Sincerely-, Tom Hartung Director -6f Building and.. -Safety July 30, 2006 Tom Hartung, Director Department of Building and Safety City of La Quinta 78-495 Calle Tampico La Quinta, CA 92253 Re: California Building Code Requirements for Changes in Existing Dwelling Units Located at 78-151 & 78-153 Indigo, Palm Royale Country Club, La Ouinta, CA Dear Tom: We have nothing but good feelings about being permanent part-time residents of Palm Royale Country Club in La Quinta, and we are very much interested in the City and excited about its growth. We have, however, an urgent situation at the moment. The brand new owner of 78-151 Indigo located directly over 78-153 Indigo, -owned by my wife and myself, is currently replacing the existing carpet and pad by using a solid poured surface as part of the existing floor/ceiling system. As you know, the California Building Code, Appendix Chapter 12, Section 1208A.1.6.1 requires both airborn and impact rated floor/ceiling assemblies, and Section 1208A.3 requires floor coverings that are part of the assembly to be replaced only by other floor coverings that provide the required impact sound insulation. The City of La Quinta has adopted the State of California Building Code which requires the City to enforce Appendix Chapter 12, Division 11A of the State Building Code. As soon as I was aware of what was happening (we had not been consulted or informed) I checked with the new owner of Unit 78-151 Indigo to be sure they were aware of flooring requirements between upper and lower condominium units. The party was not familiar with the requirements but has some sort of working relationship with a newly elected -member of the Homeowner Association Board member who has assured them their new floor covering will be approved. Are Homeowner Board Associations now replacing Building Officials in the City of La Quinta? On Monday, July 24, 2006 I phoned the City of La Quinta to speak with you as the Building Official to review sound control problems which exist between the upper and lower properties mentioned above. The person I spoke to informed me you weren't available at the moment but would return my call as soon'as possible. I called again later to speak to you about sound control, and was told my call would beretumed. On Tuesday, July 25, 2006 one of your staff members called to tell me that the La Quinta Building Department will not be requiring a Building Permit to modify replacement of an existing floor/ ceiling sound assembly at 151 indigo, Palm Royale Country Club, La Quinta. I asked again if I could speak with you on the phone and was told you were busy. As of this date I have still not had an opportunity to speak with you directly about this matter. As you and I are both aware, any approval to modify such a sound assembly should first comply with Appendix Chapter 12, Division I IA, after which the proposed project should be reviewed by the City of La Quinta Building Department, not the Palm Royale Homeowner's Association. Additionally, as you and I are also aware, a review would be conducted by the La Quinta Building Department even if no Building Permit were to be required, to ensure compliance with the State of California Building Code. It would be much appreciated if you, as Manager of the Building and Safety Department for the City of La Quinta, would review this situation and take appropriate action, as I am sure you well understand the need for effective sound management associated with permanent condominium residences. By enforcing La Quinta's own building code (i.e. the State of California Building Code) the matter could be dealt with effectively, as a review for compliance would first be required. It is fi-ustrating and unfair for my wife and myself to have to take the time and trouble to insist that professionals follow their own rules, and it is wrong that my wife and I are should be expected to suffer any subsequent consequences because the La Quinta Building and Safety Department neglects to enforce their own Building Code, which could effectively deal with this matter. Installation of any proposed floor/ceiling assembly not in compliance with the Sound Transmission Controls required by the State of California Building Code will result in a monetary loss in value of our property (located directly below this non -complying unit), not to mention the mental anguish that my wife and I will suffer because of resultant impact noise due to the City's lack of enforcing sound control compliance between floors Neither my wife nor myself could care less about other people's business, but disturbing day and night impact noises would certainly be minimized if you would enforce the Building Code that you already have in place.
