debris must be cleaned up daily. 7. Certificates of Insurance for SolarCity and its subcontractors, must be provided from their insurance carriers and meet the requirements of the Association. 8. It is understood that the homeowner assumes full responsibility for damage to roof, structure and water intrusion. 9. Prior to submitting a Notice of Completion form, a representative of Solar City and the homeowner are to schedule a jobsite inspection with HOA representatives. 10.
